Criticism of President Biden’s “New Cuba Policy”

On May 16, 2022, the White House held a press briefing on what it called “Our New Cuba Policy.” After examining the details of that briefing, we will evaluate that so called “New Policy” and conclude that it is inadequate by failing to call for elimination of (a) the U.S. embargo of Cuba and (b) the U.S. designating Cuba as a “state sponsor of terrorism.”

U.S. “New Cuba Policy”[1]

The “new” policy was said to be designed “to increase support for the Cuban people and safeguard our national security interests” and resulted from the U.S. study over the last year that “continues to center on human rights and empowering the Cuban people to determine their own future, and we continue to call on the Cuban government to release all political prisoners.” This review was directed by President Biden to take actions in response to “the large-scale [Cuban] protests that took place last July” and “to take actions in two primary areas:”

  • “The first is to promote accountability for human rights abuses, for which we have announced several rounds of sanctions targeting those individuals and entities with direct ties to human rights abuses.”
  • “Second, . . . to explore meaningful ways to support the Cuban people.”

Therefore, the “new” policy has “prioritized and facilitated the export of privately sourced or donated goods to the Cuban people, focusing specifically on agricultural and medical exports; facilitated U.S. private sector faith-based organizations and other NGOs to provide humanitarian support; provided guidance to individuals and entities seeking to export to Cuba for the first time; . . . increased our support for the families of those who were detained; and increased, by $5 million, our support for censorship circumvention technology to support the ability of the Cuban people to communicate to, from, and among each other.”

In addition, the “new” policy was stated to fulfill President Biden’s commitment to the “Cuban American community and their family members in Cuba” by the following measures:

  • “[R]einstate the Cuba Family Reunification Parole Program and continue to increase the capacity for consular services. . . . [The U.S.] resumed limited immigrant visa processing [in Cuba] in early May and are looking to make sure that we staff up so that we can begin processing the full 20,000 immigrant visas out of Havana as quickly as possible.”
  • “[Strengthen] family ties and . . . [facilitate] educational connections for American and Cuban people by expanding authorized travel. . . . [That includes] specifically authorizing commercial and charter flights to locations beyond Havana.  We are reinstating group people-to-people educational travel under a general license, among a number of other measures.  We are not reinstating individual people-to-people educational travel.”
  • “[w]e are increasing support for independent Cuban entrepreneurs.  That includes encouraging commercial opportunities outside the state sector by using . . . independent Cuban entrepreneurs’ access to the Internet, cloud technology, programming interfaces, e-commerce platforms, and a number of other measures, including access to microfinance and training.”
  • The U.S. “will ensure that remittances flow more freely to the Cuban people while not enriching those who perpetrate human rights abuses.  . . . [That includes] removing the limit on family remittances of $1,000 per quarter per sender/receiver pair.  And we’ll authorize donative remittances, which will support Cuban families and independent Cuban entrepreneurs.”

In addition, the new policy will “continue to elevate the matter of human rights, the treatment of political prisoners, and . . . elevate the issue of labor rights in Cuba, [which more generally is “a core priority for the Biden-Harris administration.”

The authorization of group travel to Cuba will be limited to purposeful purposes, not tourism.

More generally the new policy is intended “to help alleviate the humanitarian suffering that prompts out-migration from Cuba and also to advance our interest in supporting the Cuban people and ensuring that Cuban Americans and Americans in general are also the best advanced ambassadors for U.S. policy.”

The U.S. will be increasing the staff at the Havana Embassy “with an appropriate security posture.”

There was no mention at this briefing of two very significant U.S. policies regarding Cuba: the U.S. embargo of the island and the U.S. designation of Cuba as a “state sponsor of terrorism.” Therefore, both of them remain in effect with continued major impacts on the island and will be discussed below.

Reactions to the “New” U.S. Cuba Policy[2]

New Jersey Democratic Senator Bob Menendez, a Cuban-American and now the Chair of the Senate Foreign Relations Committee, welcomed the maintenance of the State Department’s Cuba Restricted List and the restart of the Cuban Family Reunification Parole program. But he was “dismayed” at its restarting group travel to the island because it will not breed democracy on the island and merely help the Cuban government fund its “continued repression.”

The harshest critic of the “new” policy was Ben Rhodes, who was President Obama’s Deputy National Security Advisor and involved in that administration’s efforts to normalize relations with Cuba. Said Rhodes, “Disappointed doesn’t begin to scratch the surface of how I feel about the Biden-Cuba policy. Granted it was Trump” who initially reversed Obama’s policies, but “then Biden doubles down” on Trump’s policies. We had Trump—in the most grotesque, callous way—politicizing this. But then Biden doubles down. It’s a gaslighting to those people in Cuba ” (deliberately and systematically feeding false information that  leads recipients to question what they know to be true). (Emphasis added).

Scott Hamilton, who served as U.S. charge d’ affaires in Havana during Obama’s opening to Cuba, said Biden’s measures do not reorient relations, but “are more about addressing the need to get the numbers [of Cuban [emigrants] down on migration.”

It also should be noted that Biden left Trump’s sanctions in place as the coronavirus pandemic overwhelmed the island’s medical system and strangled tourism, a crucial source of cash and goods for families. Allowing U.S. flights only to Havana ignores the difficulties of obtaining and paying for land transportation to other parts of the island, and most hotels are off-limits under U.S. regulations. Biden’s relaxing limits on remittances to families on the island is a good idea, but it does not cope with the difficulties of U.S. blacklisting of the financial institution for electronic fund transfers, Fincimex, due to its ties to the Cuban military. A leading U.S. expert on Cuba, William LeoGrande, a professor of government at American University, said, “What’s striking about these[Biden] measures is, there’s nothing about reopening the diplomatic dialogues that were ongoing at the end of the Obama administration.”

As a member of a church (Minneapolis’ Westminster Presbyterian) that since 2001 has had a partnership with a Presbyterian church in Matanzas, Cuba and members who actively provide and maintain clean-water systems on the island,I welcome the new Policy’s encouraging “faith-based organizations to provide humanitarian support.” I, therefore, reject Senator Menendez’s criticism of encouraging group travel to the island.

The Biden administration is hoping that these new measures will reduce Cuba’s soaring out-migration. Apprehensions of Cubans on the U.S.-Mexico border have rocketed to more than 113,000 in the first seven months of this fiscal year, nearly three times as many as in all of fiscal 2021. These emigrants include some activists who were protesting in the streets last year, teachers, farmers and parents of young children who decided they would be better off leaving as the island’s economy continued to tank, the Cuban government having not enacted significant reforms and Nicaragua lifted its visa requirement, making travel there easier. This exodus is sapping Cuba of much of its youth while its population is aging and declining.

Now these economic problems have been exacerbated by the following two recent events:

  • In August 2022 oil storage tanks near the city of Matanzas on the north coast of the island were destroyed by a lightning strike. That destruction resulted in a heavy human toll and a serious blow to fuel for Cuba’s electric power generating system, which already had been tottering from lack of maintenance and investment. The U.S., however has not offered any help in responding to this emergency other than telephonic technical assistance.
  • More recently, on September 26, Hurricane Ian, a Category 3 storm, slammed into the western end of the island. The next morning videos showed residents walking through waist-deep water as waves continued to crash on shore. Power lines, trees and siding could be seen littered along the roads. Electric power throughout the island was damaged.

U.S. Embargo of Cuba[3]

On October 19, 1960, almost two years after the Cuban Revolution had taken over the island’s government, the Eisenhower administration launched the U.S. trade embargo against Cuba that prohibited all U.S. sales of goods and services to Cuba except food and medicine. That embargo continues in effect today, nearly 62 years later, with amplification by many U.S. statutes.

Cuba claims that to date it has suffered significant economic damages from the embargo and the U.N. General Assembly every year since 1992 (except 2020 due to the Covid pandemic) has adopted resolutions, by overwhelming margins, condemning the embargo as a violation of international law.

The last session to approve such a resolution happened on June 23, 2021, when the vote was 184 to 2 (the U.S. and Israel in opposition) with three abstentions (Colombia, Ukraine and Brazil). Cuba’s Foreign Minister, Bruno Rodriguez Parrilla told the Assembly that the embargo was a “massive, flagrant and unacceptable violation of the human rights of the Cuban people” and  “an economic war of extraterritorial scope against a small country already affected in the recent period by the economic crisis derived from the pandemic” with estimated 2020 losses alone to be $9.1 million.

The U.S. opposition at the last session was offered by Rodney Hunter, the Political Coordinator for the U.S Mission, who said sanctions are “one set of tools in the U.S. broader effort toward Cuba to advance democracy, promote respect for human rights, and help the Cuban people exercise fundamental freedoms.” Moreover, despite the blockade, the US recognizes “the challenges of the Cuban people” and therefore, the US was “a significant supplier of humanitarian goods to the Cuban people and one of Cuba’s principal trading partners. Every year we authorize billions of dollars’ worth of exports to Cuba, including food and other agricultural commodities, medicines, medical devices, telecommunications equipment, other goods, and other items to support the Cuban people. Advancing democracy and human rights remain at the core of our policy efforts.”

The current session of the General Assembly on November 2, 2022, will consider this year’s report by the U.N. Secretary-General, “Necessity of ending the economic, commercial and financial embargo imposed by the United States of America against Cuba.” The U.N. website for this report had a list of countries that had submitted comments (presumably supportive of the resolution), but did not include any comments from the U.S. or Israel, both of whom voted against the resolution in 2021, or from the three countries that abstained last year (Brazil, Colombia and Ukraine).

Therefore, it is fair to assume that the resolution against the U.S. embargo will again by overwhelmingly approved on November 2. Moreover, this blog continues to support abolishing the embargo.

U.S. Designation of Cuba as a “State Sponsor of Terrorism”[4]

Since 1982 the United States has had different opinions as to whether Cuba was a “state sponsor of terrorism” under three U.S. statutes—the Export Administration Act (section 6(j)), the Arms Export Control Act (section 40) and the Foreign Assistance Act (Section 620A)—that authorize the Secretary of State to designate countries that “have repeatedly provided support for acts of international terrorism” as “state sponsors of terrorism” and thereby impose sanctions on such countries, including restrictions on U.S. foreign assistance, bans on U.S. defense exports and sales, controls over exports of dual use items and miscellaneous financial and other restrictions.

We will look at these different positions, including the Biden Administration’s current review of the Trump Administration’s last minute designation of Cuba as a “State Sponsor.”

Cuba as “State Sponsor of Terrorism,” 1982-2014. From 1982 through 2014, the U.S. designated Cuba as such a Sponsor.[5]

U.S. Rescinds Cuba’s “Sponsor” Designation, 2015.  [6] On April 14, 2015, Secretary of State John Kerry publicly announced that the State Department had recommended that President Obama rescind the designation of Cuba as a “State Sponsor of Terrorism.” His press release stated that the prior week the “Department submitted a report to the White House recommending, based on the facts and the statutory standard, that President Obama rescind Cuba’s designation as a State Sponsor of Terrorism.”

“This recommendation,” the Statement continued, “reflects the Department’s assessment that Cuba meets the criteria established by Congress for rescission . . . . whether Cuba provided any support for international terrorism during the previous six months, and whether Cuba has provided assurances that it will not support acts of international terrorism in the future.” This conclusion was based, in part, upon “corroborative assurances received from the Government of Cuba.”

Nevertheless, according to the Secretary’s statement, “the United States has had, and continues to have, significant concerns and disagreements with a wide range of Cuba’s policies and actions, [but] these concerns and disagreements fall outside of the criteria for designation as a State Sponsor of Terrorism.”

The same day (April 14, 2015), a White House press release stated the President had “submitted to Congress the statutorily required report and certifications indicating the Administration’s intent to rescind Cuba’s State Sponsor of Terrorism designation.” That presidential decision was based upon the previously mentioned State Department recommendation that was based on its “careful review of Cuba’s record, which was informed by the Intelligence Community, as well as assurances provided by the Cuban government.”

This White House press release also stated, “As the President has said, we will continue to have differences with the Cuban government, but our concerns over a wide range of Cuba’s policies and actions fall outside the criteria that is relevant to whether to rescind Cuba’s designation as a State Sponsor of Terrorism.  That determination is based on the statutory standard – and the facts – and those facts have led the President to declare his intention to rescind Cuba’s State Sponsor of Terrorism designation.  More broadly, the [U.S.] will continue to support our interests and values through engagement with the Cuban government and people.”

President Obama’s simultaneous message to Congress certified that “(i) the Government of Cuba has not provided any support for international terrorism during the preceding 6-month period; and (ii) the Government of Cuba has provided assurances that it will not support acts of international terrorism in the future.”

U.S. Non-Designation of Cuba, 2016-2020.[7] From 2016 through the end of the Obama Administration in January 2017, the U.S. continued to not so designate Cuba as the U.S. and Cuba held several bilateral diplomatic meetings to discuss the many issues that had accumulated ever since the January 1, 1959, takeover of the Cuban government by the Cuban Revolution.

At  their May 2016 Law Enforcement Dialogue, the U.S. State Department said that “law enforcement is an area of mutual interest to both the U.S. and Cuba as we advance toward normalized relations. We anticipate that the dialogue will be productive, and an additional opportunity to reinforce the benefits of law enforcement cooperation. During the dialogue, the United States and Cuba will continue to discuss a wide range of areas of cooperation, including counterterrorism, counternarcotic, transnational crime, cybercrime, secure travel and trade, and fugitives.”

The framework for the dialogue was the May 2016 Memorandum of Understanding between the U.S. Department of Homeland Security and the Cuban Ministry of Interior. This MOU set the basis of cooperation in exchanging risk information for travelers, cargo or conveyances in international transit; the continuation of periodic, mutual, and reciprocal assessments regarding air, sea, and port security; and the coordination of transportation security, screening of cargo, travelers and baggage, and the design of secure, efficient inspection facilities at ports and airports, among other things.

The next month, June 2016,  the U.S. and Cuba met in Havana for their first Counterterrorism Technical Exchange. The State Department said, “Coordination and cooperation on counterterrorism has been one of several important topics discussed in law enforcement dialogues between the United States and Cuba. We welcome the opportunity to bring together technical experts to discuss this topic of common interest.” Afterwards, the Cuban Foreign Ministry said that the meeting was conducted with “respect and professionalism” and that “both parties agreed on the importance of progress in cooperation in this sphere and agreed to continue the meetings of technicians on the topic.”

During the last weeks of the Obama Administration in January 2017, the U.S. and Cuba signed the following four agreements:

  • Cuba Memorandum of Understanding on Law Enforcement “to cooperate in the fight against terrorism, drug trafficking, money laundering and other international criminal activities.”
  • Memorandum of Understanding to strengthen cooperation in the field of maritime and aeronautical search and rescue by enhancing effectiveness and efficiency in assisting persons in distress and to act in furtherance of obligations under international law.
  • U.S., Cuba and Mexico signed a treaty to set territorial limits in contested Gulf of Mexico waters. The treaty covers the Eastern Gap of the Gulf of Mexico, an area believed to be rich in oil and gas deposits. The three countries’ overlapping claims in the Eastern Gap had created what is known as a “Doughnut Hole.” Trilateral discussions begun in mid-2016 on the maritime territorial issue were concluded by the end of the year.
  • U.S. and Cuba memorandum of understanding to help prevent the introduction and spread of quarantine pests, animal and plant disease agents through the exchange of scientific information, best practices for the prevention and control of plagues and emerging diseases, collaborative scientific projects, including the use of technology, research and surveillance, and the holding of events on specific aspects of animal and plant health.

In addition, the Trump Administration for 2016, 2017, 2018, 2019 and 2020 did not designate Cuba as a “State Sponsor of Terrorism.”

U.S. Re-Designation of Cuba as “Sponsor,2021-22.[8] On January 11, 2021 (with only nine days left of the Trump Administration), U.S. Secretary of State Pompeo announced that Cuba was being re-designated as a “State Sponsor” to join Iran, North Korea and Syria. Here is what his statement said:

  • “The State Department has designated Cuba as a State Sponsor of Terrorism for repeatedly providing support for acts of international terrorism in granting safe harbor to terrorists.”
  • “The Trump Administration has been focused from the start on denying the Castro regime the resources it uses to oppress its people at home, and countering its malign interference in Venezuela and the rest of the Western Hemisphere.”
  • “With this action, we will once again hold Cuba’s government accountable and send a clear message: the Castro regime must end its support for international terrorism and subversion of U.S. justice.”
  • “For decades, the Cuban government has fed, housed, and provided medical care for murderers, bombmakers, and hijackers, while many Cubans go hungry, homeless, and without basic medicine.  Members of the National Liberation Army (ELN), a U.S.-designated Foreign Terrorist Organization, traveled to Havana to conduct peace talks with the Colombian government in 2017.  Citing peace negotiation protocols, Cuba has refused Colombia’s requests to extradite ten ELN leaders living in Havana after the group claimed responsibility for the January 2019 bombing of a Bogota police academy that killed 22 people and injured more than 87 others.”
  • “Cuba also harbors several U.S. fugitives from justice wanted on or convicted of charges of political violence, many of whom have resided in Cuba for decades.  For example, the Cuban regime has refused to return Joanne Chesimard, on the FBI’s Most Wanted Terrorists List for executing New Jersey State Trooper Werner Foerster in 1973; Ishmael LaBeet, convicted of killing eight people in the U.S. Virgin Islands in 1972; Charles Lee Hill, charged with killing New Mexico state policeman Robert Rosenbloom in 1971; and others.”
  • “Cuba returns to the SST list following its broken commitment to stop supporting terrorism as a condition of its removal by the previous administration in 2015.  On May 13, 2020, the State Department notified Congress that it had certified Cuba under Section 40A(a) of the Arms Export Control Act as “not cooperating fully” with U.S. counterterrorism efforts in 2019.”
  • “In addition to the support for international terrorism that is the basis for today’s action, the Cuban regime engages in a range of malign behavior across the region.  The Cuban intelligence and security apparatus has infiltrated Venezuela’s security and military forces, assisting Nicholas Maduro to maintain his stranglehold over his people while allowing terrorist organizations to operate.  The Cuban government’s support for FARC dissidents and the ELN continues beyond Cuba’s borders as well, and the regime’s support of Maduro has created a permissive environment for international terrorists to live and thrive within Venezuela.”
  • “Today’s designation subjects Cuba to sanctions that penalize persons and countries engaging in certain trade with Cuba, restricts U.S. foreign assistance, bans defense exports and sales, and imposes certain controls on exports of dual use items.”
  • “The United States will continue to support the Cuban people in their desire for a democratic government and respect for human rights, including freedom of religion, expression, and association.  Until these rights and freedoms are respected, we will continue to hold the regime accountable.”

So far in 2022, the U.S. has not taken any further action regarding this designation. However, at a July 21, 2022, press conference a journalist asked, “Is the administration’s position that Cuba still meets the legal requirements to be a state sponsor of terrorism?” The only response to that question came from  Ned Price, the Department’s spokesman, who said, “The fact pattern that led a previous administration to [so] designate Cuba . . . is in the public record.”

One year after the July 11, 2021 protests in Cuba, the United States recognizes the determination and courage of the Cuban people as they continue to fight for respect for human rights and persevere through repression during a historic year. We celebrate the Cuban people and commend their indomitable determination.

Conclusion

This blogger strongly favors a return to the Obama Administration’s pursuit of normalization of relations with Cuba as well as its rescinding the designation of Cuba as a “state sponsor of terrorism” and its support for abolishing the U.S. embargo. These opinions are further supported by the recent explosion of Cuba’s oil storage tanks and its being hit by Hurricane Ira as well as recognizing that Cuba is a much smaller country than the U.S. with much more limited military and security forces.

U.S. Commission on Unalienable Rights Issues Final Report 

As previously noted, on July 6, the U.S. Commission on Unalienable Rights issued its Draft Report.[1] The Final Report was issued 51 days later on August 26 as “a consensus document that was signed and approved unanimously by all 11 commissioners.”[2]

The latter was after the Commission had solicited and obtained a large number of comments, mainly negative, about the Draft Report.[3] But presumably after reviewing those comments, the Final Report was issued with “only [unidentified] small changes.”  The only public explanation of this decision was the following: “For the most part, the recent round of public comment restated perspectives and points shared before, during, and after the Commission’s five public meetings . . . and so already had been taken into account by the Commission.”

The most important criticisms of the Draft Report, which this blog shared, were its statement, “Foremost among the unalienable rights that government is established to secure, from the founders’ point of view, are property rights and religious liberty.” Also criticized were the draft Report’s downgrading of “positive rights,” i.e., rights that “owe their existence to custom, tradition, and to positive law, which is the law created by human beings,” and Secretary Pompeo’s objections to women’s reproductive rights (especially abortion) and to LGBTQ rights.

 Criticism of Draft Report

Here is a summary of some of the criticisms of the Draft Report from some of the respected international human rights non-profit organizations.

The Human Rights Watch submission stated, “With other organizations, we also remain concerned that the commission itself was not representative of the human rights community, did not take testimony from the full scope of the human rights community, and did not consider in its scope the range of issues the human rights framework aims to address. Freedom House pointed out that there already are mechanisms for interpreting human rights obligations of states at international and regional levels. The supposed gap the commission was created to fill is one that does not exist; therefore, the premise [for the Commission] is dubious and its work duplicative. . . . we continue to question its value and have increasing concerns about the repercussions that its work may have on the universality and efficacy of human rights protections and on the institutions designed to oversee compliance and implementation.” That submission also stated the following:

  • “The world has no shortage of actors who aim to weaken existing protections or call internationally recognized rights into question. Too often, that has included the United States. In recent years, the United States has moved sharply away from its longstanding if inconsistent role of seeking to advance human rights worldwide. Its decisions to withdraw from the United Nations Human Rights Council, stonewall UN human rights experts, make an extraordinary threat of vetoing a UN Security Council resolution on women, peace, and security because it mentioned survivors’ sexual and reproductive health and rights, and terminate funding for multilateral bodies like the United Nations Population Fund, UNESCO, and the World Health Organization that help advance rights to education and health worldwide have removed the United States as a key player on global human rights issues. The United States State Department’s creation of the Commission on Unalienable Rights purports to scrutinize well-grounded rights and obligations and reinterpret them in a way that deprivileges certain human rights but poses a risk to all rights. The United States should prioritize fulfilling its commitments, not redefining them to fulfill the wishes of a few.”
  • The Report “sets dangerous precedent that countries should decide which internationally recognized rights are or are not valid. . . . appeals to history and tradition are frequently abused by governments to justify their rejection of internationally recognized human rights norms. . . . Such an approach is likely to fragment and weaken the international human rights system, not strengthen or revitalize it. “
  • The Declaration of Independence and UDHR “are statements of principle, not obligation. Using these documents without also considering relevant human rights treaties and other sources of international law to guide human rights policy leads to a distorted understanding of the United States’ binding international obligations and commitments.”
  • The Report “spends little time on the adoption of the Constitution, the Bill of Rights, the Reconstruction Amendments, the enfranchisement of women, the strengthening of due process under the Warren Court, the passage of the Civil Rights Act, Fair Housing Act, and Americans With Disabilities Act, and jurisprudence recognizing the right to reproductive autonomy and the rights of lesbian, gay, bisexual, and transgender people. Similarly, it does little to acknowledge increased recognition over the years of economic and social rights as central to human rights discourse.”
  • U.S. “obligations under core human rights treaties coexist with other commitments the United States has made to respect, protect, and fulfill human rights, which are largely absent from the commission’s report.”
  • “The human rights project is facing challenges, but they are “not a matter of too many people seeking or claiming their rights. Instead, they are challenges that arise from autocratic or authoritarian governments that have denied fundamental rights, silenced vulnerable populations, and diminished the institutions and civil society groups that protect human rights from erosion.”
  • “The [draft] report erroneously suggests “that human rights that are inconsistent with domestic traditions are less meaningful or real than those the United States deems to favor.. . . [and] does not sufficiently acknowledge the maintenance, scrutiny, and accountability that upholding human rights requires.”
  • “Efforts to secure access to abortion are . . . about rights to life, to health, and to bodily autonomy. Similarly, efforts to secure the freedom to marry are . . . about the right to form a family and equal access to existing rights and protections without discrimination based on sexual orientation or gender identity.”

Two other such organizations offered similar comments. Freedom House: Trump Administration ignored or excused violations by Egypt, Turkey, Saudi Arabia, China, Russia, N. Korea and rebuffed pressure for racial justice in U.S. The draft report also rejects LGBT+ people, women and minorities. In addition, Freedom House rejects prioritization of rights and failure to recognize change views of rights over time (Pp 21-22). Human Rights First said proliferation of rights claims has not undermined legitimacy and credibility of human rights framework; treaties have not created uncertainties; rights hierarchies are wrong; abortion, affirmative action & same-sex marriage are valid rights; effort to preclude extension of new rights is wrong. It is retreat from human rights. (Pp 80-94).

Human Rights First’s Criticism of Final Report[4]

According to Kenneth Roth, the Executive Director of Human Rights First, Secretary Pompeo “has imposed his personal preferences [in the Final Report]while relying on arguments that pose a profound threat to all human rights as well.”

The Final Report “is a frontal assault on international human rights law. The report treats the Universal Declaration of Human Rights [UDHR], adopted in 1948 and drafted with the help of Eleanor Roosevelt, as the heyday of the human rights movement.” But this important document “is a non-binding political declaration. It has been followed over the years by a series of legally binding treaties, each with an independent expert committee elected by treaty members to interpret its language and monitor compliance. The commission disparages this legal elucidation as a ‘proliferation’ of rights, suggesting that there are now too many rights.”

Initially, the UDHR was codified in two legally binding covenants. One, on civil and political rights, contains provisions similar to the US Constitution, and the US government has ratified it. Another, on economic, social, and cultural rights, finds parallels in US law but not the US Constitution. The US government signed but never ratified it or fully embraced its rights.”

“After these foundational covenants, a handful of other treaties were adopted, spelling out, for instance, the meaning of the prohibition of torture or ways to protect womenracial minoritieschildren, and people with disabilities from discrimination. What Pompeo’s commission disparages as “proliferation” is in fact a process to ensure respect for the rights of people who traditionally have been marginalized or neglected.”

The Commission seemed most concerned with “interpretations of human rights law to protect reproductive freedom and the rights of LGBT people. In the case of LGBT rights, for example, the Human Rights Committee—the official body for interpreting the civil and political rights covenant—has found that the prohibition of discrimination on the basis of sex includes discrimination based on sexual orientation, just as the US Supreme Court recently found that sex discrimination includes discrimination against LGBT people.”

“The Pompeo commission’s discomfort with the Human Rights Committee is why it lionizes the non-binding [UDHR]. The declaration, as a statement of principles, has no accompanying interpretive body of law. That allows the US government to interpret its broad principles on its own, as if the covenants had never been adopted as its legally binding version.”

The Commission “seems to favor an a la carte approach to rights: The US government will pick the rights that it wants to observe, and others can do the same. That approach would be music to the ears of the world’s autocrats, and many will happily take the opportunity to trample on certain basic rights that Pompeo himself has rightly defended in places like Hong Kong.”

“To effectively abandon binding treaties for the Pompeo commission’s a la carte approach is to relegate human rights to the vagaries of government preferences. That’s not a system of human rights. It’s an excuse for repression, discrimination, and abuse.”

Conclusion

The Final Report also completely ignores the language of the U.S. Declaration of Independence. After reciting “life, liberty and the pursuit of happiness” as among “certain unalienable rights” that “ are endowed by their Creator,” the Declaration next states, “to secure these rights, governments are instituted among men, deriving their just powers from the consent of the governed.” In other words, governments will need to enact various kinds of statutes and other rules “to secure . . .life, liberty and the pursuit of happiness.”

U.S. Reduces Refugee Admissions to 15,000 for Fiscal 2021

On September 30, 2020, the U.S. State Department announced that President Trump will be submitting to Congress a report that he has determined that the U.S. will reduce its refugee admissions for Fiscal 2021 (October 1, 2020—September 30, 2021) to 15,000. [1]

It must be understood that the individuals who will be admitted to the U.S. under this quota already have been vetted and determined by a U.N. agency to have met the international and U.S. legal definition of “refugee:” someone who “owing to well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, is outside the country of his nationality and is unable, or owing to such fear, is unwilling to avail himself of the protection of that country; or who, not having a nationality and being outside the country of his former habitual residence as a result of such events, is unable or, owing to such fear, is unwilling to return to it.”[2]

The State Department attempted to reduce the adverse humanitarian consequences of this reduction by claiming, “The United States is committed to achieving the best humanitarian outcomes while advancing our foreign policy interests.  Given the dire situation of nearly 80 million displaced people around the world, the mission of American diplomacy is more important than ever.”

Other points of this attempt to reduce the adverse consequences of this decision are the following:

  • “In line with the U.S. National Security Strategy, we are working to assist refugees and other displaced people as close to their homes as possible until they can safely and voluntarily return to rebuild their lives, their communities, and their countries.  As part of our longstanding leadership in international humanitarian crisis response, the United States provided more than $9 billion in humanitarian assistance in Fiscal Year 2019 and nearly $70 billion in humanitarian assistance over the past decade.”
  • “The President’s proposal for refugee resettlement in Fiscal Year 2021 reflects the Administration’s continuing commitment to prioritize the safety and well-being of Americans, especially in light of the ongoing COVID-19 pandemic.  It accounts for the massive backlog in asylum cases – now more than 1.1 million individuals – by prioritizing those who are already in the country seeking humanitarian protection.  It also accounts for the arrival of refugees whose resettlement in the United States was delayed due to the COVID-19 pandemic.”
  • “Refugee resettlement is only one aspect of U.S. humanitarian-based immigration efforts.  Since 1980, America has welcomed almost 3.8 million refugees and asylees, and our country hosts hundreds of thousands more people under other humanitarian immigration categories.  This year’s proposed refugee resettlement program continues that legacy with specific allocations for people who have suffered or fear persecution on the basis of religion; for Iraqis whose assistance to the United States has put them in danger; for refugees from El Salvador, Guatemala, and Honduras; and for refugees from Hong Kong, Cuba, and Venezuela.” (Emphasis added.)

The State Department continued, The President’s proposal for refugee resettlement in Fiscal Year 2021 reflects the Administration’s continuing commitment to prioritize the safety and well-being of Americans, especially in light of the ongoing COVID-19 pandemic.  It accounts for the massive backlog in asylum cases – now more than 1.1 million individuals – by prioritizing those who are already in the country seeking humanitarian protection.  It also accounts for the arrival of refugees whose resettlement in the United States was delayed due to the COVID-19 pandemic.” (Emphasis added.)

According to the State Department, the U.S. anticipates receiving 285,000 asylum requests in the upcoming fiscal year. Such applications must meet the previously mentioned international and U.S. definition of “refugee.” However, the Department’s statement admits the U.S. has a  “massive backlog in asylum cases – now more than 1.1 million individuals.”

After criticisms of this decision emerged from various groups that are discussed below, Secretary of State Michael Pompeo from Rome tried to defend this decision. He said, “We continue to be the single greatest contributor to the relief of humanitarian crisis all around the world, and we will continue to do so. Certainly so long as President Donald Trump is in office, I can promise you this administration is deeply committed to that.”

Reactions [3]

This establishment of a 15,000 quota for refugees is a 3,000 reduction from last year’s quota of 18,000, which was the lowest since the introduction of the U.S. refugee program in 1980. In contrast, in Fiscal 2017, the last full year of the Obama Administration, the quota was 85,000 while the Trump Administration’s first two years (Fiscal 2018 and 2019) set the quotas at 53,000 and 30,000.

This further reduction is seen as another point of President Trump’s “anti-immigrant themes in the closing month of his re-election campaign.” It was done as the President was “unleashing a xenophobic tirade against one of the nation’s most prominent refugees, Representative Ilhan Oma, on Wednesday night at a rally in her home state of Minnesota.”

According to a Washington Post columnist, Catherine Rampell, this presidential decision “in one fell swoop, . . .managed  to betray his country’s humanitarian interests, its national security interests, its economic interests and even his own narrow political interests to boot. . . . The only constituency helped by Trump’s latest cruelty are the bigots and knee-jerk nationalists crafting his policies. For the rest of us, it represents an incalculable loss.”

As anticipated, refugee advocacy groups condemned this decision.

  • Krish O’Mara Vignarajah, CEO of Lutheran Immigration and Refugee Services, called the 15,000 cap an “abdication” of the nation’s humanitarian leadership role in the world. “This absurdly low number is based on nothing more than xenophobic political pandering, and it’s no surprise that this all-time low comes during an election year. We have shown as we have resettled thousands of refugees that there’s no evidence any of these arrivals have endangered Americans. Refugees come to this country after the most extreme vetting procedures, including medical-health checks.”
  • The Immigrant Law Center of Minnesota’s Executive Director, Veena Iyer, said, “Slashing refugee numbers and refusing admission to desperate people whose lives are in danger, especially those whose lives are in danger because of their service to U.S. soldiers and peacekeepers, is appalling. Instead of leading the world in protecting the persecuted, the actions of this administration are an abdication of leadership.”
  • Oxfam America’s Isra Chaker said, “This inexcusable new admissions ceiling is a mere fraction of the number of refugees the United States can and should resettle in a year. During the final year of the previous administration, the U.S. safely and successfully resettled an average of 15,000 refugees every two months.”

The same reaction came from faith-based groups.

  • Scott Arbeiter, president of World Relief, a global Christian aid agency, said Trump has reneged on his promise to protect persecuted Christians in the world. “Instead, we’ve seen the resettlement of refugees from countries known for persecution drop about 90% in some cases over the last four years. This is unconscionable.”
  • Rev. John L. McCullough, head of the Church World Service, which helps resettle refugees in the United States, “described the shrinking of refugee admissions as immoral and urged Congress to . . . recommend changes or seek to influence the decision through budgeting, but is largely powerless to alter the determination. . . .Our values as a nation and as people of faith demand that we take action when people’s lives are in danger.”
  • “The Council on American-Islamic Relations, the nation’s largest Muslim civil rights organization, denounced the chipping away of the refugee program as part of “the ongoing Trump administration effort to maintain systemic anti-Black racism and white supremacy.”
  • Isaiah, a Minnesota faith coalition stated, “We know that we are better off together and that all of us, no matter where we come from or how we pray, want our communities to thrive and our voices to be heard. Overcoming tremendous challenges, Somali Minnesotans bravely moved to Minnesota with their families and have helped make this state vibrant.”

Finally this Trump decision is impeached by recent praises of refugees for their contributions to the economy and culture of 29 states by their governors (both Democrat and Republican).

For example, Minnesota’s Governor Tim Walz’s letter to Secretary Pompeo stated, ““Minnesota has a strong moral tradition of welcoming those who seek refuge. Our state has always stepped forward to help those who are fleeing desperate situations and need a safe place to call home. Refugees strengthen our communities. Bringing new cultures and fresh perspectives, they contribute to the social fabric of our state. Opening businesses and supporting existing ones, they are critical to the success of our economy. Refugees are doctors and bus drivers. They are entrepreneurs and police officers. They are students and teachers. They are our neighbors.”

Secretary Pompeo’s Reactions to U.S. Commission on Unalienable Rights’ Report     

On July 16, Secretary of State Michael Pompeo gave an immediate response [1] to the Report of the U.S. Commission on Unalienable Rights that was summarized in a prior post.  Now we look at some of the significant points of Pompeo’s response.

Pompeo’s Introduction by Chair Glendon’s 

Chair Mary Ann Glendon said that the importance of the Commission’s work has been highlighted by several recent developments. First, Freedom House recently reported that “political and civil rights worldwide have declined this year for the 14th consecutive year and that half the world’s population – 4 billion people – currently live under autocratic or quasi-authoritarian regimes.”[3] Second, “some powerful countries are now openly challenging the basic premises of the great post-World War II human rights project, and by challenging the premises, they are undermining the already fragile international consensus behind the ideas that no nation should be immune from outside scrutiny of how it treats its own citizens and that every human being is entitled to certain fundamental rights simply by virtue of being human.” Third, “Another set of threats to human freedom and dignity are emerging in technological advances – artificial intelligence, biotechnology, data collection, sophisticated surveillance techniques.” Fourth, “millions of women and men are suffering arbitrary imprisonment, torture, and those women and men are looking to the United States as a beacon of hope and encouragement.”

Pompeo’s Speech

“These . . . unalienable rights . . . are a foundation upon which this country was built. They are central to who we are and to what we care about as Americans.”

“America’s founders didn’t invent the ‘unalienable rights,’ but stated very clearly in the Declaration of Independence that they are held as ‘self-evident’ that human beings were ‘created equal’  and ‘endowed by their Creator with certain unalienable rights… among [those] are Life, Liberty, and the Pursuit of Happiness.’”

The report emphasizes foremost among these rights are property rights and religious liberty. No one can enjoy the pursuit of happiness if you cannot own the fruits of your own labor, and no society – no society can retain its legitimacy or a virtuous character without religious freedom.” (Emphasis added.)

“Our founders knew that faith was also essential to nurture the private virtue of our citizens.”

George Washington, in “his now famous letter from 1790, . . .  to the Jews of Newport,. . .  proudly noted that the United States ‘gives to bigotry no sanction, to persecution no assistance.’” But “our founders also knew the fallen nature of mankind. [As] Alexander Hamilton wrote in Federalist 10: ‘Men are ambitious, vindictive, rapacious.’ So in their wisdom, they established a system that acknowledged our human failings, checked our worst instincts, and ensured that government wouldn’t trample on these unalienable rights.”

“Limited government structured into our documents protects these rights. As the [Commission] report states, ‘majorities are inclined to impair individual freedom, and public officials are prone to putting their private preferences and partisan ambitions ahead of the public interest.’”

In 1838, Abraham Lincoln, then a 28-year-old lawyer, gave a moving speech to the local young man’s lyceum in Springfield, Illinois, when he said, ‘We find ourselves under the government of a system of political institutions, conducing more essentially to the ends of civil and religious liberty, than any of which the history of former times tells us.’

“This is still true of America today. America is fundamentally good and has much to offer the world, because our founders recognized the existence of God-given, unalienable rights and designed a durable system to protect them.”

“The . . . societal upheavals that are currently roiling our nation . . .directly ties to our ability to put our founding principles at the core of what we do as Americans and as diplomats all across the world.”

[We must admit, however,] “that at our nation’s founding our country fell far short of securing the rights of all. The evil institution of slavery was our nation’s gravest departure from these founding principles. We expelled Native Americans from their ancestral lands. And our foreign policy, too, has not always comported with the idea of sovereignty embedded in the core of our founding.”

“But . . . the nation’s founding principles gave us a standard by which we could see the gravity of our failings and a political framework that gave us the tools to ultimately abolish slavery and enshrine into law equality without regard to race. . . . From Seneca Falls, to Brown vs. Board of Education, to the peaceful marches led by Dr. Martin Luther King Jr., Americans have always laid claims to their promised inheritance of unalienable rights.”

The New York Times’s 1619 Project – so named for the year that the first slaves were transported to America – wants you to believe that our country was founded for human bondage, that America’s institutions continue to reflect the country’s acceptance of slavery at our founding. . . [and] that Marxist ideology [correctly says] America is only the oppressors and the oppressed. [This 1619 Project] is a slander on our great people. Nothing could be further from the truth of our founding and the rights about which this report speaks.”  (Emphasis added.)

The Commission rejects these notions and “reminds us [of] a quote from Frederick Douglas, himself a freed slave, who saw the Constitution as a ‘glorious, liberty document.’”

“If we truly believe . . . that rights are unalienable, inviolate, enduring, indeed, universal, just as the founders did, then defending them ought to be the bedrock of our every diplomatic endeavor.”

“Our dedication to unalienable rights doesn’t mean we have the capacity to tackle all human rights violations everywhere and at all times. Indeed, our pursuit of justice may clash with hard political realities that thwart effective action.”

“Americans have not only unalienable rights, but also positive rights, rights granted by governments, courts, multilateral bodies. Many are worth defending in light of our founding; others aren’t.”

Prioritizing which rights to defend is also hard. [According to a research group, there are] 64 human rights-related agreements, encompassing 1,377 provisions, between the United Nations and the Council of Europe alone. That’s a lot of rights. And the proliferation of rights is part of the reason why this report is so important.” This report “has provided us the [following] essential questions to ask:

  • Are our foreign policy decisions rooted in our founding principles?
  • Are the decisions consistent with our constitutional norms and procedures?
  • Are they rooted in the universal principles of the Universal Declaration of Human Rights [UDHR]?
  • Does a new rights claim . . .represent a clear consensus across different traditions and across different cultures, as the Universal Declaration did, or is it merely a narrower partisan or ideological interest?”

The great and noble human rights project of the 20th century, [however.] is in crisis. Authoritarian regimes perpetrate gross human rights violations every day, all around the world. Too many human rights advocacy groups have traded proud principles for partisan politics. And we see multilateral human rights bodies failing us. The United Nations Human Rights Council does the bidding of dictators and averts its gaze from the worst human rights offenses of our times. [In addition,] international courts too have largely abandoned unalienable rights. The International Criminal Court is training its sights on Americans and Israelis, not the ayatollahs of the world. And the incurious media rarely examines any of these failings.”(Emphasis added.)

“The vital 20th century human rights project has come unmoored, and it needs a re-grounding. The Commission’s work marks an important contribution to America’s effort to address this human rights crisis, and it’s a good time to do so.”

[As the report says,] “we must cultivate the ‘seedbeds of human rights.’ Free and flourishing societies cannot be nurtured only by the hand of government. They must be nurtured through patriotic educators, present fathers and mothers, humble pastors, next-door neighbors, steady volunteers, honest businesspeople, and so many other faithful, quiet citizens.” (Emphasis added.)

We have the responsibility to educate and advocate. Our diplomatic posts all over the world have human rights officers working to promote American values. We can shine a light on abuses, and as we do when we issue our annual reports, we take stock of the world’s efforts on religious freedom, on human rights, and on human trafficking.” (Emphasis added.)

We too can empower the people of other nations to further their social and economic rights. Our USAID does this essential work, as does our W-GDP program, which helps women flourish as entrepreneurs. Women, sadly, suffer the most human rights abuses. We can help them do better.” (Emphasis added.)

“We can work productively too with other nations. We’ve done that. We’ve worked with 60-plus nations to help the Venezuelan people recover democracy from the Maduro dictatorship.”

We also “ have punitive tools too, such as sanctions that we’ve levied on human rights abusers in Iran and in Cuba, and a recent advisory that we put out about Xinjiang and companies doing business there. We want to make sure that no American business is knowingly benefiting from slave labor.” (Emphasis added.)

“But to do so effectively, we must insist on the rightness and the relevance of America’s founding principles. Surely, if America loses them, she loses her soul and our capacity to do good around the world.”

“I am confident that the American star will shine across the heavens, so long as we keep a proper understanding of unalienable rights at the center of our unending quest to secure freedom for our own people and all of mankind. The report that you worked on will ensure that we have a better chance to accomplish that.”

Glendon-Pompeo Conversation

Immediately after Pompeo’s speech, Chair Glendon and Pompeo had a brief conversation.  One of her questions was: “Why is human rights advocacy is such an important part of our national interest?”

Pompeo responded, “Our capacity to have influence around the world . . . stems from our confidence in ourselves and our deep commitment to the fact that this nation is exceptional, because we rallied around this idea of unalienable rights. [We have developed annual ministerial meetings to gather] religious leaders of all faiths from all around the world. It’s the largest gathering of religious leaders every year to talk about these set of rights and religious freedom. . . . Some two-thirds of the people in the world live in places that are extremely challenged with the absence of religious freedom and religious liberty, the simple chance to exercise their conscientious views on faith.” (Emphasis added.)

Yet Another Pompeo Speech

On July 17th (the very next day after the above speech], Pompeo and his wife were in West Des Moines, Iowa for a speech—”My Faith, My Work, My Country”[3]— at the Family Leader Summit.[4] Here a few things he said.

“We [at the State Department] have a responsibility to keep you all safe. We advocate too for American businesses abroad, and help create jobs in every state in the union. And we represent your principles. We’ve executed a foreign policy that American families in Des Moines, in Dubuque, and in Davenport can believe in. It’s a pro-national security foreign policy focused on America. It’s a pro-religious freedom foreign policy. And it’s a 100 percent pro-life foreign policy.” (Emphasis added.)

Later, he added, “America sets the tone for the rest of the world in this respect, and our administration has defended the rights of unborn like no other administration in history. Abortion quite simply isn’t a human right. It takes a human life. You all – you all know this. The Psalmist says in Psalm 139: ‘You knit me together in my mother’s womb.’ This is when life begins, full stop. So we’ve reinstated the Mexico City Policy, so that not a single dime of American taxpayer money will ever go to a foreign NGO that performs active abortions anywhere in the world. In the fall of last year, . . . Secretary Azar at Health and Human Services and I, we mobilized 20 countries to deliver a joint statement at the UN criticizing pro-abortion language in UN documents. This has not happened before. We said clearly that “there is no international right to an abortion.” (Emphasis added.)

He also had extensive negative comments about China and Iran and positive words about Israel.

U.S. Commission on Unalienable Rights’ Report

On July 7, 2019, the U.S. State Department launched its Commission on Unalienable Rights to conduct ”an informed review of the role of human rights in American foreign policy.” This study was to focus on “human rights grounded in our nation’s founding principles and the principles of the 1948 [United Nations] Universal Declaration of Human Rights.” The next day Secretary of State Michael Pompeo announced that the group’s chair would be Mary Ann Glendon, the Learned Hand Professor of Law at Harvard Law School, an expert on human rights, comparative law and political theory and former U.S. Ambassador to the Holy See, who would be aided by nine other eminent members.[1]

Over the next year the Commission held six public meetings with these ten distinguished speakers: (1) Michael W. McConnell, a Stanford University law professor and former federal appellate judge;  (2)  Wilfred M. McClay, a humanities professor at the University of Tennessee; (3) Cass Sunstein, a professor at Harvard Law School; (4) Orlando Patterson, a Professor of Sociology at Harvard University;  (5) Michael Abramowitz, the director of the Committee on Conscience at the U.S. Holocaust Memorial Museum; (6) Miles Yu, a Chinese-American and principal China policy and planning advisor to Secretary Pompeo; (7) Kenneth Roth, Executive Director of Human Rights Watch; (8) Diane Orentlicher, Professor of International Law at American University; (9) Martha Minow,  Harvard Law School professor and expert in human rights and advocacy for members of racial and religious minorities and for women, children, and persons with disabilities; and (10) Thor Halverssen, a Venezuelan-Norwegian businessman and human rights activist.[2]

On July 16, 2020, the Commission issued its 60-page report, which is subject to public comment through July 30 and which will be reviewed in this post. [3] Subsequent posts will examine Secretary Pompeo’s personal endorsement of that report and his conversation about the report with Chair Glendon as well as reactions from others outside the Commission.

The Report: Unalienable and Positive Rights

“The 17th century British subjects who settled, and built thriving communities along, the eastern seaboard of what they regarded as a new world brought with them a variety of traditions. . . . Among the traditions that formed the American spirit, three stand out. Protestant Christianity, widely practiced by the citizenry at the time, was infused with the beautiful Biblical teachings that every human being is imbued with dignity and bears responsibilities toward fellow human beings, because each is made in the image of God. The civic republican ideal, rooted in classical Rome, stressed that freedom and equality under law depend on an ethical citizenry that embraces the obligations of self-government. And classical liberalism put at the front and center of politics the moral premise that human beings are by nature free and equal, which strengthened the political conviction that legitimate government derives from the consent of the governed.”

Each of these “distinctive traditions that nourished the American spirit contributed to the core conviction that government’s primary responsibility was to secure unalienable rights — that is, rights inherent in all persons. The Declaration of Independence proclaims this core conviction:” ‘that all men are created equal, that they are endowed by their Creator, with certain unalienable rights, that among there are Life, :liberty, and the pursuit of happiness.”

“To say that a right, as the founders understood it, is unalienable is to signify that it is inseparable from our humanity, and thereby to distinguish it from other sorts of rights. The most fundamental distinction is between unalienable rights — sometimes referred to as natural rights in the founding era and today commonly called human rights — and positive rights. Unalienable rights are universal and nontransferable. They are pre-political in the sense that they are not created by persons or society but rather set standards for politics. They owe their existence not to the determinations of authorities or to the practices of different traditions but to the fundamental features of our humanity. . . . {S]uch rights are essential to the dignity and capacity for freedom that are woven into human nature.”

“In contrast, positive rights are created by, and can only exist in, civil society. Positive rights owe their existence to custom, tradition, and to positive law, which is the law created by human beings. Because custom, tradition, and positive law vary from country to country, so too do positive rights. In the same country, positive rights may evolve over centuries, may be legislated at a distinct moment, and may be revised or repealed.”

“To say that positive rights are not universal, however, is not to deny their importance, and to say that they are distinct from unalienable rights is not to deny that the two can be closely connected in political affairs. Unalienable rights provide a standard by which positive rights and positive law can be judged, while positive rights and positive law make the promise of unalienable rights concrete by giving expression to and instantiating unalienable rights.”

All of the above, in this blogger’s judgment, is eminently reasonable.

The Report: The Foremost Unalienable Rights

The Report, however, in this blogger’s opinion, is on shakier ground when it goes on to say, “Foremost among the unalienable rights that government is established to secure, from the founders’ point of view, are property rights and religious liberty. A political society that destroys the possibility of either loses its legitimacy.”

“For the founders,” the Report goes on to say, “property refers not only to physical goods and the fruit of one’s labor but also encompasses life, liberty, and the pursuit of happiness. They assumed, following philosopher John Locke, that the protection of property rights benefits all by increasing the incentive for producing goods and delivering services desired by others.’

‘The benefits of property rights, though, are not only pecuniary. Protection of property rights is also central to the effective exercise of positive rights and to the pursuit of happiness in family, community, and worship. Without the ability to maintain control over one’s labor, goods, land, home, and other material possessions, one can neither enjoy individual rights nor can society build a common life. Moreover, the choices we make about what and how to produce, exchange, distribute, and consume can be tightly bound up with the kinds of human beings we wish to become. Not least, the right of private property sustains a sphere generally off limits to government, a sphere in which individuals, their families, and the communities they form can pursue happiness in peace and prosperity.”

“The importance that the founders attached to private property only compounds the affront to unalienable rights involved at America’s founding in treating fellow human beings as property. It also explains why many abolitionists thought that owning property was a necessary element of emancipation: only by becoming property-owning citizens could former slaves exercise economic independence and so fully enjoy their unalienable rights.”

“Religious liberty enjoys similar primacy in the American political tradition — as an unalienable right, an enduring limit on state power, and a protector of seedbeds of civic virtues. In 1785, James Madison gave classic expression to its centrality in founding-era thinking in his ‘Memorial and Remonstrance Against Religious Assessments.’ Quoting the Virginia Declaration of Rights’ definition of religion, Madison wrote, ‘we hold it for a fundamental and undeniable truth, ‘that Religion or the duty which we owe to our Creator and the manner of discharging it, can be directed only by reason and conviction, not by force or violence.’ Freedom of conscience in matters of religion is unalienable “because the opinions of men, depending only on the evidence contemplated by their own minds cannot follow the dictates of other men.’”

The Report: The Universal Declaration of Human Rights (UDHR)[4]

The report endorsed the statement of Eleanor Roosevelt, a U.S. citizen and Chair of the commission that drafted the UDHR, when the U.N. General Assembly in 1948 was considering the adoption of this instrument: “[I]t is of primary importance, that we keep clearly in mind the basic character of the document. It is not a treaty; it is not an international agreement. It is not and does not purport to be a statement of law or of legal obligation. It is a Declaration of basic principles of human rights and freedoms, to serve as a common standard of achievement for all peoples of all nations” (emphasis added).

Moreover, the UDHR has ”overarching principles and structural dimensions” connected to the U.S. founding and foreign policy.

First, the UDHR “gave voice to the conscience of global humanity for the first time in history.”

Second, the UDHR “includes only those [rights] that were capable of attaining a near-universal consensus among the diverse nations represented at the UN . . . [and] were expressed in open-ended terms in order to achieve consensus and garner widespread support.”

Third, the UDHR “was written and understood as an integrated set of interlocking principles.”

Fourth, the UDHR “affirms that human dignity, freedom, equality, and community are indissolubly linked.” It makes “clear that human dignity is inherent: it pertains to human beings solely because they are human beings . . . and provides a moral standards for evaluating positive law.” Thus, “the idea of human dignity at the heart of the [UDHR}converges with the idea of ‘unalienable rights’ in the American political tradition.”

Fifth, the UDHR has the “capacity to accommodate a broadly diverse set of political, economic, cultural, religious, and legal traditions” and “can be concretely realized in different political systems . . . [allowing] significant latitude in their interpretation and application.”

The Report: Future U.S. Foreign Policy and Human Rights

  1. “U.S. Needs To Vigorously Champion Human Rights in Foreign Policy

The U.S., “ by virtue of the principles deeply inscribed in its constitutional system and its international commitments, must champion vigorously the vision that it and nearly every other nation pledged to support when they approved the[UDHR].. It is by fidelity to what is best in the nation that the United States can respond most effectively to the manifold demands of the moment. Each of the major traditions that merged in America’s founding — Biblical faith, civic republicanism, and the modern tradition of freedom — nourished the nation’s core convictions that government is properly rooted in the consent of the governed and that its first purpose is to secure the rights that all human beings share. These core convictions, and the traditions that nourish them, are a source of inspiration and strength. It is no exaggeration to say that, with people around the world counting on America to champion fundamental rights, this country’s energetic dedication to that task will have no small influence on the future of freedom.”

  1. “The Power of Example Is Enormous”

The U.S. should serve “as an example of a rights-respecting society where citizens live together under law amid the nation’s great religious, ethnic, and cultural heterogeneity.” The U.S. also needs “to recognize the gap between our principles and the imperfections of our politics and can demonstrate, as we ask of others, tangible efforts at improvements.” 

  1. “Human Rights Are Universal and Indivisible

The U.S. needs to criticize when rights in UDHR “are radically subordinated in the name of development or other social and economic objectives.”

  1. “Universality and Indivisibility of Human Rights Does Not Mean Uniformity in Bringing Them to Life”

The UDHR contemplates “some variation in emphasis, interpretation, and mode of implementation.”

  1. A Degree of Pluralism in Respecting Human Rights Does Not Imply Cultural Relativism

“The scope for diversity in bringing human rights to life is circumscribed by the duty to ‘promote and protect all human rights and fundamental freedoms,’ and by the . . . [requirement] that all rights must be exercised with due respect for the rights of others and that its rights may be subject to “such limitations as are determined by law solely for the purpose of securing due recognition and respect for the rights and freedoms of others and of meeting the just requirements of morality, public order and the general welfare in a democratic society.”

  1. Nation-States Have Some Leeway To Base Their Human Rights Policy on Their Own Distinctive National Traditions

Yet such policies must be “consistent with the overarching conviction affirmed in Article I of the UDHR that ‘All human beings are born free and equal in dignity and rights.’”

  1. Certain Distinctions Among [Human Rights] Are Inherent in the [UDHR] . . .,as Well as in the Positive Law of Human Rights

“U.S. foreign policy can and should consider which rights most accord with national principles and interests at any given time. Such judgments must take into consideration both the distinctive American contributions to the human rights project and also prudential judgments about current conditions, threats, and opportunities.”

However, “some international norms, like the prohibition on genocide, are so universal that they are recognized as norms of jus cogens — that is, principles of international law that no state can legitimately set aside. The application of certain human rights demands a high degree of uniformity of practice among nations, as in the prohibition of torture, while others allow for considerable variation in emphases.”

  1. Freedom, Democracy, and Human Rights Are Indissolubly Linked

This “invites a [U.S.] commitment to the promotion of individual freedom and democratic processes and institutions as central to the U.S. human rights agenda. By the same token, it counsels considerable deference to the decisions of democratic majorities in other countries, recognizing that self-governance may lead them to set their own distinctive priorities. The U.S. promotion of fundamental rights should always be sensitive to the outcomes of ordinary democratic politics and the legitimate exercise of national sovereignty, and wary of rights claims that seek to bypass democratic institutions and processes.”

  1. Social and Economic Rights Are Essential to a Comprehensive [U.S.] Foreign Policy

The U.S. was a major supporter of the indivisibility principle as well as the aspiration for “better standards of life in larger freedom” . . . in the UN Charter and the [UDHR] Preamble.” For the U.S.,  implementation of these rights were “left up to each nation.” A “minimum standard of living is essential to the effective exercise of civil and political rights.”

  1. New Claims of Rights Must Be Carefully Considered”

“The effort to shut down legitimate debate by recasting contestable policy preferences as fixed and unquestionable human rights imperatives promotes intolerance, impedes reconciliation, devalues core rights, and denies rights in the name of rights. In sum, the [U.S.] should be open to, but cautious in, endorsing new claims of human rights.”

  1. National Sovereignty Is Vital to Securing Human Rights”

The U.S. “should resist attempts at creating new rights through means that bypass democratic institutions and procedures, or that are inconsistent with the understandings on the basis of which the [U.S.] entered into international agreements. {The U.S. also] should respect the independence and sovereignty of nation-states to make their own moral and political decisions that affirm universal human rights within the limits set forth in the UDHR.”

  1. The Seedbeds of Human Rights Must Be Cultivated

“Respect for human rights must be cultivated, and the promotion of basic rights is only one element in building the kind of societies that promote human flourishing in all its dimensions. . . . The collective effort since 1948 to translate the UDHR’s broad principles of human rights into binding legal commitments through a network of treaties has achieved laudable results.”

As Eleanor Roosevelt said on the tenth anniversary of the UDHR, “Protection of human rights is a never-ending struggle, one that involves a nation’s sense of its own principles and purpose. . . . The surest protection of human freedom and dignity comes from the constitutions of free and democratic states undergirded by a tolerant, rights-respecting culture. As in the case of the United States’ distinctive rights tradition, the maintenance of the international human rights project will require attention to the ‘small places’ where the spirit of liberty is rooted, nurtured, and cultivated.”

U.S. Insulting Proclamation of May 20th as Cuba’s Independence Day

On May 20, President Trump and Secretary of State Pompeo stated that May 20 was Cuba’s Independence Day. Cuban officials immediately rejected that assertion.

Presidential Message on Cuban Independence Day, 2020[1]

“On Cuban Independence Day, we recognize the patriots who fought to liberate Cuba from its colonial oppression and build a society founded on freedom. We continue to stand with the Cuban people as they seek those fundamental rights, and we express our commitment to supporting them as they continue to fight for freedom and democracy.”

“The United States has historic ties to the Cuban people and remains in solidarity with the millions who have fled the oppression of Cuba’s tyrannical regime in search of a new life. Cuba’s people deserve a government that promotes individual liberties, basic human rights, and opportunities to prosper. The Cuban model represents failed socialism, and we will continue to ensure that Cuba does not export its repression anywhere else in the Western Hemisphere. That is why I took action early in my Administration to implement a strong policy toward Cuba that promotes respect for human rights, free markets, and a transition to democracy in Cuba. America will keep working with our allies and partners in the Western Hemisphere to bring stability, religious liberty, cooperation, and a freer future to the great people of Cuba.”

“Today, we celebrate the many contributions of Cuban Americans to our American story, and we pledge to continue working with them to secure a better tomorrow for Cuba.”

Later that same day Trump delivered a video message to Cuban-Americans. “We proudly stand with the people of Cuba. We’re with you. We’re fighting with you. We’re thinking with you. Cuban Americans, we’re extremely proud of you. And I am glad you are on my side.”

Secretary Pompeo’s Statement on Cuban Independence Day[2]

“On Cuban Independence Day, I extend my warm regards and best wishes to the people of Cuba.  The United States joins you in celebrating the anniversary of Cuba’s independence, 118 years ago today.  The struggle of the Cuban people continues.  Your democratic system was overthrown by a military dictator at the middle of the last century.  But the revolution your forefathers fought for your rights, freedoms, and prosperity was hijacked by a communist dictatorship that has inflicted the worst forms of abuse on the Cuban people for 61 years.”

“Both Americans and Cubans alike value our independence and we seek to provide a better, more prosperous future for families, in realization of our God-given rights and dignity as individuals.  We salute the brave Cubans who carry on this struggle despite the threats and abuses of the Castro regime:  human rights defenders like José Daniel Ferrer and the Ladies in White; and journalists and truth-tellers like Roberto Quiñones, who by shining light on conditions in Cuba prevent the regime from hiding the truth.  We salute those demanding the right to exercise their faith in peace, like Pastors Ayda Expósito Leyva and Ramón Rigal, who chose to provide their children with a faith-based home-school education but were imprisoned for doing so.  These brave individuals, and many more who are unjustly imprisoned for their beliefs, or who daily face threats and abuse for standing up for what is right, are the true heirs to José Martí.”

“The United States stands with the Cuban people as you struggle to achieve your vision of a Cuba that is free and more just.  The day when your dream of freedom becomes reality is decades overdue, but that day will come.”

Cuba’s Responses[3]

An immediate response came in Tweets from Cuba Foreign Minister Bruno Rodriguez. He said, “The US Secretary of State is lying. Cubans do not commemorate this date, only remembered by the anti-Cuban groups which, from South Florida and with the broad support of the White House, still maintain annexationist interests and domination over Cuba.”

This thought was echoed by Rodrigo Malmierca, the head of Cuban Foreign Trade and Investment: Pompeo’s statement towards the Cuban people was “historical and politicized manipulation.”

In response to a similar message by President Trump in 2017, the Cuban government stated, “what was born on the day [May 20, 1902] was a Yankee neo-colony, which lived on until [the revolution on] January 1, 1959.”

Historical Context

This dispute over the “true” date for Cuba’s independence has been going on since at least 1959. The U.S. continued insistence on May 20 as the correct date is driven by U.S. hostility towards Cuba ever since the military defeat of the Cuban government by Fidel Castro-led rebels on January 1, 1959 (except for the period of normalization of relations led by President Obama,  December 2014—January 2017). An examination of history is necessary to understand this conflict.

May 20, 1902[4]

On April 24 and 25, 1898, Spain and the U.S. declared war against each other after the explosion of the U.S. battleship Maine in Havana harbor. The U.S. Senate’s authorization of that declaration included the Teller Amendment, which disclaimed any “inclination or intention to exercise sovereignty, jurisdiction or control” of Cuba and the U.S. intention to “leave the government and control of the island to its people.” Thereafter the U.S. entered Cuba’s war of independence from Spain, which formally was ended on December 10, 1898 with the Treaty of Paris whereby Spain ceded Cuba (and Puerto Rico, Guam and the Philippines) to the U.S. Cuba was not a party to that treaty.

Thereafter, the U.S. assumed military control of Cuba. On May 20, 1902, the supposed date of Cuban independence arrived when the U.S. flag was lowered in Havana and the new Cuban flag was raised. This was after the U.S. adoption in early  1901 of the Platt Amendment, whose terms Cuba on December 25, 1901, reluctantly included in its constitution granting the U.S. the right to intervene in Cuba to preserves its independence and imposing other restrictions on Cuba.

These provisions of the Cuban constitution existed until 1934 when the U.S. and Cuba executed a treaty allowing Cuba to delete them from its constitution.

October 10, 1868[5]

This is Cuba’s real Independence Day (Dia de la Independencia) when Carlos Manuel de Céspedes, the “Father of the Homeland,” gave freedom to his slaves and started the first war of independence against the Spanish colonial power.

July 26, 1953 [6]

This is the Day of the National Revolution (Dia de la Rebeldia Nacional) to commemorate the day that the Cuban rebels started the Cuban revolution with an attack led by Fidel Castro on the Cuban Government’s Moncada Military Barracks in Santiago de Cuba. The rebels lost that battle, Fidel was captured,, tried, convicted, imprisoned and eventually exiled to Mexico, from which he successfully returned to Cuba in 1956 aboard the boat Granma and thereafter orchestrated the successful overthrow of the Batista regime on January 1, 1959.

July 26th, therefore, was chosen as the date for a speech in Matanzas, Cuba in 1991 by Nelson Mandela only a year-and-a half after his release from prison in South Africa.

This is the Triumph of the Revolution (Triunto de la Revolución) public holiday to commemorate the triumph of the revolution led by Fidel Castro.

Conclusion

Yes, on May 20, 1902, Cuba officially ceased to be a colony of Spain. But on that same date Cuba became a neo-colony of the U.S. or a territory under a de facto U.S. protectorate. It, therefore, is an insult for the U.S. to use grandiose language to proclaim that date as Cuba’s independence day.The U.S. should stop doing so.

Texas Refuses To Consent to Refugee Resettlement

On January 10, Governor Greg Abbott (Rep.) sent a letter to Secretary Pompeo announcing his state’s refusal to consent to refugee resettlement. His letter said, ““Texas has carried more than its share in assisting the refugee resettlement process and appreciates that other states are available to help with these efforts. Since FY2010, more refugees have been received in Texas than in any other state. In fact, over that decade, roughly 10% of all refugees resettled in the United States have been placed in Texas.” He added, “Texas has been left by Congress to deal with disproportionate migration issues resulting from a broken federal immigration system.” He also cited the recent surge in migrants crossing the southwestern border last year as a reason for turning away refugees now. [1]

This refusal was contrary to the desires of major cities in the state—San Antonio, Dallas and Houston. The Mayor of Houston reacted with these words: “Regardless of where someone is from, who they are or what they believe, there is a home for them in Houston. Our welcoming spirit has led to our city becoming the national leader in refugee resettlement.” Negative words also came from these groups:

  • Lutheran Immigration and Refugee Service: “This is a deeply disappointing decision – although not surprising given Texas’ previous but unsuccessful opposition to refugee resettlement a few years ago. This is precisely why we filed a lawsuit against President Trump’s unlawful executive order, and we are confident that justice will be served — allowing children and families who have been waiting in desperation for years to be reunited with their family in Texas.” The Service added, “Nearly 2,500 refugees started to rebuild their lives in Texas last year, many of whom have additional family members in harm’s way seeking to join them in safety. These families have been torn apart by violence, war and persecution — but we never thought they would be needlessly separated by a U.S. state official.”
  • The International Rescue Committee: “In addition to making refugees’ lives harder, Texas now forfeits the opportunity for a growing business community that depends on refugees. It forfeits the cultural contributions, the growth, and ingenuity the state has come to enjoy through resettling refugees.”

The Texas decision leaves 40 consenting states (22 Democratic and 18 Republican) and 9 publicly not committed (7 Republican (Alabama, Florida, Georgia, Mississippi, South Carolina, Vermont and Wyoming) and two Democratic (Hawaii and New York)). Remember that failure to respond before the deadline, which might be January 21, 2020, will be treated as a refusal to consent.[2]

Five More States Have Consented to Refugee Resettlement     

A website from the Lutheran Immigration and Refugee Service has a list of 39 states that so far have consented to refugee resettlement with hyperlinks to the relevant documents. This list includes five states that have so consented (three Republican governors (Idaho, Maryland and Missouri) and two Democratic governors (California and Nevada)) in addition to the 34 previously identified in a post to this blog:  [1]

Justifications for Consents

These five additional states provided justifications for their consent. Here they are along with those from four of the previously identified 34 states (Arkansas, Indiana, Tennessee and West Virginia).

Arkansas.[2] Governor Asa Hutchinson on December 23 issued a consent letter to Secretary Pompeo, stating, “Arkansans have a history of welcoming refugees. While we fully support control of our borders and oppose illegal immigration, we also value the contribution of immigrants and understand the importance of America continuing to be a welcoming nation for those truly seeking refuge and following the legal path to our land. Immigrants bring energy, a thirst for freedom, and a desire to pursue the American dream. This is America’s strength and part of our future.”

California.[3] In a December 20, 2019, letter to Secretary Pompeo, Governor Gavin Newsom said, “the State of California is proud to be a welcoming state, and is committed to the continued resettlement of refugees in partnership with local jurisdictions and community partners. California recognizes its resettlement programs and services are an indispensable lifeline to refugees who have been forcibly dispatched from their home countries and cannot rebuild their lives where they first fled.”

Governor Newsom added, “The refugee resettlement program has a long history in California, spanning over 40 years and successfully resettling over 700,000 men, women and children. During these four decades, refugees continuously have contributed to the enrichment of our economy, culture, and society. California’s communities have flourished because of their diversity and ongoing ability to embrace refugees and immigrant families. . . . Refugees deserve our support and we will keep our doors open to these families and people to sustain  an inclusive California for all.”

Idaho.[4]  Governor Brad Little’s December 30, 2019 letter to Secretary of State Michael Pompeo merely said the state consented after all of its counties had consented.

Indiana.[5] Governor Eric Holcomb’s December 13th letter to to Cole Vega (Executive Director (Exodus Refugee Immigration, Inc.), “Indiana is a destination of certainty, stability and opportunity. As a state, we are on course to become the absolute best place in America to grow as an individual, a family, a business and as a community. Our long tradition of welcoming and helping to resettle refugees with support from our federal partners, shows the world the compassion of Hoosiers and our willingness to give others the ability to grow and prosper in the great state of Indiana.”

“In just the last five years, State based non-profit agencies have resettled thousands of deserving, qualified individuals in the Hoosier state, who have been fully and carefully vetted by relevant federal government agencies. These are . . . individuals who have gone through all the proper channels, were persecuted for their religious or political beliefs in their homeland and have sought and been granted refugee status in our nation of immigrants.”

Maryland.[6] On December 30, Governor Larry Hogan’s consent letter to Secretary Pompeo said, “Providing more flexibility to states has been one of my key priorities, and I appreciate the administration’s renewed emphasis on state and local engagement in determining policies that affect our security and resources.”

Governor Hogan also stated, “With proper diligence and in conjunction with the continued cooperation of local jurisdictions in our state, Maryland consents to receive legally vetted resettlement refugees in Fiscal Year 2020, per the terms of the Executive Order. We are willing to accept refugees who the federal government has determined are properly and legally seeking refugee status and have been adequately vetted. This, as you know, is different from any kind of ‘sanctuary’ status for those in the United States unlawfully. Maryland’s approach is consistent with both our laws and our values.”

A local newspaper article about this decision stated that Maryland had accepted nearly 10,000 refugees since 2016.

Missouri.[7] Governor Michael Parson’s December 30, 2019 letter to Secretary Pompeo said, “Missouri has a long and rich history of immigration, dating back to America’s earliest explorers, fur traders, and missionaries. Today, Missouri’s population includes thousands of former refugees who have become vital members of our communities. Since 2002, nearly 18,000 refugees from 45 countries have resettled in Missouri.”

The Governor continued, “In Missouri, state organizations and faith-based groups work tirelessly to support refugee resettlement. Currently, there are five agencies that integrate refugees in St. Louis, Kansas City, Columbia, and Springfield, where they have helped strengthen local economies, especially through entrepreneurship. These groups do an excellent job of transitioning newly settled populations, ensuring they are educated, trained, and prepared to assimilate into their new community. In fact, St. Louis boasts one of the largest Bosnian populations outside that country itself. Community volunteers, especially faith-based partners, continue to be an integral part of such local resettlement efforts.”

The Governor concluded, “We will continue to work hard to ensure refugees become a thriving part of our communities, and I am confident this demonstration of compassion will mark the first step in these immigrants becoming  patriotic and productive fellow Americans.”

 Nevada.[8] Governor Steve Sisolak in a December 18, 2019 letter to Secretary Pompeo stated, “Nevada is proud of our long-standing tradition of resettling refugees. Since the 1970s, Republican and Democratic Governors from Nevada have welcomed these individuals into our state with open arms. Earlier this year, I had the opportunity to meet with dozens of refugee children in the State Capitol. . . . While their unimaginable experiences of suffering and hardship may have originated in different areas around the globe, the personal stories they shared were defined by courage, hope and resilience. These stories embody the dignity and values of this country. Such is the story of Nevada Assemblyman Alexander Assefa. Mr. Assefa came to the U.S. as a refugee with similar hopes and dreams. After a lot of hard work, he became a pilot, a small business owner, and he now proudly serves in the Nevada State Legislature. Above all, he is a proud American.”

“We need not forget that refugees fled for their lives after enduring persecution, war and dire humanitarian conditions. Many waited several years in remote places, while undergoing extensive background checks and security clearances, for the opportunity to start a new life in the United States. Once here, refugees become productive, responsible and self-sufficient members of society and account for an important part of our workforce and that drives our economic engine.”

Tennessee.[9] After a perfunctory consent letter to Secretary Pompeo, Governor Bill Lee was more fulsome in a December 18 letter to the state’s Lieutenant Governor and Speaker of its House of Representatives that stated, “Resettlement will be facilitated by the Trump Administration and non-profit organizations with extensive experience in this area. The refugee population in Tennessee is small, and I believe our consent to cooperate and consult with the Trump Administration to provide a safe harbor for those who are fleeing religious persecution and violent conflict is the right decision. The United States and Tennessee have always been, since the very founding of our nation, a shining beacon of freedom and opportunity for the persecuted and oppressed, and particularly those suffering religious persecution. My commitment to these ideals is based on my faith, personally visiting refugee camps on multiple continents, and my years of experience ministering to refugees here in Tennessee.”

West Virginia.[10]  Governor Jim Justice’s December 20, 2019 letter to Secretary Pompeo, said, in part, “West Virginia has had great success with our refugee resettlement agency, which has been in operation since 1978. Refugees who have resettled here have become productive citizens and are welcomed into our West Virginia family.”

Conclusion

Now we wait to learn whether the other 11 states will also consent to such resettlements. They are nine states with Republican governors (Alabama, Alaska, Florida, Georgia, Mississippi, South Carolina, Texas, Vermont [11] and Wyoming) and two states with Democratic governors (Hawaii and New York). The following  colored map on the Lutheran Immigration and Refugee Service’s website showing the consenting states in green and the 11 remaining states in gray emphasizes that the most of the remaining states are in the Deep South.

 

This blogger believes it safe to assume that the three remaining Democratic  governors will consent and that it is more problematical whether the eight remaining Republican governors, primarily from the Deep South, will do so.

In the meantime those of us who support refugees should celebrate and congratulate those states that have consented and shared the many contributions to their states by previously resettled refugees.

U.S. State and Local Governments’ Justifications for Consenting to Resettlement of Refugees

A prior post gave the most current list of 34 states (19 Democrat and 15 Republican) that have consented to refugee resettlement. Now we look at the justifications for consent provided by some of those states.[1]

Praise for Refugees

Although perhaps unanticipated by the Trump Administration, many states that have consented to resettlement of refugees, including some headed by Republican governors, also have reminded all Americans of our national and individual states’ histories of welcoming refugees and other immigrants and of the contributions these individuals have made to our life, culture and economies.

Arizona. The state’s Republican Governor Douglas A. Ducey said, “ Throughout our nation’s history, the United States has been a refuge for individuals fleeing religious and political persecution in their homeland, and Arizona has historically been one of the most welcoming states in terms of the number of refugees resettled here. Refugees arriving in the United States have been vetted and approved by the appropriate national security agencies and Department of State and have been granted legal entry to make a new home in the land of the free.”

Colorado. In a December 16, 2019, letter, Democrat Governor Jared Polis said, “Colorado will continue to assist and resettle more refugees in our communities as long as people around the world are displaced from their home countries.”

“Since 1980, Colorado has welcomed individuals and families fleeing persecution, war, and violence from all over the world through the United States Refugee Admissions Program. Having a robust refugee program ensures that we are upholding our American values of humanitarianism, freedom, and opportunity. Not only is investing in refugees the compassionate and humane thing to do, refugees contribute to our economy in ways that benefit all Coloradans. For every dollar Colorado invests in refugees, we receive a $1.23 return on investment in tax revenue, and four new Colorado jobs are created for every refugee who is resettled in our State.”

Connecticut. Its Democrat Governor Ned Lamont said, “It is a bedrock principle of the United States of America that we welcome to our shores those fleeing tyranny, persecution and violence. As you well know, prior to being admitted to the United States, a refugee must undergo a rigorous vetting process. And we know from our own experience here in Connecticut that refugees enrich the communities that offer them shelter- socially, culturally, and economically. In addition, many people are resettled in our country as part of the Special Immigrant Visa (SIV) program, because they have put their lives and safety, and that of their families, at risk to help ensure the success and safety of our military service members in Afghanistan and Iraq. Connecticut is proud to do its part to honor our country’s commitment to them. The policy of the Trump Administration over several years to cut dramatically the number of refugees allowed to resettle in the United States is antithetical to our heritage and our values.”

Delaware. Democrat Governor John C. Carney had these words: “Our country has historically been a refuge of safe harbor for those fleeing war-torn countries, violence, and political persecution. We should continue to stand as a beacon of hope and freedom for people around the world. In that spirit, as Delawareans, we are proud to do our part, and continue to accept the resettlement of refugees.”

Illinois. Democrat Governor JB Pritzker said, “Since 1975, the State of Illinois has welcomed and resettled more than 130,000 refugees from more than 86 countries. In recent years, 1,000 to 3,000 refugees, those seeking asylum, and victims of human trafficking arrived in Illinois annually. Refugees have successfully rebuilt their lives and made positive social and economic contributions to Illinois. They have helped revitalize neighborhoods and added to the cultural vitality of our state and communities. As survivors of persecution, refugees embody the importance of human rights, democracy, and freedom. Refugees’ resilience in the face of hardship inspires courage, hope, and perseverance. And refugees’ countless contributions undoubtedly make our states and nation stronger.”

Kansas. Democrat Governor Laura Kelly offered the following: “Kansas has a long and proud history of welcoming the world’s refugees to our state. Refugees are not simply looking for a better home, they are fleeing some of the most horrific violence, war, famine, religious and cultural persecution of our time. Our country and our state can provide the security they need for a safer place to call home. The citizens of Kansas have shown time and again a strong commitment to welcoming refugees into communities statewide.”  She also said, “Refugees come to our country and state looking for a better place to live. Our country and our state benefit as they also make positive contributions in significant ways. They contribute to our economy, workforce and the cultural fabric of our state and nation.”

Maine. On December 16, 2019, the Democrat Governor of Maine expressed the following: “For more than forty years, and under the leadership of seven Democratic, Republican and Independent governors, Maine has participated in the federal refugee resettlement program. Over the course of those decades we have welcomed nearly 10,000 people from more than 30 countries – people who have resettled in Maine with the hope of finding peace, safety and work for themselves and their families.”

“Maine has a workforce shortage, projected to grow worse over the next decade, creating serious challenges for businesses seeking to hire qualified workers in every industry and in every sector of our economy. Our state welcomes refugees who have skills, education and ability, a proven work ethic and tremendous drive. It is the right thing to do, and it is critical to the strength of our economy and our future success as a state.”

Massachusetts. The Republican Governor of Massachusetts Charles D. Baker offered the following words: “ Massachusetts is committed to continuing to serve as a source of hope and opportunity, welcoming those seeking refuge with open arms and ensuring that newcomers feel safe, valued and supported as they settle into a new country and integrate into new communities.”

“The United States has a proud and noble tradition of serving as a country of refuge for those most vulnerable in the world. The Commonwealth welcomed 516 refugees last year, from 30 countries, and has welcomed 14,282 refugees over the past decade, from 59 countries. Throughout history, many of the refugees our Country admitted became distinguished scientists, government leaders, entrepreneurs, cultural icons, and public servants. We have much to gain in providing refuge to those in need. Foreign born employees provide significant support to our economy and make up a critical part of the health and human services sector workforce.”

Michigan. Democrat Governor Gretchen Whitmer had the following words: “Michigan has a rich history of welcoming refugees and other immigrants to our state. I am committed to ensuring that we remain a leader in responding to the needs of globally displaced families and individuals. We recognize the value of being a welcoming state, and the contribution of refugees to the fabric of our communities. Refugees enhance our state socially, culturally, and economically.”[2]

Minnesota. Democrat Governor Tim Walz put it this way, “Minnesota has a strong moral tradition of welcoming those who seek refuge. Our state has always stepped forward to help those who are fleeing desperate situations and need a safe place to call home. In keeping with this proud history, I offer my consent to continue refugee resettlement in the State of Minnesota.” He added, “ Refugees strengthen our communities. Bringing new cultures and fresh perspectives, they contribute to the social fabric of our state. Opening businesses and supporting existing ones, they are critical to the success of our economy. Refugees are doctors and bus drivers. They are entrepreneurs and police officers. They are students and teachers. They are our neighbors.”

New Jersey. Democrat Governor Philip D. Murphy had the following lengthy rationale for consenting:

  • “New Jersey will continue to welcome refugees anxiously fleeing harm and seeking safety. It is not only the right response; it is the American response.”[3] He continued, “We believe that America must remain a beacon of hope in the world, and we know that opening its doors to those facing danger and oppression is who we are as a nation. We are disheartened by recent attempts to undercut our commitment to freedom and opportunity by shrinking the numbers of who can seek comfort on our shores and by erecting new and significant barriers for refugees desperately reaching for safety. The announcement that your Administration will continue dramatically cutting the number of refugees allowed to resettle in the United States by reducing admission in the coming year to 18,000 from 30,000 -which was already a drastic decline from the 111,000 ceiling just two years ago – is devastating not only for those seeking refuge from harm but for the United States’ standing in the world.”
  • “New Jersey will continue to welcome refugees anxiously fleeing harm and seeking safety. It is not only the right response; it is the American response.”
  • “We believe that America must remain a beacon of hope in the world, and we know that opening its doors to those facing danger and oppression is who we are as a nation. We are disheartened by recent attempts to undercut our commitment to freedom and opportunity by shrinking the numbers of who can seek comfort on our shores and by erecting new and significant barriers for refugees desperately reaching for safety. The announcement that your Administration will continue dramatically cutting the number of refugees allowed to resettle in the United States by reducing admission in the coming year to 18,000 from 30,000 -which was already a drastic decline from the 111,000 cei ling just two years ago – is devastating not only for those seeking refuge from harm but for the United States’ standing in the world.”
  • “Over two million of our residents are immigrants, including refugees, representing nearly 23 percent of New Jersey’s population. There is no doubt that refugees have contributed to the strength of our state and have enriched our communities economically, culturally and socially. Refugees who have made New Jersey their home have helped our state thrive by growing our workforce, starting businesses, contributing to local economies, and becoming valued friends and neighbors.”
  • “We took these actions because we recognize that new Americans are integral to our State’s culture and our economy. Immigrants and refugees in New Jersey include over 120,000 entrepreneurs, employ more than 389,000 people and contribute over $24.2 billion in federal, State, and local taxes. In fact, 43 percent of the State’s science, technology, engineering, and math-focused workforce are new Americans who play a significant part in maintaining the State’s role as a leading innovator in the STEM field. Supporting immigrant and refugee integration is a smart strategy for our State and our country.”
  • “We know that a strong and vibrant democracy like ours requires that we live out our values through our deeds. To do so, we must continue to hold true to who we are as Americans by helping those who come seeking refuge from violence and persecution around the world. My Administration looks forward to continuing to work together with cities and towns across our great State to welcome immigrants and refugees.”

New Mexico. Its Democrat Governor Michelle Lujan Grisham stated, “New Mexico has always welcomed immigrants of all types, including more than 2,500 refugees from 28 countries who have resettled in New Mexico since 2002, adding to the rich multicultural mix of which New Mexicans are so rightly proud.”[4] She also said, “Unlike other immigrants, refugees have been forcibly displaced from their homes, whether by war, famine, religious and cultural persecution or violence. They leave their home countries fearing for their lives, and they come to our shores and our borders often with nothing more than the clothes on their backs, desperate — not for a handout but for a chance to start over.” The New Mexico Governor concluded, “While refugees arrive needing our help, they are often quick to pay back the country and communities that welcome them. They get jobs and pay taxes. They open businesses. They contribute their cuisines and cultures, bringing us new forms of entertainment and understanding.”

North Carolina. Democrat Governor Roy Cooper offered the following words, “North Carolina was one of the first states to welcome refugees to the United States after the United States Refugee Act was signed into law in 1980. Our state has a strong network of community and faith-based groups which aid in resettlement of refugees who seek safety from persecution.”[5]

North Dakota. Republican Governor Doug Burgum said,” North Dakota has had success at integrating refugees who have become responsible citizens and productive members of the workforce.”

Oregon. Kate Brown, Democrat Governor of Oregon, told Secretary Pompeo that Oregon opposed the President’s recent Executive Order on “refugee resettlement, and ask that you return this year’s refugee admission number to previous annual levels. The values reflected in this Executive Order are not the values on which our country was built.”

“It is a sad day for a nation founded on the principle of welcoming ‘poor, tired, and huddled masses.’ Nobody chooses to be a refugee. Refugees are just like us. They have jobs and families. They are parents and friends, teachers and doctors, farmers and fishermen. Since 1975, Oregon has resettled 67,743 refugees. Refugees contribute every day to the strength of our economy, our communities, and our culture. About 70 percent of refugees find employment within the first few months of resettlement. They pay taxes, buy homes, and open businesses. Their search for freedom and a better future for themselves and their children embodies what it means to be an American.”

Pennsylvania. Democrat Governor Tom Wolf offered the following extensive comments:

  • “Pennsylvania has a rich history of opening its doors to those facing persecution and danger. William Penn founded our commonwealth on the principle of religious freedom, seeking to allow those in Europe to escape persecution.”
  • “It is vital that America retain its moral authority throughout the world. And that means that when vulnerable and displaced individuals seek refuge from violence and oppression elsewhere, we welcome them to find that refuge in America. This maintains our image as a beacon of hope and freedom, and shows the world that America is the antithesis of the places these individuals are fleeing.”
  • “For decades, refugees have made our communities better, and I am committed to continuing that tradition to the fullest extent of my ability. In communities from Allentown to Lancaster to Erie, and elsewhere, refugees are resettling, making a home, finding employment, starting businesses, paying taxes, and enriching their communities. Church World Service, based in Lancaster, has gained national attention for how it has brought refugees and communities together to find mutual understanding and build strong relationships despite differences. That, to me, is the best of America.”
  • “During past conflicts, America has accepted hundreds of thousands of refugees who were fleeing violence and persecution. [For example,] Jewish refugees came to Pennsylvania from Germany and other European countries to escape the Nazi occupation and religious persecution. . . . As millions of people in Eastern Europe, the Middle East, Asia, Latin America and Africa face violence, persecution, and death, we should continue to help those we can while taking care to protect our commonwealth and our country, just as we have done for hundreds of years. To reject refugees outright emboldens the message of those who seek to inspire hatred by saying that we, as Americans, do not have compassion or care for specific groups of people in the world facing persecution or worse.”
  • “I am dismayed that America is sharply reducing its commitment to extend a hand of hope and freedom to vulnerable families across the world. But I remain committed to ensure – to the fullest extent possible – that Pennsylvania continues our founding traditions of tolerance and acceptance.”

Texas. Although Texas is listed as consenting in the PMR website, there is no hyperlinked state consent letter and secondary sources say to date Texas Governor is noncommittal on the subject. Instead there is one from Judge Nelson W. Wolf, Bexar County, where San Antonio is located. The Judge said the following:

  • “By definition, refugees are individuals who have been forced to flee their home country due to persecution based on their race, religion, ethnicity, political opinion, or social group. Resettlement is the last resort for refugees who cannot return to their home country and cannot rebuild their lives where they first fled.”
  • “The United States is one of 27 resettlement countries, and has the most extensive refugee vetting in the world. Refugees undergo biometric screenings, medical checks, in-person interviews with specially trained officers from the Department of Homeland Security, and interagency checks involving DHS, the State Department, Department of Defense, FBI, and the National Counter Terrorism Center.”
  • “The USRAP [U.S. Refugee Admissions Program] is a prime example of a public-private partnership between the federal government, state and local governments, local non-profit organizations, and volunteers that provide refugees with the tools of self-reliance housing, community orientation, English-language classes, and job placement. Every day, community members in Bexar County, Texas are volunteering with resettlement offices to help refugees integrate and thrive.”
  • “Even before Congress enacted the Refugee Act of 1980, faith communities across the United States built what we know today as the USRAP, welcoming refugees from World War II, the Vietnam War, the Cold War, the Rwandan genocide, and the Syrian refugee crisis, just to name a few. In addition, faith communities are still deeply involved in refugee resettlement. This is part of our nation’s heritage and we are proud to welcome refugees.”
  • “Refugees are resilient, hard workers whose innovative skills have contributed greatly to our state. They have opened businesses, revitalized towns, and are productive members of our community. Multiple studies demonstrate that refugees are economic contributors and job creators.”

Utah. Republican Governor Gary R. Herbert offered these words in a letter to President Trump, “I encourage you to allow us to accept more international refugees in Utah. We have historically accepted and resettled more than 1,000 refugees each year from a variety of troubled regions of the world. Unfortunately, that number has dropped for the past two years and is on track to decrease more this year. We know the need has not decreased and are eager to see the number of admittances rise again.”

Governor Herbert went on. “Utah’s unique history informs our approach to refugees. Our state was founded by religious refugees fleeing persecution in the Eastern United States. Those experiences and hardships of our pioneer ancestors 170 years ago are still fresh in the minds of many Utahns. As a result we empathize deeply with individuals and groups who have been forced from their homes and we love giving them a new home and a new life.” He added, “And it turns out we do it quite well. Those refugees who resettle in Utah become integrated and accepted into our communities. They become productive employees and responsible citizens. They become contributors in our schools, churches and other civic institutions, even helping serve more recent refugees and thus generating a beautiful cycle of charity. This marvelous compassion is simply embedded into our state’ s culture.”

Virginia. Democrat Governor Ralph S. Northam said the following:

  • “Virginia has welcomed refugees who are fleeing war, persecution, or other dire circumstances. We know that no one chooses to abandon their home until conditions become so difficult that the unknown is preferable.”
  • “The United States has long presented itself as a haven, a place of stability and economic prosperity. We promote the ideals upon which this country was founded, of liberty and freedom. But lo uphold those ideals abroad, we must allow access to them here at home. We must practice what we preach.”
  • “Virginia helps refugees settle into new homes only in those localities that participate in the Virginia Community Capacity Initiative, which ensures that a community’ s elected officials, faith leaders, schools, and other stakeholders are committed to helping refugees build new homes and lives. We work with resettlement agencies that have deep ties to these communities. We have always been clear that successful resettlement only happens with community involvement.”
  • “Because of our proximity to Washington, D.C., we are a preferred location for many Special Immigrant Visa holders: Iraqi and Afghanistan refugees who provided services to the U.S. military in those countries, and whose lives and families are in danger because of that service.”
  • “In recent years, as the federal government has lowered the number of refugees accepted into the United States, Virginia’s refugee number has dropped. We have the capacity to accept and help more refugees than we currently have.”
  • “These are people who no longer have a home. History shows us that this could happen to any of us. We must all imagine ourselves in their shoes, and treat them as we would wish to be treated. If I were ever in such a position, I hope a friendly country would take me in and let me rebuild my life in peace and safety. I believe people of decency would share that hope. Virginia’s lights are on and our doors are open, and we welcome new Virginians to make their homes here.”

 Washington. Democrat Governor Jay Inslee had these words:

  • “[The] State of Washington wholeheartedly consents to welcoming and resettling refugees into our communities—a long and proud tradition that we intend to continue.”
  • “As the state that resettled the second highest number of refugees last year, we are honored to remain a place of safety and security for those fleeing persecution and violence. Since 1975, Washington has bought in nearly 150,000 refugees from 70 different countries, including Vietnam, Ukraine and the Democratic Republic of the Congo. Refugees contribute to all sectors of our economy—as teachers, service members, doctors, and more—while adding to our rich cultural landscape. They are an integral part of Washington’s past, present, and future.”
  • “Just last week, we celebrated the success of Dr. Anisa Ibrahim, a Washingtonian who resettled in our state after fleeing war-torn Somalia more than two decades ago. Only six years old when her family first arrived in the United States, Dr. Ibrahim later graduated from the University of Washington Medical School and now leads a pediatric clinic in Seattle—the same clinic that treated her when she and her siblings were children.”
  • “Her story is not unique. Throughout our state, children and families speak of similar circumstances, of having sacrificed everything to seek refuge in America from violence, starvation, and other horrors most of us will thankfully never experience. Many of these children are now leaders in our communities, bringing with them their unique perspectives on tragedy, perseverance, and triumph. Washington State is stronger and our communities are richer because of their important contributions.”
  • “given all of the benefits of a robust resettlement program, we should not cast aside our founding principles as a nation. Enshrined in the Statue of Liberty, the ‘Mother of Exiles,’ is our country’s commitment as a safe place for humanity’s most vulnerable. Lest we forget that, of the 26,000,000 refugees worldwide, more than half are children.”
  • “I remain troubled by the Administration’s deep cuts to refugee resettlement and disappointed that my call for a considerably higher number of refugees went unanswered. I hope you will recognize the success of our efforts in the coming year when your administration revisits the refugee cap for 2021.”

Wisconsin. Democrat  Governor Tony Evers told Secretary Pompeo, “Our state has a rich history of opening its doors to people of all backgrounds, experiences, and walks of life. Through the years, while the people seeking resettlement opportunity in Wisconsin have changed, their circumstances have not: they are people seeking a new life, they embrace American ideals, and they bring with them valuable skills and experience which benefit all of us.” He also said, “Following the end of World War II, Wisconsin welcomed its first refugees as defined by the United Nations 1951 Refugee Convention. Our state has since continued to offer opportunities for safety and a new life to those from around the world who are granted resettlement. Over the past two decades, Wisconsin has welcomed more than 16,000 refugees from countries around the world, including Laos, Vietnam, the former Yugoslavia, Somalia, and Iraq. Most recently, our state has welcomed people from Burma and the Democratic Republic of Congo.”

In addition, Evers said, “Refugees and immigrants are essential to Wisconsin’s economy, from manufacturing to education, and public service to agriculture and healthcare. At a time when we are seeing labor shortages across our state, it is irresponsible for the administration to place obstacles in the path of talented and hard-working folks seeking refuge and a better life.” Moreover, “our refugees are a critically important part of our families, our communities, and our culture—they are part of the fabric of our state. Wisconsin’s refugee population is resilient and determined—they want to help themselves and their family, they want to continue working toward their dreams of living safely and freely, and they are eager to give back to the communities who welcome them. These contributions and our diversity and our differences make us and our state stronger, not weaker.”

Other Evidence of Positive Impact of Refugees on U.S. Economy

There are at least two independent studies of the economic impact of refugees on the U.S. economy: the New American Economy’s report From Struggle to Resilience, the Economic Impact of Refugees in America (June 2017) and the National Bureau of Economic Research’s report The Economic and Social Outcomes of Refugees in the U.S. (June 2017), https://www.nber.org/papers/w23498

They have documented the following:

  • Refugees pay $21,000 more in taxes than they receive in benefits on average in their first 20 years in the U.S.
    • Refugee rates of entrepreneurship (15%) exceed other immigrants (11.5%) as well as U.S. born (9%).
    • Refugees become citizens at a higher rate than non-refugee immigrants. In 2015, 84% of eligible refugees were naturalized citizens as compared to 51% of other immigrants.
    • Refugee children do as well as U.S.-born children on measures of education attainment.
    • Over 77% of refugees are of working age as compared to 49.7% of the U.S.-born population, helping to meet U.S. labor force needs.

 Conclusion

All of the above points need to be widely publicized to promote wider public support for refugee resettlement.

U.S. Senators Oppose U.S. Reduction in Refugee Admissions for Fiscal 2020 

As reported in a prior post. President Trump has reduced the number of refugee admissions to the U.S. for Fiscal 2020 (October 1, 2019 through September 30, 2020) to 18,000.

Now a group of 10 Democratic U.S. senators have voiced opposition to that reduction. They are Senators Amy Klobuchar (MN), Cory Booker (NJ) and Kamala Harris (CA)—all of whom are candidates for the Democratic presidential nomination in 2020—plus Senators Richard Blumenthal (CT), Christopher Coons (DE), Richard Durbin (IL), Dianne Feinstein (CA), Mazie Hirono (HI), Patrick Leahy (VT) and Sheldon Whitehouse (RI).[1]

First, they say the new quota “could effectively—and perhaps intentionally—damage our long-term capacity to resettle refugees” in the U.S. The new quota “could effectively end” the U.S. Refugee Admissions Program by “starving the infrastructure built by resettlement agencies” that helps “refugees integrate into U..S. communities.” Already because of previous reductions in this quota by the Trump Administration, “approximately 100 offices operated by “ such agencies (as of April 2019) have closed.

Second, “the administration’s allocation of refugee admissions among particular categories of individuals could render it impossible to meet even the depressed cap of 18,000 refugees.” One example is the 4,000 for Iraqis, where because of lengthy U.S. security checks very few already are being admitted. Another example is the 7,500 allocated for others appears to exclude individuals referred by the U.N.

Third, another threat to the continued operation of refugee resettlement is  the President’s executive order’s stating “that refugees may only be resettled ‘in those jurisdictions in which both the State and local governments have consented to receive refugees. . . . This requirement undoubtedly cause disruptions and disputes in the refugee settlement process—which, incidentally, already includes a consultation process with state and local officials. Moreover, permitting state and local jurisdictions to drive refugee policy subverts over a century of binding Supreme court precedent . . . that immigration policy . . . is uniquely within the purview of the federal government.”

They concluded, “We are facing the most significant displacement and refugee crisis in modern history. Reaffirming our historic role as the world’s humanitarian leader in this moment is not just about promoting our values. It is about protecting our security interests.”

The senators, therefore, requested a briefing about the new, lower quota. in their joint letter to Secretary of State Michael Pompeo and Acting Secretary of Homeland Security Kevin McAleenan.
