Human Rights Commentaries by Mary Ann Glendon, Chair of the Commission on Unalienable Rights

A prior post reviewed the limited public record (to date) of the first meeting on October 23 of the Commission on Unalienable Rights.

To gain a better understanding of what to expect from the Commission, this blog will examine two recent commentaries on human rights by, and an interview of, the Commission’s Chair, Mary Ann Glendon, the Learned Hand Professor of Law at the Harvard Law School, the author of a major book about the development of the Universal Declaration of Human Rights (UDHR) [1] and a prominent Roman Catholic who was U.S. Ambassador to the Vatican in the George W. Bush Administration. The Conclusion will evaluate her comments and those made by others at the first meeting.

Reclaim Human Rights (August 2016) [2]

Glendon began this article by acknowledging that she had been a participant in the Ramsey Colloquium’s 1998 affirmation of the UDHR as “the most available discourse for cross-cultural deliberation about the dignity of the human person” and as making “possible a truly universal dialogue about our common human future.” [3] She also affirmed she was “a longtime supporter of the cautious use of rights language, and a frequent critic of its misuses.”

Nevertheless, Glendon said that a 2016 criticism of human rights by R.R. Reno, the editor of First Things, [4] caused her to “ponder whether the noble post-World War II universal human rights idea has finally been so manipulated and politicized as to justify its abandonment by men and women of good will.”

According to Glendon, by “1998, governments and human-rights organizations alike were ignoring the fact that the UDHR was constructed as an integrated document whose core fundamental rights were meant to be ‘interdependent and indivisible.’ [However, by 1998, the] sense of the interdependence among rights and the connections between rights and responsibilities was fading.” Moreover, “a host of special-interest groups [were inspired] to capture the moral force and prestige of the human-rights project for their own purposes. . . .[The] core of basic human rights that might be said to be universal was being undermined by ‘multiplying the number of interests, goods, and desires that are elevated to the status of rights.”

As a result, by 2016, she argues, “the post-World War II dream of universal human rights risks dissolving into scattered rights of personal autonomy.”

Reno’s criticism of human rights, Glendon continues, emphasizes “the way that human rights as an ideology detracts from the difficult and demanding work of politics.” This is especially true in the U.S., she says, as “judicially-created rights have displaced political judgements that could and should have been left to the ordinary processes of bargaining, education, persuasion, and voting.” This has damaged “the American democratic experiment” by making it more difficult to correct an unwise judicial decision, intensifying “the politicization of the judicial selection process,” depriving “the country of the benefits of experimentation with different solutions to difficult problems” and accelerating “the flight from politics.”

Glendon concludes by urging “church leaders and people of good will to make every effort to connect the human-rights project to an affirmation of the essential interplay between individual rights and democratic values. We should insist on the connection between rights and responsibilities. And we should foster an appreciation of the ultimate dependence of rights upon the creation of rights-respecting cultures.”

“When Eleanor Roosevelt and a small group of people gathered at the behest of the U.N. in early 1947 to draft the world’s first ‘international bill of rights’” (the subsequent UDHR), the “idea that some rights could be universal—applicable across all the world’s different societies—was controversial.”

“Yet in the decades that followed, the UDHR . . . successfully challenged the view that sovereignty provided an iron shield behind which states could mistreat their people without outside scrutiny.”

“But now . . . the international human rights idea is in crisis, losing support both at home and abroad. Good intentions, honest mistakes, power politics, and plain old opportunism have all played a role in a growing skepticism, and even a backlash.”

As Glendon sees it, “there were three stages” to this change: [1] a pick-and-choose attitude toward rights initiated by the two superpowers in the Cold War era [U.S. and U.S.S.R.]; [2] an over-extension of the concept once the human rights idea showed its moral force; and [3] a forgetfulness of the hard-won wisdom of the men and women who had lived through two world wars.”

“The end of the Cold War increased the influence of human rights. American predominance, Western ideological ascendancy, a series of atrocities and conflicts, and a growing role for the United Nations and other international actors spurred the rapid growth of human rights activism in the 1990s. By the 2000s, there were many human rights organizations, including specialists, activists, agencies for monitoring and enforcement, and academic journals.”

These changes brought about “an interventionist approach, backed by Western—especially American—power. . . .  The establishment of state-like institutions such as the International Criminal Court (which the United States ultimately did not endorse), and doctrines such as the ‘Responsibility to Protect,’ reflected this shift. They increased the human rights field’s ability to frame the international agenda and set global standards. . . .  This encouraged an expansion in the number of basic rights.”

“Given that individual rights were gaining ascendancy, the role of social institutions and non-­individualistic values were deemphasized. A one-size-fits-all approach triumphed over the idea of a common standard that could be brought to life in a variety of legitimate ways. The indivisibility and inter­dependence of fundamental rights were ­forgotten.”

Some states now object to “uniform methods of interpreting and implementing” human rights treaties and to “supra­national institutions. They are remote from the people whose lives they affect. They lack public scrutiny and accountability, are susceptible to lobbying and political influence, and have no internal checks and balances.”

According to Glendon, the following “four major principles that the UDHR’s framers followed [in 1947-48] can reinvigorate the human rights idea in our own time:”

  • Modesty concerning universality. “The framers wisely confined themselves to a small set of principles so basic that no country or group would openly reject them. This was essential not only in order to gain broad political support within the U.N., but also to ensure that the Declaration would have deep and long-lasting support across vastly different cultures, belief systems, and political ideologies.”
  • Flexible universalism.” The UDHR framers “understood that there would always be different ways of applying human rights to different social and political contexts, and that each country’s circumstances would affect how it would fulfill its requirements.” For example, . . . [UDHR’s] Article 22 provides: ‘Everyone, as a member of society, has the right to social security and is entitled to realization, through national effort and international cooperation and in accordance with the organization and resources of each State, of the economic, social and cultural rights indispensable for his dignity and the free development of his personality.’ (Emphasis added.) Another example is Article 14, which states, ‘Everyone has the right to seek and to enjoy in other countries asylum from persecution,’ but is silent on how that right should be protected.
  • Interdependence of basic rights.” The UDHR makes it clear “that everyone’s rights depend on respect for the rights of others, on the rule of law, and on a healthy civil society. . . . The framers of the [UDHR] did not expect uniform management of tensions or conflicts between rights. . . . [and instead] assumed that communities must balance the weight of claims of one right versus another before determining the best course of action.” Only a few rights do not allow such variation: “protections for freedom of religion and conscience” as well as “prohibitions of torture, enslavement, degrading punishment, . . .retroactive penal measures, and other grave violations of human dignity.”
  • “Subsidiarity.” Emphasis on “the primacy of the lowest level of implementation that can do the job, reserving national or international actors for situations where smaller entitles are incapable.” This principle, as stated in the UDHR’s Proclamation, also calls on “every individual and every organ of society, keeping this Declaration constantly in mind, shall strive by teaching and education to promote respect for these rights and freedoms.”

Glendon concludes by arguing for a new human rights goal: “the systematic elimination of a narrow set of evils for which a broad consensus exists across all societies. This would at least include “protections against genocide; slavery; torture; cruel, inhuman, or degrading treatment or punishment; retroactive penal measures; deportation or forcible transfer of population; discrimination based on race, color, sex, language, religion, nationality, or social origin; and protection for freedom of conscience and religion.”

On August 3, 2019, Glendon was interviewed by Jack Goldsmith, another Harvard Law School professor of international law. Here are her comments that were not already expressed in the above articles.

She said there was confusion and crisis in human rights with roughly half of the world’s population without any rights and exasperated by disappointing performance of international human rights institutions.

Socrates said that definition of terms was the beginning of wisdom, and this is especially important since human rights are now important parts of U.S. foreign policy.

The concept of “unalienable rights,” which the printer of the original Declaration of Independence substituted for Thomas Jefferson’s draft’s use of “inalienable,” has evolved with the U.S. Bill of Rights (the first ten amendments to the Constitution) and the words of Abraham Lincoln and Martin Luther King, Jr.

While the U.S. Declaration of Independence talked about “laws of nature” or pre-political rights, the UDHR is grounded in the world’s religious and philosophical traditions.

Glendon emphasized the civil and political rights in the UDHR were interdependent with economic and social rights and pointed to the New Deal and the preambles of many U.S. statutes on economic and social issues as expressing this interdependence. This also is stated in Article 22 of the UDHR: ‘Everyone, as a member of society, has the right to social security and is entitled to realization, through national effort and international co-operation and in accordance with the organization and resources of each State, of the economic, social and cultural rights indispensable for his dignity and the free development of his personality.’” (Emphasis added.) This provision rejected the Soviet Union’s position that the state was solely responsible for such rights with Eleanor Roosevelt saying during the deliberations over the UDHR that no one had figured out how to do that without loss of freedom.

Another emphasis of Glendon was on the UDHR Proclamation’s words: ‘every individual and every organ of society, Keeping the [UDHR] constantly in mind, shall strive by teaching and education to promote respect for these rights and freedoms and by progressive measures, national and international, to secure their universal and effective recognition and observance, both among the peoples of [U.N.] Member States themselves and among the peoples of territories under their jurisdiction.” Or as Judge Learned Hand said, ‘The spirit of liberty will die if not in the hearts of the people.’

Reactions

 Glendon’s primary focus in these two articles and interview is the UDHR, which is mentioned as one of two  guiding authorities for the Commission on Unalienable Rights, but Glendon has less to say about the U.S. Declaration of Independence, which is the other guiding authority for this Commission.

We all should seek to follow her emphasizing the UDHR’s interdependency of civil and political rights with economic and social rights and the importance of every individual and every organ of society striving by teaching and education to promote respect for human rights and freedoms.

The UDHR indeed is an important international human rights instrument. But it is a declaration adopted by the U.N. General Assembly in 1948. It does not by itself establish legal obligations on any nation state or other person.

In any event, Glendon says nothing about another provision of the UDHR’s Proclamation: “every individual and every organ of society , keeping this Declaration constantly in mind, shall strive . . . by progressive measures, national and international, to secure [these rights and freedoms] universal and effective recognition and observance.” (Emphasis added.) In other words, the UDHR itself contemplated that there should be additional measures, including national legislation and international treaties, to secure the rights and freedoms articulated in the UDHR and, by implication, that these other measures will include “rights” language. Moreover, under the principle of “flexible universalism,” a developed and wealthy country like the U.S. could well find ways to secure the rights mentioned in the UDHR that are more complex than those in other countries.

A similar principle for the Commission exists in the U.S. Declaration of Independence.  It says, as the Commission emphasizes, “We hold these truths to be self-evident, that all men are created equal; that they are endowed by their Creator with certain unalienable rights; that among these, are life, liberty, and the pursuit of happiness.” But the very next sentence of the U.S. Declaration says, but the Glendon and the Commission ignore, “That, to secure these rights, governments are instituted among men, deriving their just powers from the consent of the governed.” (Emphasis added.) In other words, the U.S. Declaration contemplates that the not yet established U.S. government subsequently will enact statutes that protect the unalienable rights, only three of which are specifically mentioned in the Declaration.[7] These are not “ad hoc” rights as Secretary Pompeo likes to say.

As a result, after the 1948 adoption of the UDHR, various U.N. organizations have drafted and adopted many international human rights treaties,[8] and the U.S. federal and state governments have adopted many human rights statutes and regulations.

This obvious point is surprisingly overlooked by Glendon when she lauds UDHR’s Article 14 on the right to asylum as an example of flexible universalism because it does not say how that right should be protected. But the 1951 Convention Relating to the Status of Refugees that entered into force on April 22, 1954, defines”refugee” and specifies many conditions for that protection while limiting reservations under Article 42. Presumably she is not arguing that this treaty was a mistake.

Indeed, we should all celebrate, not complain as Secretary Pompeo likes to do, that there has been such proliferation or in Glendon’s words, “too much contemporary emphasis on ‘rights’ language. These arguments by Pompeo and Glendon can be seen as underhanded ways to cut back or eliminate rights that they do not like, which I assume would include abortion and LGBQ rights. Such rights constantly are criticized by her church (Roman Catholic) and by the Commission’s creator, Secretary of State Michael Pompeo, and others in the State Department.[9]

Criticism of Glendon’s apparent adherence to traditional Roman Catholic teachings on some of these issues comes from her successor as U.S. Ambassador to the Vatican in the Obama Administration, Miguel Diaz, along with 128 Catholic activists and leaders, in a letter opposing the Commission. [10] They said, “Our faith and our commitment to the principles of democracy require us to view every person on earth as a full human being. We staunchly support the fundamental human rights of all people and proudly carry on the long tradition in our country of advocating for expanding human rights around the world. Our concern is that this Commission will undermine these goals by promoting a vision of humanity that is conditional, limiting, and based on a very narrow religious perspective that is inconsistent with the beliefs and practices of billions in this country and around the world. Our faith and our commitment to the principles of democracy require us to view every person on earth as a full human being. We staunchly support the fundamental human rights of all people and proudly carry on the long tradition in our country of advocating for expanding human rights around the world,” they write. “Our concern is that this Commission will undermine these goals by promoting a vision of humanity that is conditional, limiting, and based on a very narrow religious perspective that is inconsistent with the beliefs and practices of billions in this country and around the world. Of most urgent concern is that the composition of the Commission indicates that it will lead our State Department to adopt policies that will harm people who are already vulnerable, especially poor women, children, LGBTI people, immigrants, refugees, and those in need of reproductive health services. This is being done “in the name of a very partial version of Christianity that is being promoted by the current Administration.” “All human beings,” however, “have been created in God’s image and all have been endowed by their Creator with the fundamental right to Life, Liberty, and the pursuit of Happiness. No person speaking in the name of government or in the name of God can do so to undermine or to deny this right.”

Nor does Glendon discuss how to resolve conflicts among rights. For example, the U.S. Declaration’s mention of “life” as one of the “unalienable rights” is taken by some, and probably Glendon, as a basis for arguing there should be no right to an abortion. But an abortion may be necessary to protect an expectant woman’s right to “life” or her “pursuit of happiness.”  How are those conflicts resolved? That is why we have federal and state and international courts and agencies to resolve these conflicts or disputes.

The previously cited “four major principles” of the UDHR are worthy of remembering and guiding future human rights, internationally and domestically.

Glendon, however, fails to acknowledge the continued use of the “flexible universalism” principle in human rights treaties that allow for their ratification by nation states with reservations for at least some of the treaty’s provisions. And, of course, a state may chose not to ratify a treaty and thereby not be bound by any of its provisions. [11] Moreover, there are mechanisms for other states and international agencies to address these reservations and non-ratifications. For example, in the U.H. Human Rights Council’s Universal Periodic Review process, the Council and other states may, and do, make recommendations for states to withdraw reservations or ratify certain treaties. The same was done by the Council’s predecessor, the U.N. Human Rights Committee.[12]

The words of Professor Michael McConnell from the Commission’s first meeting should also be remembered in this evaluation of its ongoing work. He warned that the term “‘unalienable rights,’ which comes to us from our country’s protestant reform traditions, has never had a common or precise definition. The phrase identifies a philosophical concept, rather than a concrete set of rights.  And while the concept often prioritizes freedom of religion, McConnell cautioned that our founders were ultimately more concerned with freedom of conscience, which includes but is not limited to a narrow understanding of religious freedom.”

“McConnell also recognized the implicit failures of this philosophical approach.  While the term ‘unalienable rights’ makes for inspirational prose, the philosophical concept behind it embraced our country’s original sin of slavery and denied women full standing in society. Concepts of equal protection could not, and did not, exist at this time, under this philosophical tradition.”

Andrea Schmitt of the Center for American Progress who attended  the Commission’s first meeting also had words of wisdom for the Commission. She said, “It is simply wrong-headed and ultimately self-defeating to create an artificial human rights hierarchy — one that strips away the universality of human rights and puts a limited number of political and religious rights above all others.  Indeed, this enterprise stands to harm religious freedom itself, as it gives philosophical justification to theocratic governments and religious majority populations who are, by far, the leading persecutors of religious minorities around the world.”

We all should thank Professor Glendon for her expertise and willingness to serve as Chair of the Commission. Those of us interested in international human rights need to carefully follow the Commission’s deliberations and eventual reports and express our agreements and disagreements with respect and reasoned arguments.

U.S. State Department Unfairly Criticizes Cuban Religious Freedom

The State Department’s recent 2018 Report on International Religious Freedom, while not characterizing Cuba as a Country of Particular Interest or placing it on the Special Watch List, for the worst violators of religious freedom, nonetheless did have harsh words for the island.[1]

Cuban Religious Demography

Keep in mind that although “there is no independent, authoritative source on the overall size or composition of [Cuban] religious groups,” the report uses the following estimates of the sizes of different religious groups:

In addition, the Report said, “Many individuals, particularly those of African descent, practice religions with roots in West Africa and the Congo River Basisn, known collectively as Santaria. These religious practices are commonly intermingled with Catholicism, and some require Catholic baptism for full initiation, making it difficult to estimate their total membership.”

The large numbers of different religious groups and of their estimated memberships, in and of themselves, tend to show religious freedom.

U.S. Report’s Executive Summary

“The constitution provides for freedom of conscience and religion and prohibits discrimination based on religion; however, the Cuban Communist Party, through its Office of Religious Affairs (ORA) and the government’s Ministry of Justice (MOJ), continued to control most aspects of religious life.  Observers said the government continued to use threats, international and domestic travel restrictions, detentions, and violence against some religious leaders and their followers, and restricted the rights of prisoners to practice religion freely.  Media and religious leaders said the government continued to harass or detain members of religious groups advocating for greater religious and political freedom. . . . [The Communist Party’s  Office of Religious Affairs and the Ministry of Justice] continued to use the law on associations to deny official registration to certain religious groups, such as a number of Apostolic churches, or failed to respond to long-pending applications, such as those for the Jehovah’s Witnesses and The Church of Jesus Christ of Latter-day Saints.. . . Human rights advocacy organization Christian Solidarity Worldwide (CSW) reported government harassment of religious leaders increased “significantly in parallel with” the churches’ outspokenness regarding the draft constitution.  According to CSW, some religious groups said the government increased its scrutiny of foreign religious workers’ visa applications and visits.  Some religious groups reported an increase in the ability of their members to conduct charitable and educational projects.  According to the religious advocacy group EchoCuba and CSW, the government gave preference to some religious groups and discriminated against others.”

 U.S. Report’s Methodology

This report purportedly adheres to the Department’s ’guiding principle’ of trying “to ensure that all relevant information is presented as objectively, thoroughly, and fairly as possible” and not attempting “to verify independently all information contained in the reports.” (Emphasis added.) But each of  its various paragraphs invariably start with the allegations of violations of this freedom followed by contradictory information. This structure thereby implicitly and improperly gives greater credence to the allegations.[2]

Another legitimate criticism of this country report is its failure to consider the island’s relatively poor economic circumstances, especially with the implosion of Venezuela, which has been the island’s principal ally and financial backer, and the report’s implicitly using as its gauge of propriety the status of churches in the prosperous U.S.

The report on Cuba also fails to acknowledge that the U.S. has had and continues to have various surreptitious programs seeking to undermine the Cuban government, which, therefore, has reasonable grounds to be suspicious of some supposedly religious ventures from the U.S.

Sources of Information

Moreover, most of the adverse allegations come from only two sources: Christianity Solidarity Worldwide (CSW) with headquarters in London and EchoCuba based in Miami, Florida without setting forth any analysis of the credibility of those organizations.

CSW’s website says its “vision is a world free from religious persecution, where everyone can practice a religion or belief of their choice” and that it has a “team of specialist advocates [who] work on over 20 countries across Africa, Asia, Latin America and the Middle East, to ensure that the right to freedom of religion or belief is upheld and protected.” https://www.csw.org.uk/about.htm Another page of the website describes various religious events on the island.

CSW was started in 1977 by Merwyn Thomas, who might have been a Roman Catholic priest and math teacher at Holy Cross College at Notre Dame, Indiana.[3]

EchoCuba, which was founded in 1994 or 1995 and is based in Miami, Florida says that it is “dedicated to strengthening the Cuban church and helping coordinate mission and social efforts from the United States in Cuba. It began as an organization dedicated to supporting the growth of the independent Christian church in Cuba in 1994, by supplying them with medical and humanitarian assistance.” But very little information about the group was uncovered on its own website or through Internet research.

On the other hand, the U.S. report only made the following reference to the Cuban Council of Churches (CIC): “Embassy officials met with the head of the Council of Cuban Churches, a government-registered organization with close ties to the government composed mostly of Protestant groups and associated with the World Council of Churches, to discuss its operations and programs.” (Exec. Summary.)

This, in this blogger’s judgment, is a major flaw in the U.S. report as the CIC was founded in 1941 and describes itself as “an ecumenical fellowship of churches and other Cuban Christian institutions, which confess the Lord Jesus Christ as God and Savior, in accordance with the Scriptures and seek to realize their common vocation for the Glory of God the Father, Son and Holy Spirit. The CIC promotes spaces for encounter, celebration, reflection, formation and joint actions of the churches and other Christian institutions, for the service to our people, as a visible expression of the ecumenism to which we are called by God in Jesus Christ.” Today the CIC’s membership includes 28 denominations, 10 fraternal associations and 14 ecumenical movements and centers.[4]

Relevant here is the subsequent statement (on or about July 17, 2019) by the CIC in response to the recent announced intent to create the Evangelical Alliance of Cuban Churches by the Cuban evangelical churches that are not members of the CIC:[5]

We want to reiterate to our people and their churches that the . . . [CIC], as it affirms in its Constitution, works under its motto “United to Serve “which states:

  • “We are a fellowship of churches, ecumenical movements and other Christian institutions that confess the Lord Jesus Christ as Son of God and Savior, according to the Scriptures of the Old and New Testaments, and seek to realize their common vocation, the glory of God: Father, Son and Holy Spirit. “
  • “Our mission is to provide spaces for meeting, celebration, reflection and formation of churches, ecumenical movements and other Christian institutions, as a visible expression of the unity to which God calls us in Jesus Christ, in the service of our people.”
  • “Encouraging the study, consultation and different areas of service in accordance with its purposes and functions; the cooperation of Christians in order to strengthen fraternal relations; enrich Christian life and witness; develop a sense of social responsibility and encourage participation in tasks of common interest for the evangelizing mission of the Church. “
  • “The Council, without authority over its members to determine issues of doctrine, government or worship, could be a mediating instance, provided that peace and goodness of the Body of Christ is sought, based on the best testimony to the world: the unity of the believers. “

“Therefore, it is not for the [CIC], to rule on doctrinal issues that have been put on the public stage, nor to represent on this or any other issue, before the Cuban people and its authorities, the churches and organizations , members or not.”

“In Cuba all denominations enjoy religious freedom and are equal before the law, therefore each church or religious organization establishes the relations it deems with the authorities, and gives testimony before them and the Cuban people as understood from their understanding of the Faith.” (Emphasis added.)

“The Council of Churches, in adherence to the values ​​that its Constitution proclaims and in its vocation of service, has carried out mediating efforts since its foundation. And it has done so by sovereign decision of its members, from its governing bodies, without supplanting it, any rights of others.”

“On the contrary, in most cases, these efforts have benefited not only the churches and member organizations of the CIC, and in some, all the religious denominations and their practitioners on the island. Suffice it to mention the import and distribution of Bibles, and in the early 90s, their decisive contribution in the cessation of all forms of religious discrimination in Cuba.”

“God calls for unity in Christ our Lord, to serve and bear witness to the Gospel. Since its foundation 78 years ago, the . . . [CIC] has shown its fidelity to this call. Our fidelity is only to Jesus Christ, our Lord. There is no other Lord, neither here in our beloved Homeland, nor outside it, to which we MUST serve and adore.”

“The . . . [CIC] reaffirms its commitment to continue working for the unity of the churches. Serving the people and the nation, seeking together and together the paths of peace, faith and hope, the dignity of the people and the care of Creation, that help us to build and live the signs of the Kingdom of God: equality and love for all and all in the midst of our beloved country.”

Conclusion

For approximately the last 17 years, my Minneapolis church—Westminster Presbyterian Church—has had a partnership with a Presbyterian-Reformed Church in Matanzas, Cuba on the north shore of the island east of Havana, and I have been on three mission trips to Cuba to visit this and other Presbyterian-Reformed churches on the island. In Havana I have visited Ebenezer Baptist Church and its Martin Luther King, Jr. Center and the offices of the CIC as well as the Seminario Evangélico de Teologia in Matanzas. As a result, I have gotten to know pastors and members of these churches and other religious institutions and have had the honor and pleasure to welcome some of them to my church in Minneapolis. On one of my trips, the Westminster group delivered a CD-ROM edition of the Talmud from our friends at Minneapolis’ Temple Israel to a scholar at the main synagogue in Havana, and on another trip we delivered an icon from Minneapolis’ St. Mary’s Greek Orthodox Church to the new Greek Orthodox Cathedral in Havana. I also have read about religion in Cuba and many of the essays by a Presbyterian-Reformed pastor, Rev. Sergio Arce, as reflected in my blog posts on the subject.

Therefore, I can testify from personal knowledge that despite limited financial and other resources, there is significant religious freedom on the island. In other words, the State Department’s recent report on religious freedom in Cuba paints an erroneous picture.[6]

Senator Leahy’s Senate Floor Speech To End Embargo of Cuba

As mentioned in a prior post, on February 7, Senator Amy Klobuchar (Dem., MN) introduced the Freedom To Export to Cuba Act (S.428) with cosponsors Patrick Leahy (Dem., VT) and Michael Enzi (Rep., WY)./

On February 15, Senator Leahy delivered a lengthy and persuasive speech on the Senate floor supporting this bill and ending the embargo. Here is the text of that speech.

After commending Senator Amy Klobuchar (Dem., MN) for introducing this bill and urging other Senators to support the bill,, Senator Leahy said, “This bill is about ending the anachronistic prohibitions in U.S. law that for decades have limited U.S. engagement with Cuba, including preventing American companies from exporting their products to Cuba.  The fact that legislation to do so is even necessary is illustrative of the absurdity of the situation in which we find ourselves.  Companies from Europe, Russia, China, Mexico, and every other country can sell their products to Cuba, which is just 90 miles from our coast, but American manufacturers and retailers are largely shut out of the Cuban market. . . . This bill would enable American companies to compete, which every believer in a free market should support.”

“It is also important for Senators to know that punitive actions by the Trump Administration last year to further restrict the right of Americans to travel to Cuba have had devastating consequences for Cuba’s fledgling private sector – the very people the White House and supporters of the restrictions profess to want to help.  The fact that they have said nothing about the harm they are causing Cuba’s struggling entrepreneurs demonstrates that they care more about continuing their failed policy of sanctions, regardless of who they hurt, than about helping the Cuban people or about protecting the right of Americans to travel freely.” 

“The latest ill-conceived attempt by the White House to punish Cuba would permit Title III of the Helms-Burton Act to go into effect.  This would allow, among others, individuals who were Cuban citizens when their property in Cuba was expropriated half a century ago to sue in U.S. courts any Cuban, foreign, and even American company whose business in Cuba today uses that property.  That could be an airport, port, warehouse, hotel, restaurant, you name it.  Virtually every American and foreign company investing in Cuba would suddenly be liable for treble damages.”

“The purpose, as the law’s authors made clear when it was enacted 23 years ago, is to harm Cuba’s economy by making it completely inhospitable for foreign investment.”

“As my friend in the House, Representative Jim McGovern (Dem., MA), has pointed out –

  • ‘It’s no mystery why Presidents Clinton, Bush, Obama, and Trump blocked Title III from going into effect every six months for the past 23 years.’
  • ‘It is hypocritical – it penalizes companies for doing what American companies do all over the world.’
  • It is contrary to international law, which recognizes the right of expropriation and requires compensation.’
  • ‘It is an extraterritorial sanction that guarantees a response from our trading partners, like Canada, Spain and the EU, including complaints at the World Trade Organization.’
  • ‘And if you care about agriculture, be warned: It will open a new front in the trade war, with all the repercussions that can bring.’
  • ‘It will allow Cuba to claim victim status and rally international support.’
  • ‘It will clog our courts with lawsuits.’
  • ‘It will make it impossible to negotiate compensation for U.S. claims in Cuba, and, in the end, hurt the very Americans who seek compensation for the property they lost.’
  • ‘It will divide us from friends and allies who are now working for a peaceful solution in Venezuela.’
  • ‘And it will guarantee that new investment in Cuba will come from the Russians, Chinese and others who are hostile to the United States, and whose state-owned companies can’t be sued in U.S. courts.’

“I agree with my friend in the other body [Rep. McGovern].  What the White House is considering would trigger an avalanche of unintended consequences that would bring U.S. commerce with Cuba to a halt, harm relations with our allies in this hemisphere and beyond, and make resolving property claims more difficult.  I ask unanimous consent that a piece by William LeoGrande on Title III of the Helms-Burton Act published in the February 13, 2019 issue of OnCubaNews be printed in the Record following my remarks.” [This article will be published in a separate post to this blog.]

Like “many issues, Members of Congress have strong feelings pro and con about U.S. relations with Cuba.  It is no secret that, after more than half a century of a policy of isolation that has achieved none of its objectives and primarily hurt the Cuban people, I, like Senators Klobuchar and Enzi and many others in this body, favor closer relations.”

“Conversely, there are those in Congress and the Trump Administration who believe strongly that we should ratchet up the pressure on the Cuban government in an attempt to achieve those elusive goals.”

“I have often spoken publicly about the lack of political freedom and civil liberties in Cuba.  But I also think it is important to try to be objective:  to criticize when called for and to acknowledge positive changes when they occur.”

“I recognize that those who favor maintaining the failed economic embargo have a longstanding, visceral antagonism and resentment toward the Cuban government.  While they rarely, if ever, mention the corrupt and brutal Batista regime that enjoyed unqualified U.S. support until it was overthrown in 1959, they have legitimate reasons to criticize the mistreatment of the Cuban people by the current government and its support for the corrupt and repressive Maduro regime in Venezuela.”

“But they too should acknowledge that threatening and bullying Cuba has not worked.  In fact it has made the situation worse, and provided an excuse for the Cuban government to blame its own failures on us.  They should also acknowledge positive changes in Cuba, but they never do.  Not ever.  It is almost as if they are psychologically, ideologically, or emotionally incapable of saying one positive thing about the Cuban government, no matter what positive things it does.”   

“Perhaps they are afraid that if they did, they would alienate their donors in the Cuban-American community.  Of course, we know that Cuban-Americans are divided about the U.S. embargo.  Some are hardcore believers in the embargo, and they always will be.  But at least as many – and increasing numbers – oppose the embargo, especially those who were born after the Cuban revolution.” 

“I wonder what the pro-embargo isolationists would say if the Cuban government were to stop harassing and abusing dissidents who favor a more democratic system.  Would those who oppose the embargo say anything positive?” 

“What if the Cuban government decided to embrace a free market economy and let private businesses flourish?  Would those who oppose the embargo say anything positive?”

“I doubt it.  I doubt it because no matter what positive reforms occur in Cuba, they will continue to defend the embargo until Cuba is a full-fledged democracy and those who currently hold power either die or are voted out of office.” 

“We all want Cuba to become a democracy, where civil and political rights are respected, and the sooner the better.  But those same defenders of the embargo support billions of dollars in U.S. aid – and weapons sales – to countries that are led by authoritarian, brutal, and corrupt dictatorships and monarchies, some of which have held power for decades or generations.”    

“How do the pro-embargo diehards reconcile that?  They don’t and they can’t.”

“The fact is, Cuba is changing.  Not nearly as fast as we and the Cuban people would like, but it is changing in ways that few would have predicted not very long ago.”

“Last year, Raul Castro’s hand-picked successor, Miguel Diaz-Canel, became President and he promised a government more accessible and responsive to the people’s needs.  How he delivers on that promise remains to be seen.”   

“Since 2010, after the Cuban government recognized that the Internet is essential if Cuba wants to be part of the modern world, Internet access has exploded.  The government has opened hundreds of public Wi-Fi hot spots and cyber cafes in the past five years, and home Internet access became legal and available in 2017.  Today, almost half of the Cuban people have personal cell phones that were illegal just a decade ago.”

“As others have pointed out, these changes have encouraged new forms of communication, networking and organizing via social media.”

“But change does not come easily in Cuba, as it does not in many countries.  Last July, the government announced onerous new regulations on the private sector, covering a wide range of issues:  food safety, labor contracts, procurement, taxation, limits on the size of private businesses.  The new rules were an attempt by hardliners to crack down on the private sector, which was criticized for black marketeering.”

“But private entrepreneurs resisted, and they challenged the regulations as contradictory to the government’s own plans that recognizes the private sector as important to economic growth and employment. They appealed to government officials and spoke publicly about the harm the new rules would have on their businesses.”

“When the final regulations were issued, several that had caused the most resentment were dropped.  According to the Minister of Labor and Social Security, the decision to revise the rules was due to ‘the opinion and experiences of those directly involved.’”

“The government also retreated on a new law – Decree 349 – requiring artists, musicians and performers to register with the state and pay a large commission on their earnings from private engagements, and it banned work with objectionable content and empowered inspectors to shut down any offensive exhibition or performance.  Clearly, an attempt to further limit free expression.”

“Since the 1980s, Cuban artists have had more freedom to be critical of the government than other social sectors, and so it was not surprising that Decree 349 ignited widespread protests.  After social media was used to mobilize opposition within the Cuban arts community and among artists abroad, the government agreed not to enforce the law until implementing regulations are drafted in consultation with the arts community.”

“According to one observer, ‘during [the latter half of last year], nearly 8.9 million Cubans debated the draft of a new constitution in their workplaces, neighborhoods and schools.  Communist Party members were told not to argue with even the most radical proposals for amendments, and the ensuing debates were freewheeling, often lasting past their scheduled time.  Among the main topics: whether the president and state governors should be directly elected by voters; whether the concentration of wealth and property should be allowed; whether term limits and age limits for leaders were a good idea; and whether the Communist Party should be subordinated to the constitution and hence the law.”  Not long ago it would have been unthinkable to openly debate these issues, especially as part of a constitutional reform process.”

“One article that attracted intense debate recognized same-sex marriage, and was promoted by Raul Castro’s daughter, a long-time activist for LGBTQ rights. The proposal sparked strong opposition from evangelical churches supported by the Catholic Church.  Gay rights advocates countered with campaigns of their own.  The chance of a significant ‘no’ vote on the entire constitutional reform led the government to drop the provision from the final draft of the constitution with a pledge to consider it later.”

“This surge in mobilization by well-organized constituencies utilizing social media to resist government policy, from burdensome private sector regulations to gay marriage, is unprecedented in Cuba.  The government’s willingness to not only tolerate these organized challenges but to change policies in response to them, is significant. “   

“As has been noted, none of these issues dealt with the rigid structure of the Cuban system.  Cuba remains a one party state, in which those who challenge the system are treated as criminals.  But the precedent of organized interest groups mounting successful campaigns to challenge and change government policy is now established, which is positive.” 

“None of the longstanding critics of the Cuban government in the U.S. Congress or the Cuban-American community [has] acknowledged any of this, nor are they likely too.  For them, anything less than a wholesale change of government in Cuba is unworthy of mention, even though they apply a very different standard – a double standard – to other authoritarian governments.  In fact, they would ridicule anyone who regards such changes as positive or worthy of recognition.”

“As we know from our own experience, political reform is difficult.  Our own Electoral College, an anachronism designed to protect a slave-holding minority, remains in effect more than two centuries later.  Five times, in the world’s oldest democracy, it has prevented the winner of the most popular votes from being elected president.”  

“The Cuban people want to live better and they want a lot less government control over their lives.  Armed with cell phones and the Internet they are going to make increasing demands of their government.  This is happening at a time when Venezuela’s economy is collapsing and the survival of the Maduro regime, Cuba’s closest ally in the hemisphere, is in question.  Not surprisingly, the Cuban government is trying to limit the pace of change and to secure other benefactors.  It is turning increasingly to Russia, Algeria, Iran and other countries that welcome the chance to challenge U.S. influence in this hemisphere.” 

“This is a time for the United States to be actively and visibly engaged in Cuba, for Americans to be traveling to Cuba, for expanding educational, cultural, and professional exchanges between the U.S. and Cuba, and for American companies to be competing in Cuba.  It is not a time to return to a failed policy of threats and ultimatums, driven by domestic politics rather than by what is in our national interests.”

“That is why I am cosponsoring the Freedom to Export to Cuba Act.  And it is why I intend to support other bipartisan legislation to replace our failed Cuba policy with one that serves America’s interests, not the interests of a shrinking minority, and not the interests of Russia and other countries that are reaping the economic benefits of our self-defeating policy of isolation.”

Reaction

I concur in the rationale and conclusion of this speech: end the U.S. embargo of Cuba.

While I believe there is valid documentation of the Senator’s assertion that Cuba has limits on free speech and assembly, he views this in isolation from Cuba’s situation. Cuba is a small country facing the vastly larger and more powerful  U.S., which for many years has had various hostile policies and actions against Cuba, including secret and undercover so-called “democracy promotion” programs on the island. In that context, it should be easy to understand why Cuba is concerned about dissidents and free speech and assembly.  Accordingly reliable U.S. assertions about the abolition of so called “democracy promotion” programs on the island should be a precondition to improving Cuban freedoms of speech and assembly.

Cuba Religious Freedom in the Eyes of the U.S. State Department 

On May 29, 2018, the U.S. Department of State released its 2017 International Religious Freedom Report, which is required by the International Religious Freedom Act of 1998 (“the Act”) and which details the status of religious freedom in nearly 200 foreign countries and describes U.S. actions and policies in support of religious freedom worldwide.[1]

The State Department says its “guiding principle [in preparing this report] is to ensure that all relevant information is presented as objectively, thoroughly, and fairly as possible. Motivations and accuracy of sources vary, however, and the Department of State is not in a position to verify independently all information contained in the reports. To the extent possible, the reports use multiple sources to increase comprehensiveness and reduce potential for bias.”

At the report’s release, introductory remarks were made by Secretary of State Mike Pompeo (a former Republican U.S. Representative from Kansas and Director of the CIA), followed by a briefing for journalists by Ambassador at Large for International Religious Freedom Sam Brownback (a former Republican U.S. Senator and Governor of the State of Kansas). After reviewing these comments, the Report’s discussion of Cuba religious freedom will be covered.

Secretary Pompeo’s Introduction[2]

“This report is a testament to the United States’ historic role in preserving and advocating for religious freedom around the world. Religious freedom is in the American bloodstream. It’s what brought the pilgrims here from England. Our founders understood it as our first freedom. That is why they articulated it so clearly in the First Amendment. As James Madison wrote years before he was president or secretary of state, ‘conscience is the most sacred of all property.’ Religious freedom was vital to America’s beginning. Defending it is critical to our future.”

“Religious freedom is not only ours. It is a right belonging to every individual on the globe. President Trump stands with those who yearn for religious liberty. Our Vice President stands with them, and so do I.”

“Advancing liberty and religious freedom advances America’s interests. Where fundamental freedoms of religion, expression, press, and peaceful assembly are under attack, we find conflict, instability, and terrorism. On the other hand, governments and societies that champion these freedoms are more secure, stable, and peaceful.”

“So for all of these reasons, protecting and promoting global respect for religious freedom is a priority of the Trump administration. As our National Security Strategy so clearly states: ‘Our Founders understood religious freedom not as the state’s creation, but as the gift of God to every person and a fundamental right for a flourishing society.’ We’re committed to promoting religious freedom around the world, both now and in the future.”

“I am pleased to announce that the United States will host the first ever Ministerial to Advance Religious Freedom at the Department of State on July 25th and 26th of this year. I look forward to hosting my counterparts from likeminded governments, as well as representatives of international organizations, religious communities, and civil society to reaffirm our commitment to religious freedom as a universal human right. This ministerial, we expect, will break new ground. It will not just be a discussion group. It will be about action. We look forward to identifying concrete ways to push back against persecution and ensure greater respect for religious freedom for all.”

The Ambassador mentioned that Eritrea, Tajikistan, Saudi Arabia, Turkmenistan, North Korea  and Iran were “Countries of Particular Concer” and that Pakistan, Russia and Burma also raised serious issues.

Report’s Executive Summary: Cuba Religious Freedom

“The constitution provides for freedom of religion and prohibits discrimination based on religion. The government and the Communist Party, through the Communist Party’s Office of Religious Affairs (ORA), continued to control most aspects of religious life. Observers noted the government continued to use threats, travel restrictions, detentions, and violence against some religious leaders and their followers. In May the government officially informed the Assemblies of God (AG) it would not proceed with confiscation orders against 2,000 AG churches or demolish a church in Santiago under zoning laws passed in 2015; however, it did not provide written guarantees to this effect. Christian Solidarity Worldwide (CSW) [4] noted 325 violations of freedom of religion or belief during the year. CSW reported a “significant drop” in the reported cases of violations of religious freedom or belief in the year compared with previous years, which it attributed to the government’s verbal rescinding in May of the decree outlawing the 2,000 AG churches. The majority of CSW’s reported violations were related to government efforts to prevent members of the human rights organization Ladies in White from attending Catholic Mass, as well as government threats and harassment of members of religious groups advocating for greater religious and political freedom. Religious groups reported a continued increase in the ability of their members to conduct charitable and educational projects, such as operating before and after school and community service programs, assisting with care of the elderly, and maintaining small libraries of religious materials. Some leaders from Catholic, Protestant, and minority religious groups stated the religious freedom environment had improved compared with the previous year, pointing to progress made in a pending permit to build a permanent church structure, while some evangelical Christian groups said religious freedom had not improved for them.”” (Emphases added.)

“The Community of Sant’Egidio organized the Paths of Peace, an interreligious meeting, in Havana on October 4 and 5. Leaders of different religions and more than 500 participants attended the meeting, which focused on the importance of welcoming and integrating migrants regardless of their religious affiliation or nonaffiliation.”

“U.S. embassy officials met with ORA officials to discuss the registration process for religious organizations and encourage equal treatment in allowing nonregistered groups to practice their religion. Embassy officials also met with the head of the Council of Cuban Churches (CCC), a government-recognized organization with close ties to the government and comprising most Protestant groups, to discuss its operations and programs. The embassy met regularly with Catholic Church authorities and Jewish community representatives concerning the state of religious, economic, and political activities. Embassy officials also met with representatives from Muslim, Jehovah’s Witness, Santeria, and various Protestant communities. The embassy remained in close contact with religious groups, including facilitating exchanges between visiting religious delegations and religious groups in the country. In social media and other public statements, the U.S. government continued to call upon the government to respect the fundamental freedoms of its citizens, including the freedom of religion.”

The Report’s Comments About Cuban Government Practices[5]

Religious organizations and human rights groups stated the government continued to threaten, detain, and use violence against outspoken religious figures, especially those advocating for human rights and religious freedom or collaborating with independent human rights groups. Security forces took measures, including detentions sometimes accompanied by violence, which inhibited the ability of members of the protest group Ladies in White to attend Catholic Mass. Some members of independent evangelical Christian churches said government authorities closely monitored and detained, for unspecified periods of time, their leadership and family members. Representatives of the Patmos Institute, a religious freedom advocacy organization, said authorities also targeted Christians affiliated with the institute, including through threats, detentions, and expulsions from school and work. One leader, who stated the situation had improved from the previous year, cited the approved permit to build the first new church built in the country since 1959.”

“Some high level Catholic, Protestant, and minority religious leaders stated the religious freedom environment had improved compared with the previous year; however, some evangelical Christian groups said religious freedom had not improved for their groups. CSW’s annual report stated church leaders from all denominations reported consistent harassment and surveillance from state security and officials responsible for religious affairs. It also stated the government continued to severely restrict public religious events. The CSW report counted 325 violations during the year, compared with 2,380 violations in 2016 and over 2,300 violations in 2015. In its report CSW stated the “significant drop” in the reported cases of violations of religious freedom or belief in the year, compared with previous years, was due to the government’s verbal rescinding in May of a decree that had outlawed 2,000 AG churches. One leader, who stated the situation had improved from the previous year, cited the approved permit to build a new Catholic church in Pinar del Rio Province – the first new church built in the country since 1959.” (Emphases added.)

“According to CSW, human rights activist Jorge Luis Garcia Perez reported state security agents raided the home of Misael Diaz Paseiro on October 22 and confiscated two Bibles, a number of crucifixes and five rosaries. On November 4, police reportedly beat Diaz, tore his rosaries from his neck, and said ‘in addition to being a counterrevolutionary, you are also a Christian. You should look at us – we are revolutionaries and we don’t believe in your god. Our god is Fidel Castro.’ Diaz was imprisoned on November 22 and reportedly denied visits from a priest and access to a Bible. The Christian Post reported the government charged Diaz with ‘pre-criminal dangerousness’ and sentenced him to 3.5 years in prison.” (Emphasis added.)

“Reverend Juan Carlos Nunez Velazquez, an Apostolic Movement leader, lost an appeal on February 1 to overturn his sentence of one year under house arrest. Police arrested Nunez in 2016 for disturbing the peace because he failed to comply with police orders to reduce the size and volume of the speakers he used during Sunday sermons at his open-air church.”

“According to CSW, in February authorities twice interrogated an Eastern Baptist Convention pastor about his work, members of his congregation, and the activities of his church. The authorities also threatened to confiscate the property; however, at year’s end, the government had taken no action against the church.” (Emphasis added.)

“According to CSW and news sources, on April 27, airport authorities detained and interrogated Felix Yuniel Llerena Lopez, a 20-year-old student and evangelical Christian and religious freedom activist, upon his return to the country. The authorities informed Llerena Lopez he was being investigated for planning terrorist acts, possessing pornographic materials, and meeting with “terrorist” Cuban exiles opposed to the government. The authorities briefly detained Lopez’s mother, expelled Llerena Lopez from the university where he was a part-time student, and banned him from international travel. On October 2, authorities informed Llerena Lopez he would not be charged with any crimes and rescinded his travel ban; however, the university had not reinstated him at year’s end. CSW quoted Llerena Lopez as saying, ‘After five months of opposition, arrests, being expelled from university, intimidation, threats, and a false accusation, today I can say that solidarity and the dignity of not giving up on principles … triumphed.’” (Emphases added.)

“According to CSW, on November 6, police arrested and briefly detained Leonardo Rodriguez Alonso, a local Patmos coordinator in Santa Clara, without charges. CSW sources said on April 11, Rodriguez’s daughter, Dalila Rodriguez Gonzalez, was fired from her position as a university professor for not being ‘a good influence on students’ and because she ‘could damage their formation.’  According to Rodriguez Alonso, his daughter’s dismissal was revenge for his religious freedom advocacy.” (Emphasis added.)

“According to CSW, police physically assaulted members of the Ladies in White, a rights advocacy organization, while they were en route to attend religious ceremonies. On February 19, CSW reported that a police officer punched in the face Ladies in White member Magda Onelvis Mendoza Diaz as she was going to church. On August 13, a police officer in Havana reportedly choked Berta Soler Fernandez, and officers detained her for 24 hours; they subsequently released her without charge.” (Emphases added.)

“According to representatives of several religious organizations that had unsuccessfully sought legal recognition, the government continued to interpret the law on associations as a means for the MOJ to deny the registration of certain religious groups. If the MOJ decided a group was duplicating the activities of another, it denied recognition. In some cases, the MOJ delayed the request for registration or cited changing laws as a reason why a request had not been approved.”

“According to the members of Protestant denominations, some groups were still able to register only a small percentage of ‘house churches’ in private homes; however, most unregistered house churches continued to operate with little or no government interference. A number of religious groups, including the Jehovah’s Witnesses and the Mormons, continued to await a decision from the MOJ on pending applications for official recognition, some dating as far back as 1994. These groups said the authorities permitted them to conduct religious activities, hold meetings, receive foreign visitors, make substantial renovations to their facilities, and send representatives abroad. They also said state security continued to monitor their movements, telephone calls, visitors, and religious meetings.”

“According to CSW sources, on September 14, police disrupted an interdenominational Christian service in Santiago; local authorities had previously approved the service. Local authorities said the service was ‘counterrevolutionary’ and threatened to imprison event organizer Pastor Ernesto Lora if he organized a similar event in the future.” (Emphasis added.)

“According to CSW, on April 3, authorities in Las Tunas fined Reverend Mario Travieso of the Apostolic Church 1,500 pesos ($1,500) for building a wall next to his church that the authorities considered too high even though he had received written approval from his neighbors. Prior to imposing the fine, authorities had inspected his house in response to a noise complaint; they told him not to pray or sing with neighboring families.” (Emphasis added.)

“Many religious leaders continued to state they refrained from speaking about overtly political topics. Some said they feared criticizing the government could lead to denials of permits from the ORA, dismantling of religious buildings, or other measures that could limit the growth of their religious groups. The nongovernmental organization Outreach Aid to the Americas (OAA) reported some instances in which evangelical Christians not supporting Communist Party political activities experienced harassment and threats from government employers and educators.”

“According to the OAA, the Central University in Santa Clara expelled an 18-year-old student after he began attending Christian group meetings at the university. The OAA said university officials told the student he was expelled because his beliefs ‘were not compatible with the philosophy taught at the university.’”

“The OAA said from October 2016 to April 2017, the supervisors of an employee in a government-run company in Taguasco reportedly threatened the employee with termination after learning he had joined a Christian church in 2016. The man reported his harassment and threats to his pastor in April.”

The OAA stated in April school administrators had threatened to expel a 17-year-old student “enrolled in a pre-university course at the Ernesto Che Guevara Institute of Santa Clara if he continued to participate in Christian group meetings.”

“In May the government informed the Assemblies of God (AG) it would not proceed with confiscation orders against 2,000 AG churches or demolish a church in Santiago under zoning laws passed in 2015; however, it did not provide written guarantees to this effect.”

“Many religious groups continued to use private homes as house churches to work around restrictions on constructing new buildings. Protestant leaders’ estimates of the total number of house churches for Protestant groups varied significantly, from fewer than 2,000 to as many as 10,000. Religious groups said authorities approved many applications within two to three years from the date of the application, but either did not respond to or denied other applications arbitrarily.”

“Representatives from both the Catholic Church and the CCC [Cuban Council of Churches] said they continued to conduct religious services in prisons and detention centers in some provinces. The Protestant seminary in Matanzas and churches in Pinar del Rio continued to train chaplains and laypersons to provide religious counseling for prison inmates and to provide support for their families. The CCC continued to operate a training facility it opened in 2016, at which it offered courses on chaplain work as well as courses on caring for sacred religious objects, gender and women’s issues, and seminars for international students.”

“Representatives of religious groups reported their leaders continued to travel abroad generally unimpeded to participate in exchanges between local and international faith-based communities.”

“The majority of religious groups continued to report improvement in their ability to attract new members without government interference, and a reduction in interference from the government in conducting their services. According to local observers, in September authorities prohibited a Baptist journalist from traveling with an interfaith group of religious and civil society activists and journalists to a human rights training seminar in Brazil. The journalist’s employer reportedly accused the journalist of selling secret information and of committing treason. Several independent journalists and bloggers reported an increase in government harassment and prohibitions of travel of individuals who questioned government policies.”

“Some religious leaders reported obstacles preventing them from importing religious materials and donated goods, including bureaucratic challenges and arbitrary restrictions such as inconsistent rules on computers and electronic devices. Several groups said they could import large quantities of Bibles, books, clothing, and other donated goods. The Catholic Church and several Protestant religious group representatives said they continued to maintain small libraries, print periodicals and other information, and operate their own websites with little or no formal censorship. The Catholic Church continued to publish periodicals and hold regular forums at the Varela Center that sometimes criticized official social and economic policies.”

“By year’s end, the government had not granted the Archbishop of Havana’s 2016 public request to allow the Catholic Church to reopen religious schools and have open access to broadcast on television and radio. The ORA authorized the CCC to host a monthly radio broadcast, which allowed the council’s messages to be heard throughout the country. No other churches had access to media, which are all state-owned. Several religious leaders continued to protest the government’s restriction on broadcasting religious services over the radio or on television.”

“The ORA stated in August the law on associations was being revised, although it did not provide a timeline for when the revisions would be finalized, nor what the changes would be. Members of the AG continued to request the government pass reforms to the law that would validate and legalize the property the church owned, as well as allow the church to build new temples.”

“Several religious leaders said the ORA continued to grant new permits to repair or restore existing buildings, allowing the expansion of some structures and in some cases the construction of essentially new buildings on the foundations of the old. In August an ORA source stated the ORA had granted permission in 2015 for the Catholic Church to build an entirely new church on newly acquired ground in Pinar del Rio Province. The media reported in 2017 the construction was almost complete. Some religious leaders stated the government regularly granted permits to buy properties to be used as house churches, including in some cases when the titleholder to the property did not plan to live there. Other religious groups stated securing permission for the purchase or construction of new buildings remained difficult, if not impossible.”

T”he government continued to prevent religious groups from establishing accredited schools but did not interfere with the efforts of some religious groups to operate seminaries, interfaith training centers, before- and after-school programs, eldercare programs, weekend retreats, workshops for primary and secondary students, and higher education programs. The Catholic Church continued to offer coursework leading to a bachelor’s and master’s degree through foreign partners. Several Protestant communities continued to offer bachelor’s or master’s degrees in theology, the humanities, and related subjects via distance learning; however the government did not recognize any of these degrees.”

“Jehovah’s Witnesses leaders continued to state they found the requirements for university admission and the course of study incompatible with the group’s beliefs since their religion prohibited them from political involvement. As a result, Jehovah’s Witnesses remained ineligible for professional careers in the fields of law, medicine, among others.”

“Church leaders reported the government continued an unofficial practice of allowing civilian public service to substitute for mandatory military service for those who objected on religious grounds. Church leaders submitted official letters to a military committee, which decided whether to grant these exemptions. Jehovah’s Witnesses and Seventh-day Adventist leaders stated their members generally were permitted to perform social service in lieu of military service.”

“Some religious leaders said the government continued to restrict their ability to receive donations from overseas. They cited a measure that prohibited churches and religious groups from using individuals’ bank accounts for their organizations, and required existing individual accounts used in this way to be consolidated into one per denomination or organization. Larger, better organized churches reported more success in receiving large donations, while smaller, less formal churches reported difficulties with banking procedures. According to these religious leaders, the regulations allowed the government to curb the scope and number of activities of individual churches and to single out groups that could be held accountable for withdrawing money intended for purposes not approved by the government.”

“Religious groups continued to report the government allowed them to engage in community service programs, including assisting the elderly, providing potable water to small towns, growing and selling fruits and vegetables at below-market prices, and establishing health clinics. International faith-based charitable operations such as Caritas, Sant’Egidio, and the Salvation Army maintained local offices in Havana. Caritas in particular was very involved in gathering and distributing hurricane relief items.”

“According to the Western Baptist Convention (WBC), on July 6, members of a family that occupied a Havana property owned by the WBC more than 30 years ago broke into the WBC’s new office adjacent to where the family lived. The family reportedly stole the WBC’s documents, computers, furniture, and other property and refused to return it to the WBC. The ORA took no action, despite WBC’s requests for ORA’s intervention. In 1992, a court ruled the family’s residency in the property was illegal but did not require the family to leave.”

Conclusion

The Act requires the Secretary of State to make annual designations of counties that have “engaged in or tolerated systematic, ongoing, and egregious violations of religious freedom” as “Countries of Particular Concern,” and on December 22, 2017, then Secretary Rex Tillerson so designated these 10 countries: Burma, China, Eritrea, Iran, North Korea, Sudan, Saudi Arabia, Tajikistan, Turkmenistan, and Uzbekistan, all of which in this Report are so identified.[6]

The Report’s discussion about Cuba surprisingly did not mention the recent annual report of the U.S. Commission on International Religious Freedom and instead heavily relied on the annual report of Christian Solidarity Worldwide, which seems contrary to the Department’s stated desire to have multiple sources of information. Further research and a separate blog post about CSW seem necessary and then an overall evaluation of these reports about Cuba religious freedom.

U.S.’ Secret Cuban Social Media Program Raises Questions about the Validity of Criticisms of Cuba by the U.S. Commission on International Religious Freedom

On April 3, 2014, the Associated Press (AP) reported that the U.S. Agency for International Aid (USAID) had been providing financial support from 2008 through 2012 for “a secret plan to build a social media project aimed at undermining Cuba’s communist government.” This “messaging network . . . [was designed to] reach hundreds of thousands of Cubans.” “To hide the network from the Cuban government, [there was a] byzantine system of front companies using a Cayman Islands bank account, and . . . [recruitment of] unsuspecting executives who would not be told of the company’s ties to the U.S. government.”

According to the AP, after an initial period of creating non-political messages for this social media program, the U.S. planed to “introduce political content aimed at inspiring Cubans to organize ‘smart mobs’ — mass gatherings called at a moment’s notice that might trigger a Cuban Spring, or, as one USAID document put it, “renegotiate the balance of power between the state and society.” In short, the social media program aimed to promote regime change in Cuba.

U.S. Government’s Responses to the AP Report

The U.S. Government responded to the AP article the same day by essentially confirming the existence of the social media program while playing word games over whether it was a covert operation and saying it was not aimed at changing the Cuba regime.

At an April 3rd press briefing, President Obama’s Press Secretary, Jay Carney, implicitly admitted the existence of this secret program while claiming it was not covert and was pursuant to congressionally authorized funding. He said, “suggestions that this was a covert program are wrong. . . . In implementing programs in non-permissive environments, of course the government has taken steps to be discreet.”

An USAID spokesman the same day said essentially the same thing. “Of course, [in] the implementation, . . the [U.S.]government [has] taken steps to be discreet in non-permissive environments . . . .  That’s how you protect the practitioners and the public. In hostile environments, we often take steps to protect the partners we’re working with on the ground. This is not unique to Cuba.”

USAID also issued an April 3rd statement that did not deny the AP’s report. Instead, the agency said, “It is longstanding U.S. policy to help Cubans increase their ability to communicate with each other and with the outside world. Working with resources provided by Congress for exactly this purpose, USAID is proud of its work in Cuba to provide basic humanitarian assistance, promote human rights and universal freedoms, and to help information flow more freely to the Cuban people.  All of our work in Cuba, including this project, was reviewed in detail in 2013 by the Government Accountability Office and found to be consistent with U.S. law and appropriate under oversight controls.”

USAID added, “It is also no secret that in hostile environments, governments take steps to protect the partners we are working with on the ground.” This was a backhanded way of admitting that the U.S. government’s involvement in this Cuban social media program was intentionally kept secret.

The U.S. State Department’s April 3rd briefing parroted these remarks. The spokesperson said, “there was nothing classified or covert about this program. Discreet does not equal covert.” She added, the funding was notified to Congress in a 2008 congressional notification titled “Outreach to New Sectors of Cuba Society” for the amount of $6,850,000 for a number of programs, including this one.” Moreover, the spokesperson alleged the U.S. was not “ somehow trying to foment unrest . . . [or] to advance a specific political agenda or point of view.” However, Senator Patrick Leahy has said he was not briefed on the program.

Yes, the U.S. Government Accountability Office investigated and last year issued a “clean bill of health” report on the U.S. “Cuba Democracy Assistance” programs, without mentioning the social media program. This report said that USAID and “Department of State .  . . provide democracy assistance for Cuba aimed at developing civil society and promoting freedom of information. Typical program beneficiaries include Cuban community leaders, independent journalists, women, youths, and marginalized groups.”[1]

Other U.S. Government Programs Directed at Cuba

The recent Cuban social media project must be seen in light of at least three other U.S. programs directed at and against Cuba.

First is the George W. Bush Administration’s creation in 2003 of the U.S. Commission for Assistance to a Free Cuba. It was directed it to report with recommendations for a comprehensive program to (i) “Bring about a peaceful, near-term end to the [Cuban] dictatorship;” (ii) “Establish democratic institutions, respect for human rights and the rule of law [in Cuba];” (iii) “Create the core institutions of a free economy [in Cuba];” (iv) “Modernize [Cuban] infrastructure;” and (v) “Meet [Cuban] basic needs in the areas of health, education, housing and human services.”

This Commission issued a report in May 2004 that stated “Religious organizations, including Catholic and certain authentically independent Protestant denominations, represent the fastest growing and potentially fastest growing alterative to the Cuban state in providing basic services and information to the Cuban people.” (P. 20; emphasis added.)

The rest of this report makes clear that the Commission believed that only evangelical Christian groups were authentically independent and should be used by the U.S. to build a free Cuba. According to this report, they had “the trust of the people and the means to organize through an existing social network of communications and distribution channels at all levels of society.”[i]

The report also called for the U.S. to avoid trying to use the Cuban Council of Churches, which the U.S. Commission believed had been “taken over by the Castro regime in the early 1960s and used as a means to control the Protestant churches.” (P. 64.) However, most of the clergy and laity of churches that belong to the Council, the Commission asserted, were “not sympathasizers of Castro and the communists and therefore should not be denied assistance or a role in Cuban religious affairs due to ‘guilt by association.” (P. 64)

The second other U.S. program directed against Cuba was the George W. Bush Administration’s 2005 creation of the position of Cuba Transition Coordinator in the State Department to implement the recommendations of the Commission for Assistance to a Free Cuba. Or in the words of then-Secretary of State, Condoleeza Rice, the position’s purpose was to “accelerate the demise of Castro’s tyranny.” In more practical terms, this position was charged with allocating millions of dollars in U.S. funding to Cuban dissidents and their U.S. supporters.

The third other program directed against Cuba is Radio y Televisión Martí, a radio and television broadcaster based in Miami, Florida that is financed by the U.S. Government (Broadcasting Board of Governors) and that transmits pro-democracy newscasts to Cuba.

U.S. Commission on International Religious Freedom Reports on Cuba

Another U.S. commission—the Commission on International Religious Freedom– in its annual reports consistently has been very critical of that freedom in Cuba.

This Commission has placed Cuba in its “Watch List,” now called its “Tier 2” list of countries “where religious persecution and other violations of religious freedom engaged in or tolerated by the governments are increasing” or is “on the threshold of . . . [‘Countries of Particular Concern’] status—because the  “violations engaged in or tolerated by the government are particularly severe and that at least one, but not all three, of the elements of [the governing statute’s] ‘systematic, ongoing, egregious’ standard is met (e.g., the violations are egregious but not systematic or ongoing).”

The Commission apparently based its very negative appraisal of Cuba in its most recent  report for 2012 (issued in 2013) on the following grounds with respect to the Cuban government:

  •  alleged arrests and mistreatment of evangelical pastors, especially Pentacostal pastor Reutilio Columbie;
  • alleged arrests of human rights/democracy activists, including the Ladies in White, which prevented them for attending mass; and
  • alleged harassment of Cuba’s Apostolic Reformation Movement and the Western Baptist Convention by allegedly making “short-term arrests of [their] leaders, confiscation, destruction or threats of destruction of church property; harassment and surveillance of church members and their relatives; fines of churches; and threats of losses of job, housing or educational opportunities….”

This Blog’s Prior Critiques of the Commission’s Assessment of Cuba

This blog has criticized the Commission’s reports on Cuban religious freedom for 2010, 2011 and 2012.

First, as the Commission reports themselves proclaim, there have been “improvements” or “[p]ostive developments” for the religious freedom of most of the religious organizations on the island. The most recent report states:

  • “Positive developments for the Catholic Church and major registered Protestant denominations, including Baptists, Pentecostals, Presbyterians, Episcopalians, and Methodists, continued over the last year. The State Department reports that religious communities were given greater freedom to discuss politically sensitive issues. Catholic and Protestant Sunday masses were held in more prisons throughout the island. Religious denominations continued to report increased opportunities to conduct some humanitarian and charity work, receive contributions from co-religionists outside Cuba, and obtain Bibles and other religious materials. Small, local processions continued to occur in the provinces in 2012. The government granted the Cuban Council of Churches time for periodic broadcasts early Sunday mornings, and Cuba’s Roman Catholic Cardinal read Christmas and Easter messages on state-run stations.”
  • “Relations between the Catholic Church and Cuban government continued to improve. March 2012 marked the 400th anniversary of the appearance of the Virgin de Caridad de Cobre (Our Lady of Charity), Cuba’s patron saint. Pope Benedict XVI travelled to Cuba March 26-29 to participate in the celebrations, at which time he met Fidel Castro and Cuban President Rául Castro. Throughout the year, a replica of the Our Lady of Charity statue toured the island drawing large crowds. Prior to the Pope’s visit, 13 individuals occupied the Church of Charity of Cobre in Central Havana seeking an audience with His Holiness. The government removed, but did not charge, the individuals at the request of the Church.”

Second, the Commission’s statements about positive developments cover, I submit, most of the religious organizations and believers in Cuba, whereas the organizations cited by the Commission for its harsh judgments are the distinct minority. That, of course, does not excuse the Cuban government from committing any of the alleged acts regarding these organizations and believers, if that in fact is the case.

Third, the Commission’s complaint about the treatment of “human rights/democracy activists,” if they are substantiated by evidence, are really complaints about violations of human rights other than religious freedom. Therefore, they do not really belong in the limited scope of the Commission’s mandate.

Fourth, the Commission apparently is unable to put itself in the shoes of the Cuban government, which for many years has had to contend with the super power of the North, which has consistently taken hostile actions against the island, including those of the “Cuba Democracy Assistance” program. The wise words of Matthew 7: 5 come to mind: “You hypocrite, first take the log out of your own eye, and then you will see clearly to take the speck out of your neighbor’s eye.”

Conclusion

This blogger concludes that the revelation yesterday of the U.S. secret social media program for Cuba as part of the U.S.’ so called “Cuba Democracy Assistance” programs should raise serious questions about the legitimacy of the conclusions on Cuban religious freedom coming from the U.S. Commission on International Religious Freedom.

Specifically, there should be an independent investigation of whether Cuba’s Apostolic Reformation Movement, its Western Baptist Convention and pastor Reutilio Columbie have received or are receiving any funding or other support from the U.S. Government, including USAID, the Central Intelligence Agency, the State Department and the Commission on International Religious Freedom itself. I hope that this is not the case.

More generally, such an investigation should determine whether the harshly negative views of the Commission on International Religious Freedom are being driven by the philosophy and objectives of the Cuba Assistance Programs. Again I hope this is not the case.
