Other Opinions About the U.S. Electoral College

A prior post discussed the July 6 Supreme Court decisions about the “faithless electors’ in the U.S. Electoral College for electing the president and vice president and initial reactions to those Supreme Court cases. Here are some additional reactions to those cases as well as other commentaries about the U.S.’ complicated system for election of a president and vice president.

Jesse Wegman[1]

Jesse Wegman, a member of the New York Times editorial board and the author of a book about the Electoral College, rightly says these recent cases did not address the issue of the continued existence of that institution, which, he says,” is rotting American democracy from the inside out.” First, it potentially can award “the presidency to the candidate who earns fewer votes among the people as a whole — which violates the fundamental premise of majority rule.” Second, it violates “the constitutional mandate of ‘one person, one vote.’ In the presidential election, the value of your vote depends on where you live. If you live in one of the half-dozen or so ‘battleground’ states, it matters hugely. If you happen to live in a ‘safe state,’ as a vast majority of Americans do, it’s effectively irrelevant.”

The Electoral College was created in the late 18th century Constitution because its “framers worried that most voters — who rarely ventured far from home and had no easy way of getting information quickly — couldn’t know enough about national candidates to make an informed decision.” However, Wegman says, the College has never worked that way with the immediate formation of national political parties.

As a result, Wegman argues, “there is no remaining rationale for the Electoral College. What remains is a system that serves no purpose other than to erase the votes of 100 million Americans every four years, making them bystanders to the most consequential election of all.” In short, amend the Constitution to eliminate the Electoral College.

Wall Street Journal[2]

A Wall Street Journal editorial also points out that these new cases do not “address the most controversial question about the Electoral College, which is whether the U.S. should have one at all.”

The editorial, however, does not address that issue either. Instead, it discusses the National Popular Vote Interstate Compact whereby some states agree to grant their electors to the winner of the nationwide popular vote and which presumably is valid under the Opinion of the Court. However, says the Journal, Justice Thomas in his concurring opinion, points out that the Constitution in the last clause of Article I, Section 8, states, “No State shall, without the Consent of Congress . . . enter into any Agreement or Compact with another State.”

In any event, that compact currently has 16 members (15 states and the District of Columbia) with a total of 196 electoral votes and by its terms would go into effect when enough additional states join to constitute a majority of the Electoral College (270 votes).

Richard L. Hasen[3]

 Just before these Supreme Court decisions, Richard L. Hasen, a professor of law and political science at the University of California, Irvine and the author of a leading book on problems of the U.S. election system, noted several problems with that system.

  • First, it “features deep fragmentation of governmental authority over elections. Not only does the United States use a highly decentralized and localized election system that gives many powers over national elections to state and local bodies, but also, even within the approximately 10,500 bodies expected to run the 2020 election, there is sometimes disagreement over who has decision making authority over voting rights decisions.”
  • Second, “protection of voting rights in the United States is marked by polarized and judicialized decision making.”
  • Third, U.S. “ constitutional protections for voting rights remain weak. The U.S. Constitution contains no affirmative right to vote. It speaks of voting rights mostly in the negative: thanks to a number of constitutional amendments, it is now illegal to bar someone from voting on the basis of race, gender, age of at least 18, or through the use of a poll tax.”
  • Fourth, this “decentralized, federalist approach to voting rights has led to a self-perpetuating system of voting inequality, where in some places you may be disenfranchised even if you do everything right.”

Therefore, Hasen proposes the following short-term remedies. “All states need to expand opportunities for online voter registration in time” for this November’s presidential election. . . . Congress needs to adequately fund additional expenses related to running an election during the pandemic. . . .  States need to form independent bipartisan task forces to conduct full and independent investigations into why areas with more poor voters and voters of color saw significant problems voting in person during the primaries.”

In addition, Hasen advocates for a new constitutional amendment that would “guarantee all adult citizens the right to vote in federal elections, establish a nonpartisan administrative body to run federal elections that would automatically register all eligible voters to vote, and impose basic standards of voting access and competency for state and local elections.

 Wilfred Codrington III [4]

Last year Codrington, a Fellow at the Brennan Center for Justice at NYU School of Law, pointed out a racist motivation for the creation of the Electoral College at the Constitutional Convention.

“The populations in the North and South were approximately equal, but roughly one-third of those living in the South were held in bondage. Because of its considerable, nonvoting slave population, that region would have less clout under a popular-vote system. The ultimate solution was an indirect method of choosing the president, one that could leverage the three-fifths compromise, the Faustian bargain they’d already made to determine how congressional seats would be apportioned. With about 93 percent of the country’s slaves toiling in just five southern states, that region was the undoubted beneficiary of the compromise, increasing the size of the South’s congressional delegation by 42 percent. When the time came to agree on a system for choosing the president, it was all too easy for the delegates to resort to the three-fifths compromise as the foundation.”

This racial impact affected the election of 1800, when Thomas Jefferson defeated John Adams, 73-65 in the Electoral College and “metaphorically rode into the executive mansion on the backs of slaves,” according to a Yale Law School professor, Akhil Reed Amar.

In the 1876 presidential election, Democrat Samuel Tilden won the popular vote but not the Electoral College vote due to disputes about the status of some electors. An ad hoc commission ultimately awarded the disputed electors to Republican Rutherford Hayes with his agreeing to remove federal troops in the South that were intended to maintain order and protect black voters.

Max Boot[5]

Boot, an historian and Washington Post columnist, reports that he recently participated in a “war game” over a hypothetical narrow Biden victory in the Electoral College, 278-260, including narrow wins in three swing states—Michigan, Wisconsin and Pennsylvania—where Republicans control both houses of their legislatures. Although all three states have Democratic governors, who usually certify election results, there is nothing to prevent the legislatures from certifying different results, especially if Trump “will stop at nothing to avoid the stigma of being branded a ‘loser’” and if hypothetically he and his allies concocted allegations of election fraud in those three states. The resulting dispute over these three states and hence the results of the election could well end up in the Supreme Court, and who could predict how they might resolve the dispute, given what it did in the 2000 election contest between George W. Bush and Al Gore.

A related concern is whether local, state and federal funding for the expenses of conducting the upcoming election in this pandemic will be adequate. This especially is true for the U.S. Postal Service with the anticipated mailing of election ballots.

David Rothkopf[6]

A lot of these current issues about the Electoral College are prompted by the outrageous conduct of our current president, Donald Trump, who is the “embodiment of the Founders’ worst fears.” So says David Rothkopf, a former professor of international affairs at Columbia University, Johns Hopkins and Georgetown University, former CEO and editor-in-chief of Foreign Policy magazine and a senior official in the Clinton Administration.

Rothkopf continues, Trump “has invited our enemies to interfere with our elections to help him win, then sought to do it again. He has misused federal resources, inappropriately elevated his own family members, and enriched his own businesses. He has repeatedly attacked the First and the Fourteenth Amendments. He has had infants thrown in cages and denied relief to Puerto Rico in the wake of Hurricane Maria at the cost of thousands of lives. He has gutted environmental protections and attacked alliances that the US spent decades building and maintaining. And now he has mismanaged the worst public health crisis in a hundred years, overseen the greatest economic crisis since the Depression, and attempted to use the US military to crush legitimate protests on the streets of the capital.”

Moreover, “in the space of just a few days, . . . [Trump] was revealed to have endorsed concentration camps in China and to have again sought the assistance of a foreign adversary in winning a US election, was quoted as calling for the deaths and imprisonment of US journalists, defended the slave power traitors of the Confederacy, admitted that he suppressed testing during the pandemic because true data about the rate of infections would harm him politically, sought to fire more truthtellers in the administration and had his attorney general remove an official in charge of investigations into him and his supporters. He was reportedly briefed about a Russian scheme to place bounties on American and allied troops in Afghanistan, and not only did nothing about it but continued to act as an advocate for Putin. And so it goes on… before we even consider the many complaints about his character—his racism and misogyny, his ignorance and contempt for science and history, his lies, his narcissism, his vulgarity, his demagoguery. Has there ever been a public official in US history so unable to relate to others, show an emotion besides anger, or view the world through any means but his own self-interest?”

Conclusion

 Support a constitutional amendment to abolish the Electoral College!

U.S. Commission on Unalienable Rights’ Meeting, November 1, 2019

Here is a summary of the November 1, 2019, meeting of the U.S. Commission on Unalienable Rights featuring  presentations by Cass Sunstein, the Robert Walmaly University Professor at Harvard Law School, and Orlando Paterson, the John Cowles Professor of Sociology at Harvard University.  [1]

Chair May Ann Glendon’s Introduction

Chair Glendon “explained that the Commission is still in the very beginning stages of its task, which is to advise the Secretary of State on the role human rights play in foreign policy, with that advice grounded in America’s founding principles, as well as the international commitments the United States made after World War II. Glendon emphasized the Commission’s independence: Commissioners are obliged to give the Secretary their best advice, to be non-partisan, and to consult broadly with experts from Department of State (for example, in the Bureau of Democracy, Human Rights, and Labor (DRL)), but also with outside activists and academic specialists. Glendon praised the speakers who participated in the Commission’s previous meeting in October.”

Commissioner’s Comments

“Each commissioner explained his/her professional background and reflected on the speakers from the last session.” Of particular note is the following comments by Commissioner  Dr. Jacqueline Rivers, who “voiced a sentiment, shared by others, that bridged the different topics and time periods the Commission will consider in its work. For Rivers, one crucial question is how to avoid repeating a ‘major failing’ at the time of the Founding, when there was a great articulation of rights (for example, in the Declaration of Independence) but also, because of the prevalence of chattel slavery and the political subordination of large segments of society, a graphic failure to live up to those principles. As she contemplates how the United States can prevent that same failure from re-occurring internationally, one focus for Rivers will be on achieving consistency in forcefully stating, and then implementing protections for, human rights.”

Professor Cass Sunstein’s Presentation

Sunstein opened by saying he would make two major points:

  • First, . . .the U.S. conception of rights [in 1776] was a historical outgrowth of a sustained attack on monarchical legacy and the notion that some people rank above others by birth. Rights, [ however,] reflected a belief in human  dignity and citizenship.
  • Second, ”’freedom from desperate conditionshad widespread support at the Founding. Although it was not constitutionalized in any sense, . . . the articulation of, and public support for, this freedom later culminated in President Franklin Delano Roosevelt’s Second Bill of Rights. Thus, . . . there is a degree of continuity between newer, twentieth century conceptions of rights and freedoms and those from the founding era.” (Emphases added.)

Rights and citizenship: the “American Revolution is often considered to be ‘conservative,’ relatively speaking – or at least cautious and milder than the French and Russian revolutions. But, . . . that characterization is misleading, given the major break with British legacy that occurred in the American colonies in the decades leading up to the revolution. During that time period, cultural notions of republicanism were popular, which led to fresh thinking about what governments ‘do’ and the purposes for which they exist. In America, ‘radical’ republicanism entailed self-government and eliminated social class-based hierarchies of various kinds. [The] so-called ‘down look’ of the poor – a sign they ‘knew their place’ and had resigned themselves to their lowliness. This down look changed as the explosive new ideas of liberty and equality took hold on society. John Adams wrote with amazement that ‘Idolatry to Monarchs, and servility to Aristocratical Pride, was never so totally eradicated from so many Minds in so short a time.’ . . . [This] quote is significant because Adams’s surprise is palpable – he did not express such obvious ‘shock’ in any of his other writings. The transformation upon which Adams was remarking involved people who once regarded themselves as subjects coming to regard themselves instead as citizens, who possess sovereignty. This is a major development, . . . and to lament on what the revolution did not accomplish is to miss the remarkable social and political restructuring that it set into motion.”

Citizenship as unifying theme in Bill of Rights. Shifting to the U.S. Bill of Rights, . . . the American Founders sought, above all, to guarantee the preconditions of effective self-government. (. . .We fail to understand the Bill of Rights if we see it as based solely on opposition to government, or on a kind of laissez-faire individualism.) “

“[Among the writings [of the Founders] is a convergence of several intellectual traditions, both theological and otherwise.”

“Turning to individual provisions of the Bill of Rights, . . . the jury trial protected by the Sixth and Seventh Amendments . . .  should be thought of not only in terms of the individual legal right created. The jury trial also allows for the participation of citizens – ones, who, prior to the Revolution, may have borne the ‘down look’ – in American civil and criminal justice systems. In deciding individual cases, jurors can modify the harsh edges of law by finding defendants innocent in close cases. And in carrying out these [duties?]. jurors also receive an education in the law itself.”

“In the same regard, . . . the right to private property, which creates a [sense?] of individual control (by protecting people’s holdings against government taking without compensation) but is also necessary for the status of citizenship. Since private property provides a means for people to live and support themselves, citizens possessing it are not solely dependent on the good will of government.”

“As for the Second Amendment, . . .  it is controversial in modern times. . . .[It] is a political right, which, at a minimum, prevents the federal government from outlawing state militias. These militias perform important democratic functions – by providing a training ground for the cultivation of virtue, and a constraint on potentially tyrannical government.”

The “Bill of Rights is not only about creating a sphere of individual liberty, free of government control, but also about creating conditions that would allow for the robust practice of citizenship.”

Social and economic rights: . . . [The] Founders gave no serious thought to including social and economic guarantees in the Bill of Rights. But . . . some of the founders’ writing, while not at the constitutional level, shows a surprisingly strong commitment to such guarantees. James Madison, for example, wrote of ‘withholding unnecessary opportunities from a few, to increase the inequality of property, by an immoderate, and especially unmerited, accumulation of riches.’ Madison also appeared in favor of ‘rais[ing] extreme indigence toward a state of comfort.’ Meanwhile, Thomas Jefferson, while not a framer of the Constitution, exerted a strong influence during the founding period and wrote of ‘lessening the inequality of property’ by ‘exempt[ing] all from taxation below a certain point, and . . . tax[ing] the higher portions of property in geometrical progression as they rise.’ . . . [S]ocial theorists Montesquieu, John Locke, and Thomas Paine, all of whom were read by the American founders,. . . [in their writings] similarly suggest a commitment to social and economic rights. [D]uring the constitutional framing period, there was widespread support in America for legislation that would provide poor people with the basic necessities of life and that, unlike in England, where so-called ‘outdoor relief’ to able-bodied poor people was restricted, nearly all U.S. states allowed that form of assistance.“

“FDR and the Second Bill of Rights: . . . In 1944, President Franklin Delano Roosevelt (FDR) delivered a State of the Union address to Congress, which connected the war against tyranny with the Great Depression and the subsequent effort to combat economic distress domestically. The speech characterized ‘the one supreme objective for the future’ as ‘security,’ a term with multiple meanings. For FDR, security entailed not only ‘freedom from fear’ but also ‘freedom from want.’ . . . FDR explicitly used the, threat from Germany and Japan as an occasion for a renewed emphasis on providing protection against the most serious forms of human vulnerability at home.”

“In his speech, FDR looked back to the framing of the Constitution and argued that the unalienable rights at the Founding had proved inadequate, since it had become obvious that ‘true individual freedom cannot exist without economic security and independence.’ That provided the justification for FDR laying out his ‘Second Bill of Rights,’ which included the right to employment, to a dwelling place, to medical care, and to a good education, among other rights. . . . Roosevelt did not mean for these rights to be judicially enforceable, and indeed . . . FDR would have ‘deplored’ this idea. In his speech, however, FDR did call on Congress to ‘explore the means for implementing the economic bill of rights-for it is definitely the responsibility of Congress to do so.’”

“FDR’s speech is significant for marking the collapse of the idea, prominent in the period before the New Deal, that freedom comes from an absence of government. It was also important because the Second Bill of Rights went on to influence the content of the Universal Declaration of Human Rights, the International Covenant on Economic, Social, and Cultural Rights, and dozens of foreign constitutions.”

Sunstein’s Responses to Commissioners’ Questions

The Commission’s Executive Director, Peter Berkowitz: Heagreed that the jury trial right is essential to citizenship in a liberal democracy, . . . [but] that few would contend the jury right to be appropriately labeled as a ‘human’ and/or ‘unalienable’ right. Is a jury trial, Berkowitz wondered, essential to human flourishing in non-democratic regimes?“

  • Sunstein responded: “[C]ertain protections in the [original] Bill of Rights are properly characterized as unalienable; off the top of his head, he . . . [said] that free speech and property rights, for example, qualify. . . . [He] was ‘hoping and gambling that many cultures have a ‘Locke-type’ figure that provides the philosophical founding for these rights in non-Anglo American traditions. When it comes to social and economic rights, Sunstein said the situation is somewhat different. Were those rights to qualify as unalienable, what is necessary would be ‘a theory about how, if people are living in desperate conditions, a universal right is being violated.’ He said that, in some sense, the destitute living on the street without food or shelter suffer from their humanity being ‘annihilated,’ but also said he was ‘groping for right verbal formulation’ to express this notion in terms of rights.“

Rabbi Dr. Meir Soloveichik, the Director of the Zahava and Moshael Straus Center for Torah and Western Thought at Yeshiva University and rabbi of Congregation Shearith Israel, said that “the founders often stressed that certain rights are pre-political – like the free exercise of religion. He asked . . . if some of the other rights contained inside the Bill of Rights are also pre-political. . . . Soloveichik also asked whether the promotion of social and economic rights at the hands of government, . . .will inevitably clash with individual liberty. (By way of example, Soloveichik noted that expanding health care coverage at times has been in tension with individual religious liberty claims.)”

  • Sunstein said the following: “[T]ension between different rights is inevitable, regardless of whether social and economic rights (rather than other kinds) are involved. Citing the U.S. Supreme Court decision Wisconsin v. Yoder, Sunstein said that it is clear that certain kinds of rights—for example. the right to religious free exercise – prevail over others in legal disputes, and that, in order to decide, courts sometimes will look at the severity with which a right is being infringed, a question over which reasonable people may disagree. He said that clashes are an occasional but not devastating consequence of a regime recognizing multiple rights. . . . Sunstein [also] said that the majority of the rights contained in the Bill of Rights are pre-political, but that that is not at odds with acknowledging the Bill of Rights as being fundamentally ‘about’ citizenship.”

Professor Paolo Carozza, Professor of Law and Concurrent Professor of Political Science at the University of Notre Dame, where he also directs the Kellogg Institute for International Studies, asked Sunstein to elaborate on the nature of social and economic rights, and his rationale for saying that they are judicially unenforceable. . . .”

  • Sunstein “said that he had a ‘mundane’ account of why they are not judicially enforceable, and that is because allocative decisions are not well suited, institutionally, for judicial oversight. He cited the example of judges in South Africa facing severe challenges when attempting to enforce social and economic rights in that country.”

Dr. Christopher Tollefsen, Distinguished Professor and Chair of Philosophy at the University of South Carolina,“brought up the right to a jury trial, saying that he would have thought that the notion underlying it is not citizenship, . . ., but rather fairness. Tollefsen asked if there was a more pluralistic set of directions that the notion of dignity ‘can go in’ that does not need to get ‘filtered through’ citizenship.

  • Sunstein “agreed that the jury right is most fundamentally about fairness, but he pushed back against Tollefsen’s labeling citizenship as just a ‘bonus’ in the Bill of Rights. Sunstein said that it was more like a by-product of notions central to our constitutional system. Sunstein further explained that it is hard to understand the Bill of Rights outside the context of a revolution recently fought for republican self-government. In his view, modern observers tend to read it in a way that is de-historicized.”

Dr. David Tse-Chien Pan, Professor of German at the University of California, Irvine, “wondered if, in U.S. foreign policy, any defense of human rights necessarily entailed creating republican self-government everywhere. He asked Sunstein if, in his view, there could be a . . . [more] modest role for human rights that does not necessitate regime change.”

  • Sunstein “answered that yes, the U.S. can hold republican self-government up as ideal while still working with other types of regimes. In Sunstein’s view, the writings of the American founders speak deeply to nations and peoples that are ambivalent about republican self-government, and part of the reason may be the writings’ emphasis, though never quite expressed in these terms, on human dignity.”

Dr. Russell A Berman, the Walter A. Haas Professor in the Humanities at Stanford University and a Senior Fellow at the Hoover Institution and current Senior Advisor in Policy Planning at the Department of State, “asked why FDR would have, in Sunstein’s words, ‘deplored’ the judicial enforcement of social and economic rights.”

  • Sunstein “said that FDR was not a fan of judicial ‘aggressiveness’ generally and would have been attuned to tradeoffs and difficulties inherent in economic allocation. That FDR nonetheless was insistent that social and economic guarantees be labeled as ‘rights,’ in Sunstein’s view, speaks to the president’s view that they have some sort of moral foundation. Furthermore, that FDR was willing to embrace the rights in a presidential speech, but would probably not have elected for [them to] be extensions to the Bill of Rights, may have had something to with his belief – shared by James Madison in his own day – in ‘infusing the culture’ with ideas that eventually become part of the national fabric. Sunstein pointed out that the right to education, and bans on monopolistic corporations, still widely embraced in the 21st century, show that Roosevelt really did play an enduring role in shaping our national consciousness.”

Professor Hamza Yusuf Hanson, the President of Zaytuna College, the first accredited Muslim liberal arts college in the United States, and Dr. Jacqueline Rivers, Lecturer in Sociology at Harvard University, exchanged ideas regarding private property. Hanson said that scholar Richard Weaver once described it as the ‘last metaphysical right’ that people agree upon, but that, in the 20th and 21st centuries, it has not received as much attention as it did in the time of Locke and the American revolutionaries.”

  • Sunstein “said that, in Western countries, the perceived need to fight for property rights is not acutely felt, because property is relatively secure in these places. But in other countries where those rights are most needed, the idea of private property is under attack.

Rivers “segued into consideration of other types of property. She noted that the American welfare system is still weaker than in some other Western countries. Could that be, she wondered, because America has become overcommitted to protecting private property?”

  • Sunstein “described himself as a proponent of private property and saw no conflict between endorsing private property rights alongside social welfare benefits. Sunstein brought up President Ronald Reagan, for whom he once worked, saying that Reagan was on record for endorsing a right to education and other rights conventionally associated with more socially progressive advocates.” 

Chair Mary Ann Glendon thanked Sunstein for being helpful in achieving one of the most challenging parts of the Commission’s overarching task – showing a degree of continuity between the Founding and the New Deal, and from New Deal to the Universal Declaration of Human Rights (UDHR). She asked if the Bill of Rights leaving out social and economic guarantees could be thought of as an instance in which the founders took for granted the local associations and arrangements that would care for indigent persons.

  • Sunstein “answered affirmatively, saying that the Constitution contemplated institutional pluralism. He noted that, in the early years of the republic, the national government had a limited role and the Bill of Rights did not apply to states.”

Professor Orlando Patterson’s Presentation

“Patterson’s first main point was that the idea of rights and the idea of freedom overlap but are not interchangeable.”

“The United States has long seen itself as the ‘Land of the Free,’ and, as the global leader of the free world, its “mission” has been to ensure freedom of its citizens to a degree not enjoyed in many other countries. But Patterson said that another concept has come to compete with this notion. Especially since World War II, U.S. has come to embrace individual rights in fits and starts.”

“Patterson expanded on the distinction (freedom vs. rights) by clarifying what, in his mind, ‘freedom’’means. He referred to it as a tripartite idea.”

  • First, human persons are free, at least to the degree they are not under power of others, to make choices, to do what they want, and to achieve the desires they set for themselves.”
  • Second, they are free to exercise power to influence the world. (Patterson called this “empowerment” and cited Indian economist and philosopher Amartya Sen.) For long periods of human history, Patterson argued, this type of freedom was associated with power over other people. This is important to recognize because, for him, freedom is not the opposite of power, even though it is commonly held to be.”
    • “To support his argument.Patterson mentioned “the Southern slaveholding conception of freedom” in the United States, which entailed the freedom of wealthy landowners to control the bodies and labor of African-Americans and was famously discussed by Abraham Lincoln and Stephen Douglas in their debates.”
    • “Even though slavery has been abolished in America for many years, Patterson said that freedom as ‘power over others’ continues in the 21st century – in the form of some people controlling large amounts of property.”
  • Third, people are free, according to Patterson, to share in the collective power of groups. He referred to this as civic freedom, and as best realized through democracy.”

“Patterson called tripartite freedom quintessentially Western in origin, rather than universal. He explained that, although English philosopher John Locke held freedom to be ‘written on the heart of man’ (Patterson’s words), freedom actually involves an ancient, culturally specific, way of looking at the world. What is uniquely Western is not only the tripartite nature of freedom, but also its relative status – in other words, that freedom is valorized as one of the pinnacle values of civilization. Contributing to this prioritization, . . [was].the religion that fashioned the West, Christianity (which emphasizes redemption, sacrifice as the way to free one’s self from spiritual slavery), as well as earlier, Roman notions of liberty. Patterson compared the spread of freedom across the world to Christian missionary work, arguing that freedom became more universal over time. This, in his view, has not always been without negative consequences. Military interventions in Iraq have shown that assuming all people (and especially non-Westerners) to desire freedom can be wrong and even dangerous.”

“‘Rights’ are distinguishable from freedom. For Patterson, they represent a set of claims concerning our condition as human beings. The claims are moral in nature, and their protection is necessary to preserve our most fundamental sense of what it means to be human. Rights are inherently egalitarian, whereas with ‘freedom,’ Patterson argued, there is no such assumption of equality.”

“Patterson then commented on America’s complex relationship between rights and freedom, stressing that the American tradition differs from the European one. In Britain, Patterson said, there frequently has been skepticism about rights. The English jurist and social reformer Jeremy Bentham, for example, called natural rights “nonsense upon stilts.” In the United States, there has been a stronger embrace of rights, but also a lingering uneasiness about them, according to Patterson. He mentioned that the Bill of Rights was a compromise measure that, at its adoption, few if any thought was perfect. Patterson noted that, throughout American history, there has been elite opposition to rights held by ‘the masses.’ He also mentioned the passage of the 14th Amendment and the Slaughterhouse cases as important rights milestones.”

“Patterson quoted an intellectual descendant of Jeremy Bentham, the philosopher Alasdair McIntyre, who once described rights as a ‘fiction,’ writing that ‘belief in them is one with belief in witches and unicorns.’”

“Then Patterson shifted gears to discuss the U.S. ‘Rights Revolution,’ which he believes stands in stark contrast with the history preceding it. His view is that it is anachronistic to posit that rights are the most critical element of America’s founding documents. That is because, in Patterson’s view, rights did not gain currency until much later – specifically, when the horrors of Nazism during World War II shocked the world’s conscience, triggering people’s shared moral instincts that there must be some baseline that all people are owed, inhering their basic humanity. The war’s atrocities combined with anti-imperial movements across the world and other developments: Black Americans fighting for freedom and returning home, wondering what their status would be in American politics, and what they held in common with others fighting for freedom; a shift in decisions by the U.S. Supreme Court; and the social movements waged by women and other groups. These trend lines converged and culminated in the 1970s, a decade which Patterson called quite extraordinary, even though, in his view, America in many respects is still (in the year 2019) in the midst of the lingering rights revolution.”

“Patterson held that the next phase of the rights revolution, almost as important as War II in terms of focusing attention on the deprivation of human rights, began to occur in the 1980s, with the emergence of the fight against modern slavery and human trafficking. Patterson emphasized that trafficking is normally spoken about as a violation of rights, more than it is a violation of freedom. He mentioned sex trafficking, the widespread condemnation of which has led to an alliance of strange bedfellows – the evangelical right and feminist left. He also mentioned labor trafficking, and employers being unable to say ‘stay out of our business’ as various forms of on-the-job inequity are now challenged and subject to outside scrutiny.”

“Patterson gave a tip of the hat to the U.S. Department of State for publishing its annual Trafficking in Persons (TIP) report, and said that, when it comes to condemning trafficking, the Department is better off using the language of rights than it is using the language of freedom. Each year, more and more people are able to make rights claims – for example, women in forced marriages, who have been newly defined as ‘slaves.’ Patterson described the language of rights as infinitely expandable to accommodate new kinds of claims. He saw this largely as a good thing: America is leading by example, expanding rights for an ever increasing number of people. As intimated at other points during his remarks, Patterson said that although he retains great love and respect for the concept of freedom, he thinks it is a mistake for the West to proclaim it to the world and try to convert others into showing similar reverence. Rhetorically speaking, rights are more effective tools to achieve similar ends.”

Patterson’s Responses to Questions

Executive Director Berkowitz “thanked Patterson for his thoughtful talk and then explained that the Commission has heard some criticisms of rights that are very similar to ones Patterson made about ‘freedom’ – that rights are exclusively Western, for example. Berkowitz said he welcomed Patterson’s thoughts on whether criticisms are equally applicable to both concepts.”

  • Patterson “said that, in his view, the [assertion that] rights are Western’ claims are shallower than those waged against freedom. Rights have origins that go at least as far back as the Middle Ages and Reformation. Admitting that there is a complicated story of how the concept of rights evolved and influenced public discourse, Patterson said that ‘rights talk’ – while Western in origin – was, from very beginning, seen as applying to all human beings, unlike freedom. Fundamental rights, thus, were extra-territorial and extra-political.”

Tollefsen “expressed some sympathy for the distinction Patterson drew between freedom and rights. Nothing that there are articulations of freedom that can come into tension with rights, Tollefsen cited the ‘freedom to consume,’ which, when enjoyed, can sometimes mean disregarding the rights of those whose exploited labor produced goods consumers enjoy. But Tollefsen also worried that any moral concern over modern-day slavery must involve an appeal to some notion of freedom.”

  • Patterson “responded that the concepts in question (rights, freedom) definitely overlap. But he said that, when it comes to international advocacy, work on behalf of freedom does not always have the same force or effect that rights-based advocacy does. Patterson mentioned Freedom House, which honors  countries on their honoring of civil and political rights, and contrasted its work with Department’s TIP report. Patterson discussed the TIP report’s 3-tier methodology, a provided the example of Japan, where there was great consternation when the U.S. did it in its TIP report. In response to the demotion, Japan made important reforms. Patterson’s basic point was that the United States can promote liberal democracy (and thus-freedom) abroad but must remember that democracy requires preconditions in order to function successfully. He argued that, when it comes to making rights claims, those preconditions are not as necessary because people have rights regardless of what political system is in place.”

Soloveichik “acknowledged that the concept of freedom has been misused and perverted at times throughout America’s history. But then he cited the abolitionist movement, during which the concepts of freedom and rights appeared to go hand in hand. Soloveichik also mentioned Martin Luther King, Jr., one of whose most famous lines is “let freedom ring.” Soloveichik’s question was whether freedom and rights enhance one another.”

  • Patterson “responded that, yes, at America’s best moments – in some of President Abraham Lincoln’s writings, for example, during the struggle for women’s suffrage and equality, etc. – rights and freedom complement each other ‘sublimely.’ But during our country’s worst moments, the two concepts are twinned in perverted ways – for example, during the Confederacy, when southern liberty was held up as an ideal while African American slaves’ rights were openly and appallingly violated.“

Katrina Swett, the President of the Tom Lantos Foundation for Human Rights and Justice,  said “that she had always thought of freedom and human rights as inextricably connected, but that Patterson’s writings and lecture were very challenging to her past understandings. She wondered as a practical matter if free and democratic societies do the best job of protecting rights.”

  • Patterson “said that, absolutely, they do. But then he mentioned that somewhere on the order of 70% of the world’s chocolate is (or previously was) produced by child labor. In recent years, thousands of NGOs have pressured chocolate manufacturers, farmers, and governments to change this situation. Patterson’s point was that, when it comes to protecting human rights, advocates can achieve progress even in non-democracies. (Democracies are ideal, but they are not the only regimes where rights can be protected.) In another example, he said that China has cut poverty in half. People are no longer starving – because China, though far from a democracy, in certain respects has honored the ‘right to food’ and the ‘right to life.’”

Chair Glendon concluded by thanking Patterson for helping the Commission with a problem it will have to confront – the difficulties and confusion inherent in using terms and concepts to which different groups impute various meanings and connotations.”

Public Comments

Several members of the public made comments. Here is a summary of the more substantive ones.

“A representative from the Center for Family and Human Rights spoke of the unintended consequences of rights expansion: Sometimes people have to give up certain rights in order to accommodate new definitions of rights – thus promoting a ‘competition of rights’ [and?] growing skepticism regarding the United Nations (UN) approach to protecting human [rights. The representative stressed that now is a prime opportunity for basic issues to be [reframed?]”

“Fr. Mark Hodges, an Orthodox priest. spoke about the Christian conception of rights, framework which involves concepts like universal dignity and free will. He urged the Commission to prioritize religious freedom and the right to life.”

“A representative from the Heritage Foundation said that when international bodies like the UN consider all rights on equal footing, it is worth asking whether they are confusing certain ‘desirable ends’ with human rights. He asked how long internal conflicts can persist within the global human rights movement before we reach a point of human rights paralysis, and he wondered whether the proliferation of rights does violence to the notion of unalienable rights. Commissioner Paola Carozza responded that, in international human rights law, there actually is a hierarchy of rights – some are non-derogable, and some achieve status of jus cogens, while others do not.”

“A law professor from the University of Oklahoma then asked whether the comments submitted to the Commission by various civil society groups will be made public, and suggested the Commission publish specific questions, and set specific deadlines, so that outside groups can contribute more efficiently.”

“Representatives from Human Rights Watch urged the Commission to invite ‘grassroots’ human rights defenders to come testify, saying their work is crucial but does not enter into ‘esoteric academic debates.’”

U.S. Stupidity and Cowardice in Continuing to Designate Cuba as a “State Sponsor of Terrorism”

On April 30, 2014, the U.S. Department of State issued its annual report on terrorism in the world: Country Reports on Terrorism 2013. A prior post reviewed the report as a whole.

We now examine this report’s designation of Cuba as a “State Sponsor of Terrorism” [“SST”], i.e., as a country that has “repeatedly provided support for acts of international terrorism.” This post’s analysis is also informed by the U.S.’s similar designations of Cuba in the annual reports on terrorism for 1996 through 2012. Earlier posts analyzed and criticized the reports about Cuba for 2009, 2010, 2011 and 2012.

State Department’s Rationale

The following is the complete asserted justification for the Department’s designation of Cuba for 2013:

  • “Cuba was designated as a State Sponsor of Terrorism in 1982.
  • Cuba has long provided safe haven to members of Basque Fatherland and Liberty (ETA) and the Revolutionary Armed Forces of Colombia (FARC).  Reports continued to indicate that Cuba’s ties to ETA have become more distant, and that about eight of the two dozen ETA members in Cuba were relocated with the cooperation of the Spanish government.  Throughout 2013, the Government of Cuba supported and hosted negotiations between the FARC and the Government of Colombia aimed at brokering a peace agreement between the two.  The Government of Cuba has facilitated the travel of FARC representatives to Cuba to participate in these negotiations, in coordination with representatives of the Governments of Colombia, Venezuela, and Norway, as well as the Red Cross.
  • There was no indication that the Cuban government provided weapons or paramilitary training to terrorist groups.
  •  The Cuban government continued to harbor fugitives wanted in the United States.  The Cuban government also provided support such as housing, food ration books, and medical care for these individuals.”

Rebuttal of State Department’s Rationale

On its face alone, this alleged justification proves the exact opposite: Cuba is not a state sponsor of terrorism. Nevertheless, a detailed rebuttal follows.

U.S. Admissions of the Weakness of Its Designation

First, the report itself admits, “There was no indication that the Cuban government provided weapons or paramilitary training to terrorist groups.” This is consistent with past U.S. admissions that there was no evidence that Cuba had sponsored specific acts of terrorism (1996, 1997) and that there “was no indication that the Cuban government provided weapons or paramilitary training to terrorist groups” (2011, 2012, 2013). Similar admissions were made in the U.S. reports for 2005, 2008, 2009 and 2010.

Second, earlier U.S. reports admitted that “Cuba no longer supports armed struggle in Latin America and other parts of the world” (1996, 1997, 1998, 2008, 2009) and that in 2001(after 9/11) Cuba “signed all 12 UN counterterrorism conventions as well as the Ibero-American declaration on terrorism” (2001, 2002, 2003).

Third, the latest report’s Western Hemisphere Overview says the FARC  “committed the majority of terrorist attacks in the . , . Hemisphere in 2013.” There is no mention of Cuba in this overview. The same was said in the report for 2012.

Fourth, there is no mention of Cuba in the latest report’s “Strategic Assessment” that puts all of its discussion into a worldwide context.

Fifth, the latest report makes no allegations against Cuba regarding money laundering and terrorist financing, which was one of the purported bases for the SST designation for 2012. Thus, the U.S. apparently has recognized the weakness of such charges were evident to all, as discussed in this blogger’s post about the prior report and a related post about Cuba’s adoption of regulations on these financial topics.

All of this rebuttal so far is based only on what the State Department has said about this designation since 1996.

In addition, the Cuban government has taken the following actions that strengthen the rebuttal of the designation and that, to my knowledge, the U.S. has not disputed:

  • Cuba publicly has stated that Its “territory has never been and never will be utilized to harbor terrorists of any origin, nor for the organization, financing or perpetration of acts of terrorism against any country in the world, including the [U.S.]. . . . The Cuban government unequivocally rejects and condemns any act of terrorism, anywhere, under any circumstances and whatever the alleged motivation might be.”
  • In 2002, the government of Cuba proposed to the U.S. adoption of a bilateral agreement to confront terrorism, an offer which it reiterated in 2012, without having received any response from the U.S.
  • Cuban President Raul Castro on July 26, 2012 (the 59th anniversary of the Cuban Revolution) reiterated his country’s willingness to engage in negotiations with the U.S. as equals. He said no topic was off limits, including U.S. concerns about democracy, freedom of the press and human rights in Cuba so as long as the U.S. was prepared to hear Cuba’s own complaints. In response the U.S. repeated its prior position: before there could be meaningful talks, Cuba had to institute democratic reforms, respect human rights and release Alan Gross, an American detained in Cuba.

But let us go further.

Cuba As an Alleged Safe Haven for Terrorists

The only remaining asserted basis for the “SST” designation is Cuba’s alleged providing safe haven to individuals with two U.S.-designated Foreign Terrorist Organizations—ETA (an armed Basque nationalist and separatist group in Spain) and FARC (an armed Colombian rebel group)—and to certain fugitives from U.S. criminal proceedings.

Analysis shows that these charges do not support the SST designation.

            a. ETA

Prior U.S. reports say there were only 20 to 24 ETA members in Cuba, and the latest report says “Cuba’s ties to ETA have become more distant, and . . . about eight of the two dozen ETA members in Cuba were relocated with the cooperation of the Spanish government.” Thus, there are only 12 to 16 ETA members remaining in Cuba, and by now they must be older people who have not participated in any terrorist activities in Spain for many years. They are “side-line sitters.”

Moreover, the 2011 and 2012 U.S. reports state that Cuba is “trying to distance itself” from the ETA members on the island and was not providing certain services to them.

Earlier U.S. reports also reflect the limited nature of the charges regarding ETA. Of the 20 to 24 members previously on the island, the U.S. said, some may be in Cuba in connection with peace negotiations with Spain (2009). In May 2003, the U.s. reported, Cuba publicly asserted that the “presence of ETA members in Cuba arose from a request for assistance by Spain and Panama and that the issue is a bilateral matter between Cuba and Spain” (2003). In March 2010, a U.S. report stated, Cuba had “allowed Spanish Police to travel to Cuba to confirm the presence of suspected ETA members” (2010).

Moreover, in March 2011 the Spanish Ambassador to Cuba told former U.S. President Jimmy Carter that Spain was “not concerned about the presence of members of . . . ETA . . . in Cuba.” Indeed, the Spanish Ambassador maintained that this enhances his country’s ability to deal more effectively with ETA. In fact, the Ambassador added, some ETA members are there at the request of the Spanish government.

At least the last three U.S. reports say that Cuba is providing “safe haven” to the ETA members, but their separate chapters on the legitimate international problem of terrorist safe havens have no mention whatsoever of Cuba.

It also should be noted that there has been some movement towards an understanding to resolve the ETA challenges to the Spanish government. In September 2011 an international verification commission was established to help broker such a resolution, and the next month ETA announced a unilateral cease-fire. More recently, February 2014, that commission announced its corroboration of a partial disablement of ETA weapons. The Spanish government, on the other hand, publicly has refused to negotiate and instead has insisted that ETA admit defeat and surrender unconditionally. In addition, the government still enforces a criminal law against publicly glorifying terrorists or their actions  with April 28th arrests of 21 Spaniards for praising terrorist groups such as ETA and radical Islamists, for encouraging further attacks, and for making fun of victims on social networking sites.

In the meantime, Spain as a member of the European Union is participating in negotiations between the EU and Cuba to establish a Political Dialogue and Cooperation Agreement without any mention of ETA members being on the island. Recently the parties completed the first round of those negotiations with an understanding that the final agreement will have these four components: political dialogue and governance; cooperation and sectoral policies; the economy and trade; and management of the bilateral relationship. The subject of human rights will remain an issue in the chapter on the Political dialogue and governance.

In summary, I submit, any objective analysis shows that Cuba’s limited connection with a small number of ETA members is no legitimate reason for the U.S. SST designation.

            b. FARC

Most of the reasons for the speciousness of the charges regarding ETA also apply to the charges regarding the Colombian group, FARC.

In addition, the 2008 U.S. report said in July of that year “former Cuban President Fidel Castro called on the FARC to release the hostages they were holding without preconditions. He has also condemned the FARC’s mistreatment of captives and of their abduction of civilian politicians who had no role in the armed conflict.”

There is no indication in the State Department’s reports of the number of FARC members allegedly in Cuba, but for 2009 the U.S. reported that some may be on the island in connection with peace negotiations with Colombia (2009 report).

Moreover, in March 2011 the Colombian Ambassador to Cuba told former U.S. President Jimmy Carter that Colombia was “not concerned about the presence of members of FARC . . . in Cuba.” Indeed, the Ambassador maintained that this enhances their ability to deal more effectively with FARC.

Cuba’s limited connections with the FARC resulted in a September 2012 statement by Cuba’s Ministry of Foreign Relations about the then recently-announced peace talks between Colombia’s government and the FARC. It stated that Cuba “has a historical commitment to peace in Colombia and efforts to put an end to [her] . . . political, social and military conflicts.” To that end, the Cuban Government “has made constructive efforts to . . . search for a negotiated solution, always responding to a request from the parties involved and without the slightest influence in their respective positions.” The statement continued. For over a year, at the express request of the Government of Colombia and the FARC, “the Cuban government supported the . . . exploratory talks leading to a peace process,” and as a “guarantor” Cuba participated in these talks. “The Cuban government will continue to . . . [provide its] good offices in favor of this effort, to the extent that the Government of Colombia and the FARC . . . so request.” The Government of Colombia publicly stated its gratitude for Cuban facilitation of such negotiations.

As a result, the last two U.S. reports admit that Cuba has “supported and hosted negotiations between the FARC and the Government of Colombia aimed at brokering a peace agreement between the two sides.” In addition, Colombia’s president has said that support for such negotiations by Cuba and Venezuela has been crucial in helping the two sides to reach agreement on conducting the negotiations.

In May 2013, the two sides announced an agreement to distribute land to small farmers and undertake development projects that would improve rural education and infrastructure that will not take effect until a final peace agreement is reached.

In short, Cuban involvement with some FARC members is not a legitimate basis for the U.S. designation of Cuba as a SST .

            c. U.S. fugitives

There apparently were or are over 70 individuals living in Cuba who are fugitives from criminal charges in U.S. relating to violent acts in the 1970’s purportedly committed to advance political causes, but, as the U.S. has admitted, since at least 2005 Cuba has not admitted any additional U.S. fugitives. In addition, the U.S. also had admitted that in a few instances Cuba has extradited such fugitives to the U.S. (2001, 2003, 2004, 2005, 2006, 2007, 2008, 2009).

One of the U.S. fugitives, William Potts, this year voluntarily returned to the U.S. after serving a 15-year Cuban sentence for the 1984 hijacking of a Piedmont Airlines passenger plane with 56 people aboard in the U.S. and forcing it to go to Cuba. On May 1, 2014, Potts appeared in a U.S. federal court and pled guilty to kidnapping (with a possible life sentence); under a plea agreement, the government dropped an air piracy charge (with a mandatory minimum sentence of 20 years). Potts is asking the court to give him credit for the 15 years he already served in a Cuba prison on the same charge. Sentencing is scheduled for July 11th.

None of the other U.S. fugitives apparently is affiliated with any U.S.-designated terrorist organizations. The issue of whether or not they will be extradited to the U.S. is an appropriate issue for bilateral negotiations between the two countries.

In any event, the presence in Cuba of some fugitives from U.S. criminal charges is not a legitimate basis for the U.S. designating Cuba as a SST.

Conclusion

The U.S. designation of Cuba as a “State Sponsor of Terrorism” is absurd. This conclusion is shared, in less colorful language, at least by the U.S. Central Intelligence Agency, former President Jimmy Carter, the U.S. Council on Foreign Relations, the Center for Democracy in the Americas, the Center for International Policy, the Latin American Working Group, The Atlantic Magazine’s noted national correspondent (Jeffrey Goldberg) and a retired U.S. Army Brigadier General (John Adams).

Not surprisingly the Cuban government comes to the same conclusion. In response to the latest designation, it stated,” Cuba’s Foreign Ministry “energetically rejects the manipulation of a matter as sensitive as international terrorism by turning it into an instrument of policy against Cuba and it demands that our country be definitively excluded from this spurious, unilateral and arbitrary list.” Last year, it said “the only reason Cuba is kept on this list is . . . an attempt to justify the U.S. blockade of our country, as well as the adoption of new measures to limit our financial and commercial transactions, to strangle the Cuban economy and impose a regime which responds to U.S. interests.”

The U.S. itself also has damned the designation by faint praise. In a press briefing about the most recent terrorism report, a journalist pointed out some of the weaknesses of the stated rationale and asked when the U.S. would cancel the designation. The State Department spokesperson refused to speak directly about the purported rationale for the Cuban SST designation. Instead the spokesperson said, “there’s not a routine process by which you re-evaluate the state sponsors. . . . [and the annual terrorism reports just list those on the SST list. It is not]as if every year we look at those and re-evaluate them in some way based on the report.” [1] She added she knew of no plans to remove the SST designation for Cuba.

Whatever legitimate issues are raised by these U.S. reports, I submit, they are appropriate subjects, among many, for the bilateral negotiations that a prior post recommended should occur between the U.S. and Cuba to the end of reconciliation and restoration of normal relations.

In the meantime, this SST designation is ridiculous, absurd, stupid. It can only continue, in this outsider’s opinion, because of the Administration’s political cowardice in facing resistance to an elimination of this designation, especially from influential Cuban-Americans in Congress, especially Democratic Senator Robert Menendez, Chairman of the Senate Foreign Relations Committee,[2] and Republican Rep. Ros-Lehtinen, member of the House Foreign Affairs Committee.[3]

All U.S. citizens should protest this SST designation to President Obama, Secretary of State Kerry, Senator Menendez (and your own Senators), Representative Ros-Lehtinen (and your own Representative).

The first path requires the President to submit a report to Congress, before the proposed rescission would take effect, certifying that: (1) there has been a fundamental change in the leadership and policies of the government of the country concerned; (2) the government is not supporting acts of international terrorism; and (3) the government has provided assurances that it will not support acts of international terrorism in the future.The second path requires the President to submit a report to Congress, at least 45 days before the proposed rescission would take effect, justifying the rescission and certifying that: (1) the government concerned has not provided any support for international terrorism during the preceding six month period, and (2) the government concerned has provided assurances that it will not support acts of international terrorism in the future.

The American Revolutionary War’s Campaign for New York and New Jersey, March 1776–January 1777

On March 17, 1776, the 11-month colonists’ Siege of Boston ended when the British troops and their dependants evacuated the town of Boston. A fleet of 120 British ships set sail for a British military base in Halifax, Nova Scotia with nearly 10,000 British troops and over 1,000 dependants. This was discussed in a prior post.

Both sides’ attention next turned to New York City, which then was a town of 25,000 at the southern tip of the island of Manhattan (then known as York Island). This post will review what is known as the Campaign for New York and New Jersey, March 18, 1776, through January 1777.[1]

For the British, the City was an obvious strategic target. It had a large harbor from which the vastly superior British navy could easily command the area and be a base to conquer the middle colonies to the south and west. The terminus of the Hudson (or North) River into that harbor would provide the British with a route north to connect with British forces in what is now Canada and thereby potentially separate New England from the other colonies. Moreover, many British Loyalists lived in the City and thus made it a friendlier host for British troops than Boston had been.

The strategic importance of the City also was obvious to General George Washington. Not knowing that the British troops were going from Boston to Nova Scotia, he was worried that they would instead be sent directly to New York. Therefore, Washington immediately after the British evacuation of Boston sent some colonial regiments from Boston to New York to join the colonial forces already there under the command of General Charles Lee. Thereafter other colonial troops were sent from Boston, including my 5th maternal great-grandfather, Perley Brown, and his brothers William and Benjamin. Perley and his comrades arrived in New York City in late July on a ship from New Haven, Connecticut.[2]

These transfers of troops from Boston were not easy. The men first had to march 100 to 120 miles over five to seven days to the Connecticut ports of New Haven or New London, where they boarded sailing ships to take them via Long Island Sound to New York City.

General Washington himself arrived in the City on April 13th and established his headquarters in the Archibald Kennedy Mansion at No. 1 Broadway.[3]

Washington soon discovered that much work still needed to be done to finish the construction of fortifications in Brooklyn on Long Island and on York Island. He was kept busy supervising their continued construction, inspecting the troops and deciding on command assignments and troop deployments.

Another problem faced Washington in the City. The soldiers were growing sickly. Smallpox appeared causing the deaths of several of the men. In the summer heat, “camp fever” became epidemic, and poor sanitation caused dysentery. At least 3,000 to 6,000 men were ill at one time or another, and many died. One of the victims of these illnesses was William Brown (Perley’s brother), who died in a City hospital on August 27th after being sick for eight days. Also sick at this time was brother Benjamin, but his health improved so he could return to active duty.[4]

New York Harbor & Sandy Hook

The long anticipated arrival in New York of the British troops began on June 29th when 120 British ships arrived at Sandy Hook, a barrier spit jutting northward into Lower New York Bay from the New Jersey shore. Three days later (July 2nd) 9,000 British troops from their Nova Scotia base left these ships to establish their new base on the unguarded Staten Island southwest across the harbor from York Island and directly west of the present-day southern part of Brooklyn.

And the British ships kept coming with another 15,000 British and Hessian soldiers soon thereafter. On August 13th 96 more ships entered the harbor plus 20 more the next day. That summer more than 400 British ships with 1,200 cannon and 10,000 sailors under the command of Admiral Lord Richard Howe were anchored in the harbor, and more than 32,000 British and Hessian troops under the command of his brother, General Sir William Howe, were on the nearby land. This turned out to be the largest expeditionary force of the 18th century.

The British, however, did not launch an immediate attack.

Instead General Howe, on July 14th sent a messenger from Staten Island to York Island with a letter addressed to “George Washington, Esq.” conveying an offer to meet and discuss ending the rebellion. Washington’s assistant rejected the letter because it was not addressed to “General George Washington” and because there was no one there by the letter’s simple title. Three days later (July 17th) a second letter was sent; this one was addressed to “George Washington, Esq., etc.,” which also was rejected for the same reason. The next day (July 18th) the British returned to York Island to ask if General Washington would meet with Adjutant General Patterson, and Washington said “yes.”

On July 20th such a peace conference was held at the Kennedy Mansion on York Island. In the midst of polite formalities Washington said he understood that General Howe only had authority to grant pardons, but that those who had committed no wrongs wanted no pardons. This ended these British peace efforts.

In the meantime, General Washington had 19,000 colonial troops in the area, but did not know where the British planned to attack. Therefore, Washington split the Continental Army into fortified positions in Brooklyn on Long Island and in Manhattan with some held in a reserve so-called “Flying Camp” in northern New Jersey to be deployed when they knew where the British were going to attack.

The fighting phase of the campaign for New York and New Jersey began on August 22nd when the British troops invaded Long Island. Thus began what turned out to be the largest battle of the War (the Battle of Long Island or the Battle of Brooklyn) that lasted until August 30th with a British victory.

Staten Island Peace Conference

Soon thereafter– on September 11th (an ironic date in light of its 225th anniversary falling on the day of  the 9/11 attacks of 2001)–another attempt was made to end the rebellion peacefully at the Staten Island Peace Conference.

The Conference participants were Admiral Lord Howe and Continental Congressmen John Adams, Benjamin Franklin and Edward Rutledge. The Americans insisted on British recognition of their recently declared independence. Admiral Lord Howe said he could not do that. Howe was also pressed to repeal the Prohibitory Act that authorized a blockade of the colonies, but he said he could not do that either. Instead, Howe offered to suspend execution of the blockade if the Americans agreed to end hostilities and make fixed financial contributions to Britain. This offer was rejected by the Americans. There was no peace agreement. The War continued.

With the exception of an American victory at Harlem Heights on York Island,  the British won all the military encounters of this campaign through Christmas Eve Day (December 24, 1776) and forced General Washington and the Continental Army to retreat from New York into New Jersey and then from New Jersey into Pennsylvania. Future posts will review the Battles of Long Island (Brooklyn), Harlem Heights and White Plains.

The British victory in this campaign looked secure at that time. But on Christmas Day (December 25th) Washington and 2,400 of his troops made their now famous “crossing the Delaware River” maneuver. They crossed the partially frozen river from Pennsylvania to return to New Jersey to make their successful surprise attack on British and Hessian troops at Trenton, New Jersey. This was followed on January 3rd with another successful colonial attack at Princeton, New Jersey and Washington’s establishing his winter headquarters in Morristown, New Jersey.

Fighting essentially ceased in January 1777 due to winter conditions.

Nevertheless, it has to be said that the British won the Campaign for New York and New Jersey and that the British occupied New York City for the duration of the War.
