U.S.-Cuba Skirmishes at the Summit of the Americas

The confrontation of Presidents Donald Trump and Raúl Castro at the Summit of the Americas in Peru, as anticipated in a prior post, did not happen. Each of them cancelled his trip to the Summit. Instead Cuba sent its Foreign Minister, Bruno Rodriguez, while the U.S. sent Vice President Mike Pence, and the two of them exchanged verbal insults. The Secretary of the Organization of American States (OAS), Luis Almagro, also leveled criticism at Cuba.

OAS Secretary General[1]

On April 13, the OAS Secretary said the governments at the Summit “cannot allow the Cuban people to continue to be oppressed by an infamous dictatorship, a dictatorship that carries the weight of decades of human rights violations … tortures and executions. We have to be faithful to fundamental ethical values. Indifference in the face of dictatorship is to break the fundamental ethical values of policy.”

Cuba since 1962 has been suspended from the OAS. Nevertheless, “the resolutions of the OAS still apply to Cuba because it is still part of the Inter-American system. A suspension does not spare it from having to meet its responsibilities. That’s why we demand democracy for Cuba and the application of the Inter American Democratic Charter.”

The Secretary General also urged those at the Summit to “continue to put pressure on the regime. Let’s not recognize the [Cuban] rules for succession that the dictatorship wants to impose on its people.” This was an endorsement of the call earlier in the week by about 30 former heads of state and government from Spain and Latin America who urged the governments at the Lima summit to refuse to recognize the new Cuba government that is scheduled to be appointed April 18 or 19.

Almagro also condemned the Cuban delegation in Lima for an outburst of screams and slogans on Thursday that forced him and civil society activists to move a meeting to a closed-off hall. The Cuban delegates shouted “liar” at Almagro and “down with the worms” at the Cuban opposition activists in the room. “Today we had a very clear example of the levels of intolerance and how they want to silence the voice of dissidents in Cuba,” said the OAS secretary general. “They brought intolerance to our system, brought the voice of hatred, the voice that certainly tries to drown other voices. They have tried to dismantle our own democracy, the functioning of the Summit of the Americas. And that we cannot allow,” Almagro said. “And we cannot allow that in Cuba. It would not be ethical.”

Foreign Minster Rodriguez[2]

 On April 14, Cuba Foreign Minister Rodríguez addressed the Summit. “Our America, . . ., united by a common destiny in the search for its second and definitive independence, continues being sacked, intervened and vilified by the North American imperialism that invokes the Monroe Doctrine[3] for exercise of domination and hegemony over our peoples.”

“It is a story of wars of conquest, dispossession of territories, invasions and military occupations, coups d’état and imposition of bloody dictatorships that assassinated, disappeared and tortured in the name of freedom; of rapacious plundering of our resources.

Today there is the danger of a return to the use of force, the indiscriminate imposition of unilateral coercive measures and bloody military coups.”

He continued, “Our America, with its cultures and history, the territory, the population and its resources can develop and contribute to the balance of the world, but it is the region with the most unequal distribution of income on the planet.”

The richest 10 percent amass 71 percent of the wealth and, in two years, one percent of the population would have more than the remaining 99 percent. It lacks equitable access to education, health, employment, sanitation, electricity and drinking water.”

“We will only advance through regional integration and the development of unity within the diversity that led to the creation of CELAC [Community of Latin American and Caribbean States].”

“Recent events show that the OAS and its hysterical Secretary General are instruments of the United States.”

“Now, the objective is to reestablish imperialist domination, destroy national sovereignties with unconventional interventions, overthrow popular governments, reverse social conquests and restore, on a continental scale, wild neoliberalism. For this, the fight against corruption is used as a political weapon; prosecutors and judges act as ‘political parties’ and voters are prevented from voting for candidates with strong popular support, as is the case of the President, political prisoner, Luiz Inacio “Lula’ Da Silva whose freedom we demand.”

“It is hidden that corruption prevails among conservative politicians, parliamentarians and politicians and in electoral systems, in corrupt laws and political models, by nature, based on money, on corporate ‘special interests.’”

“People are manipulated from private monopolistic property on media and technological platforms. In electoral campaigns, there are no ethical limits: hate, division, selfishness, slander, racism, xenophobia and lies are promoted; neo-fascist tendencies proliferate and walls are promised, militarization of borders, massive deportations, even of children born in the territory itself.”

“In the hemisphere, massive, flagrant and systematic violations of civil and political human rights are increasing; and economic, social and cultural rights of hundreds of millions of human beings.”

What democracy and values ​​are spoken of here? Of those of President Lincoln or the “dream” of Martin Luther King , that would elevate the American people to whom indissoluble bonds unite us ?, Or of those of Cutting and of the supposed “anti-system” extremist conservative?

“Cuba will not accept threats or blackmail from the government of the United States. We do not want confrontation, but we will not negotiate anything of our internal affairs, nor will we yield a millimeter in our principles. In defense of independence, the Revolution and Socialism, the Cuban people have shed their blood, assumed extraordinary sacrifices and the greatest risks.”

“The progress made in recent years [2014-2016], based on absolute sovereign equality and mutual respect, which are now reversed; They showed tangible results and that civilized coexistence, within the deep differences between governments, is possible and beneficial for both.”

“The [U.S.] blockade [embargo] and financial persecution harden, cause deprivation to our people and violate human rights, but the isolation of the US government throughout the world, in American society itself and in Cuban emigration also grows with respect to that genocidal policy, obsolete and unsuccessful.”

“The international rejection of the occupation of our territory in Guantánamo by the Naval Base and the detention and torture center located in it increases equally. [The U.S.] suffers total discredit [of] the pretext to reduce the staff of the Embassies and affect the right to travel of Cubans and Americans.”

“Next April 19, in the year 150 of our independence fights, with the constitution of a new National Assembly of the Popular Power will culminate the general elections. Cubans and Cubans, especially the youngest, closely linked to the Party of the nation, founded by Martí and Fidel; together with Raúl, we will commemorate the victory against the mercenary aggression of Playa Girón [Bay of Pigs], firm, confident and optimistic.”

Vice President Pence[4]

 On April 14, as the last scheduled speaker at the Summit, Vice President Mike Pence touched on many issues. He said the following about Cuba.

A ”tired communist regime continues to impoverish its people and deny their most fundamental rights in Cuba.  The Castro regime has systematically sapped the wealth of a great nation and stolen the lives of a proud people.  Our administration has taken decisive action to stand with the Cuban people, and stand up to their oppressors.”

“No longer will the United States fund Cuba’s military, security and intelligence services — the core of that despotic regime.  And the United States will continue to support the Cuban people as they stand and call for freedom.”

“But Cuba’s dictatorship has not only beset its own people, as we all well know — with few exceptions in this room acknowledging that.  Cuba’s dictators have also sought to export their failed ideology across the wider region.  And as we speak, they are aiding and abetting the corrupt dictatorship in Venezuela.”

Earlier Vice President Pence met with  Rosa María Payá, daughter of the late Cuban dissident Oswaldo Payá, who told him about Cuba Decide, a movement that promotes political change in Cuba through peaceful mobilization and the holding of a binding plebiscite whereby the Cuban people would decide their political system. Payá said, “What the Cuban people want is freedom, what the Cuban people want is to decide on another system.” Pence told her that he admires “enormously the courage” that her father had, “his commitment to freedom in Cuba” and her “courage” with her current “important work. ‘We are with you for the freedom of the Cuban people,’

Reply by Cuba Foreign Minister[5]

Invoking the right of reply, Cuba Foreign Minister Rodríguez had these additional comments on April 14.

“The Vice President of the [U.S.] seems ill-informed, ignores reality, hides the truth. I want to ask Mr. Pence directly if the Monroe Doctrine guides his government or not, in his policy toward Latin America. I want to respond with words from Bolívar: ‘The United States seems destined by Providence to plague America with miseries in the name of freedom.’ I want to quote Marti: ‘What I did up to now, and I will do, is to prevent the United States from spreading through the Antilles and falling with that force more on the lands of America.’”

“I reject the insulting references to Cuba and Venezuela and the humiliating attitude for Latin America and the Caribbean that [the U.S.] has assumed. The moral vacuum of the government of the [U.S.] cannot be, it is not a reference for Latin America and the Caribbean.”

“In the last 100 years they bear the responsibility for the most brutal abuses against human rights and human dignity. All the despotic governments in the region, all without exception, have been imposed or have received support from the government of the [U.S.], including the most cruel military dictatorships. Shameful acts like Operation Condor[6] or the bloody coup d’état in Chile[7] are about the conscience of North American governments.”

“Mr. Pence’s country has been the first and the only one to use the nuclear weapon against innocent civilians. It is responsible for criminal wars and hundreds and hundreds of thousands of deaths, massacres of civilians, including children, women and the elderly, which they call collateral damage. It is responsible for acts of torture, disappearances, extrajudicial executions and kidnappings.”

“The government of the [U.S.] is the author of massive, flagrant and systematic violations of the human rights of its own African-American citizens, of Hispanics, of migrants and of minorities. It is a shame for humanity that in this country of extreme wealth there are tens and tens of millions of poor people. They have a differentiated racial pattern in their prisons and the application of the death penalty is where most judicial errors associated with the execution of people occur; It is where students are killed by guns, whose lives were sacrificed to the imperative of political lobbying, particularly in Florida”

“The government of the [U.S.] has received tens and tens of millions of dollars from the arms lobby, and a Miami senator [Marco Rubio] has received no less than 3 million for the same concept. Miami is where the political mafias are, where confessed international terrorists take refuge and is also the place of the famous electoral fraud of the year 2000.”

“Mr. Pence has not said, when he talks about corruption, that his country is the center of the laundering of financial assets of drug trafficking and the smuggling of arms to the south that destabilizes entire countries. The electoral system that has elected him and the legislature, in which he has served for a long time, is corrupt by nature, because it is supported in an unusually legal way in corporate financial contributions and the so-called Political Action Committees.”

“It is the [U.S.] government that imposes a fierce protectionism, which does not take into account that it will ruin industry, agriculture and employment throughout our region. It is where the political lobby has imposed the idea that climate change is an anti-American invention. It is the political and electoral system where there has been scandalous traffic with the private data of tens of millions of its citizens.”

“If [the U.S.] government were interested in the well-being, human rights and self-determination of Cubans, it could lift the blockade, collaborate with our international cooperation, instead of sabotaging it, and give funds to Cuban medical collaboration programs in the world and literacy programs.”

Mr. Pence “has referred insultingly to Cuba. I respond with the text of the Proclamation of Latin America and the Caribbean as a Zone of Peace, signed in Havana by the Heads of State of Latin America and the Caribbean in 2014, whose principles include the inalienable right of peoples and States to freely give their own political, economic, social and cultural system.”  I also respond with a paragraph of the historical document signed at the time of this event, at the José Martí International Airport in Havana, by His Holiness Pope Francis and by His Holiness Patriarch Kirill . . .:’Our fraternal encounter has taken place in Cuba, at the crossroads between North and South, East and West. From this island, symbol of the hopes of the New World and of the dramatic events of 20th century history … ‘”

“We are a few hours away from the 57th anniversary of the [Bay of Pigs] bombing of US planes at airports in Cuba, in which Cubans died in defense of our independence and sovereignty, in whose farewell to duel the socialist character of the Cuban Revolution was proclaimed, and It is surprising that, f[after] so many decades, Vice President Pence has come here to use the same language that led governments of that time to carry out this terrible event.”

“The events that have taken place in recent years [2014-2016] show that coexistence between the United States and Cuba is possible, productive and can be civilized. For that, do not wait for him, nor the delegation that now occupies the seat that he has just left, for Cuba to give up one millimeter of its principles, nor cease in its efforts to build socialism.”

Conclusion

Unfortunately these verbal skirmishes are to be expected in the Age of Trump at gatherings like the Summit. Now we all will see whether this week’s election of Cuba’s new President of the Council of State will lead to any changes in at least the rhetoric between the two countries. Also unfortunately most observers, including this blogger, do not anticipate any immediate changes.

Cuba’s Unchanged Status in U.S. State Department’s Annual Report on Human Trafficking        

The U.S. Trafficking Victims Protection Act of 2000, among other things, establishes a definition of “human trafficking” and requires the Department of State to issue annual reports on such conduct in every country of the world.

The latest such report was issued on June 27, 2017.[1] Upon its issuance Secretary of State Rex Tillerson noted that the preamble to the Act states, “The purpose of this act is to combat trafficking in persons, a contemporary manifestation of slavery, whose victims are predominantly women and children, to ensure just and effective punishment of traffickers, and to protect the victims. As the 21st century begins, the degrading institution of slavery continues throughout the world.” Other remarks were provided by Ivanka Trump, Advisor to the President; and Susan Coppedge, Ambassador-at-Large, Office to Monitor and Combat Trafficking in Persons.[2]

Background

“The Department places each country in this Report onto one of four tiers, as mandated by the TVPA. This placement is based not on the size of the country’s problem but on the extent of governments’ efforts to meet the TVPA’s minimum standards for the elimination of human trafficking.”

The top tier (Tier 1) consists of “governments [according to the Department’s judgment that] fully meet the [Act’s] . . . minimum standards.” However, that ranking “does not mean that a country has no human trafficking problem or that it is doing enough to address the problem. Rather, a Tier 1 ranking indicates that a government has acknowledged the existence of human trafficking, has made efforts to address the problem, and meets the TVPA’s minimum standards. Each year, governments need to demonstrate appreciable progress in combating trafficking to maintain a Tier 1 ranking. Indeed, Tier 1 represents a responsibility rather than a reprieve. A country is never finished with the job of fighting trafficking.” The latest report has 36 countries, including the U.S., in Tier 1.

Tier 2 consists of those countries “whose governments do not fully meet the TVPA’s minimum standards, but are making significant efforts to meet those standards.” For the latest report 80 countries were placed in Tier 2.

Tier 2 Watch List this year has 68 countries, including Cuba, “whose governments do not fully comply with the TVPA’s minimum standards, but are making significant efforts to bring themselves into compliance with those standards AND: (a) the absolute number of victims of severe forms of trafficking is very significant or is significantly increasing; (b) there is a failure to provide evidence of increasing efforts to combat severe forms of trafficking in persons from the previous year; or (c) the determination that a country is making significant efforts to bring itself into compliance with minimum standards was focused on commitments by the country to take additional future steps over the next year.”

Tier 3 this year has 23 “countries whose governments do not fully comply with the minimum standards and are not making significant efforts to do so. There also are 3 countries that are not ranked and instead labeled as Special Cases.

In 2015 there was criticism by some senators about that year’s upgrading of Cuba and Malaysia. Subsequently that same year the previously mentioned State Department Office agreed to brief the Senate Foreign Relations Committee prior to releasing future reports in an effort to prevent any inappropriate influence over the country rankings recommended by the TIP office. As a result on June 21, 2017, Ambassador Coppedge did just that.[3]

Report Regarding Cuba

“The Government of Cuba does not fully meet the minimum standards for the elimination of trafficking; however, it is making significant efforts to do so. The government demonstrated significant efforts during the reporting period by prosecuting and convicting sex traffickers; providing services to sex trafficking victims; releasing a written report on its antitrafficking efforts; and coordinating anti-trafficking efforts across government ministries. In addition, the government investigated indicators of trafficking exhibited by foreign labor brokers recruiting Cuban citizens. However, the government did not demonstrate increasing efforts compared to the previous reporting period. The penal code does not criminalize all forms of human trafficking. The government did not prohibit forced labor, report efforts to prevent forced labor domestically, or recognize forced labor as a possible issue affecting its nationals in medical missions abroad. Because the government has devoted sufficient resources to a written plan that, if implemented, would constitute significant efforts to meet the minimum standards, Cuba was granted a waiver per the Trafficking Victims Protection Act from an otherwise required downgrade to Tier 3. Therefore, Cuba is placed on Tier 2 Watch List for the third consecutive year.”

The Report then goes on to provide the State Department’s recommendations for Cuba; assessments of the island’s prosecution, protection and prevention of trafficking; and its Trafficking Profile.

Reactions[4]

On July 13, the Senate Foreign Relations Committee held a hearing on the 2017 report with testimony from Deputy Secretary of State John Sullivan, whose opening statement did not mention Cuba, and from Ambassador Coppedge. [5]

The statement on the new report from Senator Robert Menendez (Dem., NJ), a Cuban-American, merely referenced a bill he had introduced to reform the State Department’s process for publishing its annual TIP reports, and re-published his statement about the 2015 report that criticized its granting a waiver to downgrading Cuba.

Surprisingly Senator Marco Rubio (Rep., FL), another Cuban-American and a fierce critic of the “promotion” of Cuba to Tier 2 Watch List in 2015, issued a statement about the latest trafficking report that said nothing about Cuba’s continued placement in that category.

Earlier in 2017 Senator Menendez along with cosponsors Senators Rubio, Tim Kaine (Dem., VA), Cory Gardner (Rep., CO), Rob Portman (Rep., OH) and Christopher Coons (Dem., DE) introduced the Trafficking in Persons Report Integrity Act  (S.377), which would reform the State Department’s annual trafficking reports. The press release by Rubio said the bill was prompted in part by “The past two TIP reports . . . [containing] unwarranted, politically-driven upgrades of countries with deplorable human trafficking records, like Cuba and Malaysia.”[6] However, as of August 15, 2017, no actions had been taken on the bill.

Senate Confirms Nomination of Rex Tillerson as Secretary of State

On January 23 the Senate Foreign Relations Committee by a straight party-line vote, 11 to 10, approved the nomination of Rex Tillerson to be Secretary of State. [1]  On February 1 the full Senate did the same, 56 to 43, which was the largest negative vote for confirmation for this position in the Senate’s history. [2]

Senate Foreign Relations Committee

Senator Bob Corker (Rep., TN), the Chair of the Committee, said the following:[3]=

  • “I personally have no doubt that Rex Tillerson is well-qualified. He’s managed the world’s eighth largest company by revenue with over 75,000 employees. Diplomacy has been a critical component of his positions in the past, and he has shown himself to be an exceptionally able and successful negotiator who has maintained deep relationships around the world.”
  • “The other absolute standard we apply to each of these nominees who come before us is to ensure they have no conflicts of interest related to their position.”
  • “The non-partisan director of the Office of Government Ethics (OGE) recently stated that Mr. Tillerson is making ‘a clean break’ from Exxon and is free of these conflicts. He has even gone so far to say that Mr. Tillerson’s ethics agreement ‘serves as a sterling model for what we would like to see from other nominees. He clearly recognizes that public service sometimes comes at a cost.’”
  • “I believe inquiries into Mr. Tillerson’s nomination have been fair and exhaustive. His hearing lasted over eight hours, and he’s responded to over 1,000 questions for the record. I’m proud of the bipartisan process, which is in keeping of the tradition of this committee that we pursued this, regarding his nomination, and I think that while our opinions and votes today may differ, that the process has been very sound.”

Senator Benjamin Cardin (Dem., RI), voting against confirming this nomination, said the following:[4]

  • “I believe Mr. Tillerson’s demonstrated business orientation and his responses to questions during the confirmation hearing could compromise his ability as Secretary of State to forcefully promote the values and ideals that have defined our country and our leading role in the world for more than 200 years. I will therefore not be supporting his nomination with my vote in Committee or on the Senate floor.”
  • “The United States plays a unique and exceptional role in world affairs.  Our values are our interests, as I said at Mr. Tillerson’s hearing. And our leadership in supporting democracy, universal human rights, unencumbered civil society, and unabridged press and religious freedoms is indispensable if these ideas and ideals are to be real and tangible in the world.”
  • “Mr. Tillerson equivocated on these self-evident truths under direct questioning, repeatedly prioritizing narrow business interests ahead of these core national security interests.  The power of the Secretary of State to call out wrong, to name and shame, and to fight each day on behalf of the American people and freedom-seeking people the world over is an enduring symbol to the oppressed and the vulnerable that the United States has their back.”
  • “Mr. Tillerson was unwilling to characterize Russia and Syria’s atrocities as war crimes, or Philippine President Duterte’s extrajudicial killings as gross human rights violations. And he was not willing to dismiss with unqualified clarity a registry for any ethnic or religious group of Americans.”
  • “I also believe Mr. Tillerson misled the Committee regarding his knowledge of ExxonMobil’s [well documented] lobbying on U.S. sanctions [against “some of the worst human rights abusers in the world such as Sudan, Syria, and Iran”]. Additionally, ExxonMobil’s stance on U.S. sanctions against Russia for their illegal invasion and annexation of Crimea, Ukraine in 2014 was well known at the time . . . . This is why it is particularly concerning that Mr. Tillerson indicated during questioning that he was not willing to recuse himself from matters relevant to ExxonMobil for the entire duration of his term.”
  • “While I was pleased that Mr. Tillerson said that he would support the laws I have written to hold accountable human rights abusers globally and in Russia specifically, and that America should have a seat at the table when discussing climate change with the international community, merely being willing to uphold the law or being willing to participate in global diplomacy are simply the necessary prerequisites for the job, not sufficient cause for confirmation.”
  • “On Russia more broadly, I am concerned as to whether Mr. Tillerson would counsel President Trump to keep current sanctions in place. . . . He showed little interest in advancing the new Russia sanctions legislation I’ve introduced with Senator McCain and colleagues on both sides of the aisle. Russia attacked us through cyber warfare and has committed even greater atrocities in Ukraine, Syria, and Eastern Europe. They must be held accountable and our bipartisan legislation is an important tool to do so.”
  • “Strangely, he was quick to caution about easing sanctions on Cuba because it would benefit a repressive regime, but seemed indifferent to doing business with Russia knowing that that business helped finance their ongoing violations of international norms.”
  • “Finally, America deserves a Secretary of State who will take advantage of every smart power tool in America’s diplomatic arsenal before recommending the use of force. I was therefore disturbed when Mr. Tillerson signaled during the hearing he would have recommended using force sooner when asked about real-world scenarios. The Secretary of State must be the consistent voice in any Administration that ensures the President has exhausted all diplomatic efforts before we put our brave men and women in uniform in harm’s way.”

Senate Debate and Vote

During the debate, supporters stressed Tillerson’s qualifications and the importance of confirming the president’s choice or this important position.

The affirmative vote of 56 was recorded by all 52 Republican senators plus three Democrats (Heitkamp (ND), Manchin (WV) and Warner (VA)) and Independent King (ME).

The negative vote of 43 was registered by  the other 42 Democrat senators and Independent Sanders (VT).

Conclusion

In the meantime, there have been at least four major developments linked to the future role of the State Department and its new Secretary.

First, a White House post, “America First Foreign Policy,” has no specific references to Cuba. But it does have this helpful general statement: In “pursuing a foreign policy based on American interests, we will embrace diplomacy. The world must know that we do not go abroad in search of enemies, that we are always happy when old enemies become friends, and when old friends become allies.”

Second, the White House has informed at least 13 career Foreign Service officers in charge of the State Department’s bureaus responsible for policy, security and other matters that they will not be retained in those positions. A Department spokesman said, “These positions are political appointments, and require the president to nominate and the Senate to confirm them in these roles. They are not career appointments, but of limited term.” However, as Nicholas Burns, former under secretary of state for political affairs during the George W. Bush administration and a longtime diplomat, said, “Normally the outgoing person would stay in the job until his or her successor is confirmed. What you don’t want to have is a vacuum without senior leadership.”[5]

Third, the Trump Administration on January 27 issued an executive order banning admission into the U.S. of all refugees worldwide and all immigrants from seven states with majority-Muslim populations while simultaneously welcoming Christian immigrants from those same countries. This immediately prompted lawsuits in federal courts across the country with a federal court in Seattle on February 3 issuing a temporary restraining order against implementation of the executive order and the U.S. Court of Appeals for the Ninth Circuit the next morning denying the Government’s motion to stay the lower court’s order.[6]

Fourth, in another immediate reaction to that executive order, over 900 State Department diplomats prepared and submitted a dissent cable objecting to that same executive order because of its impact on “green card holders, visa holders, visa seekers, the young, the old, and the sick.” [7]

On the periphery perhaps of the above turmoil is whether the Trump Administration will abandon or alter the Obama Administration’s pursuit of normalisation of relations with Cuba. As noted in a prior post, the Administration recently stated it has commenced an overall review of U.S. policies regarding Cuba, which in the abstract sounds like a reasonable thing to do. Previous statements by President Trump and Mr. Tillerson, however, suggest that a significant retreat is on its way, a development that would be very troubling to this blogger and other supporters of normalisation.[8]

Rex Tillerson, Secretary of State Nominee, Provides Written Responses Regarding Cuba to Senate Foreign Relations Committee

On or before January 20 Rex Tillerson provided written responses to questions from the Senate Foreign Relations Committee that is considering his nomination to be Secretary of State.[1] Here we will look at those responses regarding U.S. policies regarding Cuba.

Tillerson’s Responses Regarding Cuba

Many of his responses were “Yes, if I am confirmed” and are not understandable without the question. The following are his responses regarding U.S. policies regarding Cuba [with portions of the questions inserted in brackets to make the answers more understandable]:

  • “If confirmed, I will engage with Cuba but continue to press for reform of its oppressive regime. I will support human rights defenders and democracy activists in Cuba, empower civil society, defend freedom of expression, and promote improved Internet access and I will ask our allies to do the same.”
  • “Yes, if I am confirmed, [I will continue to support programs that promote democratic voices and initiatives in Cuba like Radio and TV Marti].”
  • “If confirmed, I will engage bilaterally and multilaterally to bring these fugitives [like New Jersey cop-killer Joanne Chesimard] to justice.”
  • “Yes, if I am confirmed, [I work with the Treasury Department to ensure that no revenue from American businesses goes directly toward supporting the Cuban military and the regime].”
  • “If confirmed, I will press Cuba to meet its pledge to become more democratic and consider placing conditions on trade or travel policies to motivate the release of political prisoners.”
  • “I will work bilaterally and multilaterally to identify training and technical assistance opportunities to assist with judicial reform, if I am confirmed.”
  • “Yes, [I will stand by President-elect Trump’s commitment to reverse the Obama Administration’s Cuba regulations until freedoms are restored on the island]. There will be a comprehensive review of current policies and executive orders regarding Cuba to determine how best to pressure Cuba to respect human rights and promote democratic changes.”
  • “Yes, [I will stand by Vice President-Elect Pence’s commitment to reverse the Obama Administration’s Cuba regulations].”

Conclusion

Perhaps not too surprisingly, these responses do not add much clarity on the new administration’s policies regarding Cuba. As he said in his live testimony to the Committee and in these written responses, there are hints that the new administration will change at least some aspects of the Obama Administration’s policies to normalize relations with Cuba. But first there will be “a comprehensive review of current policies and executive orders regarding Cuba to determine how best to pressure Cuba to respect human rights and promote democratic changes.”

Those of us who support normalization need to be on guard and register our objections to any proposed retreat from that important, positive development for the U.S. and Cuba and indeed all of Latin America.

Secretary of State-Nominee Rex Tillerson Addresses U.S. Policies Regarding Cuba

In his opening statement at the January 11 Senate Foreign Relations Committee hearing on his nomination, Secretary of State Nominee Rex Tillerson made the following comments about U.S. policies regarding Cuba:[1]

  • “And we must adhere to standards of accountability. Our recent engagement with the government of Cuba was not accompanied by any significant concessions on human rights. We have not held them accountable for their conduct. Their leaders received much, while their people received little. That serves neither the interest of Cubans or Americans.”

Later in response to questions by Senator Marco Rubio (Rep., FL), a Cuban-American and a noted opponent of normalization, Tillerson said he would advise the president to veto any legislation codifying President Obama’s thaw with Cuba, at least until the Trump administration can conduct its own review of that policy. In addition, Tillerson said the current U.S. normalization policy has not benefited most Cubans.

Tillerson specifically added that he would also advise Trump to veto any measures to lift the Cuban embargo, and “examine carefully the criteria” under which Cuba was taken off the list of state sponsors of terrorism, to determine “whether or not that de-listing was appropriate.”

Tillerson did not commit to indefinitely maintaining the above positions, instead deferring to the results of the new administration’s forthcoming review to determine its long-term Cuba policy.

Tillerson underscored that the United States “cannot ignore the law” and must comply with measures such as the Helms-Burton Act, which codified the embargo in 1996, and stated that economic restrictions must remain in force until the Cuban government complies with certain conditions, among them that the Castro family leaves power. Any modification of that legal basis on the policy toward Cuba “should be done by Congress,” according to Tillerson, who committed to strictly enforcing the law.[2]

The obvious follow-up question that I believe was not asked is whether one of the objectives of the promised review of U.S. policies regarding the island will be recommending changes to relevant statutes.

Responding to a question by Senator Robert Menendez (Dem., NJ), a Cuban-American opposed to normalization, Tillerson said that advancing human rights and democracy in Cuba and returning to justice U.S. fugitives like Joanne Chesimard, convicted of aiding and abetting the murder of a New Jersey State Trooper, would be a condition of any further engagement with Cuba.

Conclusion

This hearing was bad news and good news for advocates of normalization like this blogger.

The good news is Tillerson’s prediction that the new administration will conduct a review of existing U.S. policies regarding Cuba before making any changes in them.As previoulsy stated, this review should include recommendations to Congress for changes in existing statutes on the subject.

The bad news is the series of suggestions that many of the normalization policies will be cancelled.

Although I agree that so far Cuba has not made significant concessions on human rights, I disagree with the implicit conclusion from this statement: the U.S. needs to demand Cuban concessions on human rights as a condition for the U.S. making any further economic “concessions” to the island. This is the policy that was followed for over 50 years before December 17, 2014, without the desired result.

I also disagree with his prospective recommendation of a veto of any legislation ending the U.S. embargo of Cuba. In addition, I reject his implication that the U.S. May 2015 rescission of its designation of Cuba as a “state sponsor of terrorism” was not justified. As explained in earlier posts, the embargo is unjustified and counterproductive for the U.S. while  previous “terrorism” designations were ridiculous and unjustified and the rescission was fully consistent with the law and the facts and was implicitly endorsed by Congress’ failure to approve a joint resolution countermanding the rescission. [3]

Finally I disagree with Tillerson’s testimony that the Cuban “people have received little” from U.S.-Cuba engagement or normalization. As previously stated in various posts, the increased remittances from families and friends in the U.S. to others in Cuba, all made possible by the Obama Administration’s loosening of U.S. restrictions, have been a major source of funding for the expansion of family-owned businesses on the island. That expansion has helped to reduce the portion of the Cuban economy controlled by state-owned enterprises and has increased the income and well being of Cuban entrepreneurs and their employees, who are and will be a significant force for further modification of the Cuban economic and political system.[4]

The Future of U.S.-Cuba Normalization Under The Trump Administration

Many U.S. citizens who welcomed the last two years of U.S.-Cuba normalization are worried about whether that policy will be continued by the future Trump Administration. Therefore, examination of past comments about Cuba by prospective members of that future administration is appropriate. Here is such an examination.

A prior post recounted the responses to the death of Fidel Castro from President-elect Donald Trump, Vice President-elect Mike Pence, prospective White House Chief of Staff Reince Priebus and Trump aides Kellyanne Conway and Jason Miller. The basic conclusion of their remarks was that Mr. Trump would be seeking a better deal with Cuba than the Obama Administration had negotiated.

More recently, at a December 16 “thank You” rally in Orlando, Florida, Trump told the crowd, “America will also stand with the Cuban people in their long struggle for freedom. Their support has been unbelievable. The Cuban people. We know what we have to do, and we’ll do it. Don’t worry about it.”[1]

Additional negative views about U.S.-Cuba rapprochement are found in comments by others in the prospective Trump Administration.

The most negative words came from Cuban-American Mauricio Claver-Carone, transition team member for the Department of the Treasury. After the election in an op-ed article in the Miami-Herald he argued,“Obama’s new course for Cuba has made a bad situation worse.” It concluded with this statement: “There’s no longer any rational strategy behind President Obama’s ‘Cuba policy.’ It has gone from what it initially portrayed as a noble purpose to pure sycophancy in pursuit of ‘historic firsts. Unfortunately, those Cuban dissidents who recognized Obama’s intent from the beginning and labeled it ‘a betrayal’ of their fight for freedom have now been proven correct. Their foresight has come at a terrible cost.”[2]

A similar hostile analysis of rapprochement come from Mike Pompeo, a Congressman from Kansas and the nominee for Director of the CIA.[3] Here are two examples. Immediately after the December 17, 2014, news of the release of Alan Gross from Cuban prison, Pompeo said, “Unfortunately, the Obama Administration has once again taken the opportunity to appease America’s enemies by releasing convicted spies, reviewing Cuba’s designation as a State Sponsor of Terror, and attempting to re-establish diplomatic relations with the Castro regime. In March 2016 Pompeo said, Obama’s trip to Cuba was “misguided for the flawed Cuba policy it represents,” including the dropping “ Cuba from the State Sponsors of Terrorism list, . . . [loosening] sanctions, and . . . [opening] a U.S. Embassy in Havana while there has been zero needed political reform, no increase in freedom, and inadequate loosening of Castro’s grip on power.”

General Michael Flynn, the proposed White House National Security Advisor, sees Cuba as an enemy. Promoting a book he co-authored (The Field of Fight), Flynn stated his belief that the U.S. is in “a global war, facing an enemy alliance that runs from Pyongyang, North Korea, to Havana, Cuba, and Caracas, Venezuela. Along the way, the alliance picks up radical Muslim countries and organizations such as Iran, al Qaeda, the Taliban and Islamic State.” (Emphasis added.) Another Kelly article says the world is divided into two sets of enemies. First, there are the radical Islamists, whom he sees as America’s principal foes. Then there is a constellation of hostile anti-democratic regimes that he calls “the alliance” that includes both Islamists and non-Islamists that collaborate against the West because we’re their common enemy. The alliance includes Russia, Syria, North Korea, China, Iran, Cuba, Bolivia, Venezuela and Nicaragua.” (Emphasis added.) [4]

Trump’s nominee for Secretary of State, Rex Tillerson, however, has not expressed an opinion on U.S.-Cuba relations. Only tangential clues turn up. [5] For example, Tillerson has negotiated multi-billion dollar deals with Putin and Kremlin-confidant Igor Sechin, the head of a Russian state-owned oil company who has negotiated oil deals with Cuba. But at ExxonMobil’s May 2014 annual stockholders’ meeting, Tillerson said the company had no plans to participate in Cuban deposits development by Russian oil major Rosneft because of U.S. sanctions against Cuba.

Guardedly positive comments about Cuba have been made by General John Kelly, the nominee for Secretary of Homeland Security, who recently served as the U.S. military’s Commander of the Southern Command with responsibility for the detention facility at Guantanamo Bay. Last January Cuba was a first-time participant in the Caribbean Nations Security Conference, when Kelly said, “We’ve normalized now and, regardless of how we think of each other in terms of politics, we have very, very common challenges.” Kelly also said that the Naval station at Guantanamo Bay is “strategically valuable” and should remain open after the detention facility is closed and possibly jointly operated with Cuba employing Cubans. At an earlier Pentagon briefing he said, “the Guantanamo Naval Base is a hugely useful facility to the United States.”

In an October 2015 interview, Kelly said that the U.S. “Coast Guard has worked with the Cubans over the years, but mostly in terms of rescue-at-sea and humanitarian activities. But the other four services – Army, Navy, Air Force, and Marines – have had zero relationships with the Cubans. There is a meeting called the “fence-line meeting” at Guantánamo where the Base Commander, a U.S. Navy Captain, meets about weekly with a counterpart on the other side. They talk and chat a little bit, but it’s not much of a relationship.’ In addition, “There are no drugs in Cuba.” [6]

As Kelly neared retirement as Commander of the Southern Command in January 2016, he said, “What tends to bother [terrorist groups and rights activists] . . . is the fact that we’re holding them [at Gitmo] indefinitely without trial … it’s not the point that it’s Gitmo. If we send them, say, to a facility in the U.S., we’re still holding them without trial.” If “ it were agreed Guantanamo should be closed, logistically it wouldn’t be hard, and remaining detainees could be held in the U.S.— “They’re not going to escape, for sure.”

One advocate for rapprochement in the Trump team is (or has been?) Kathleen (K.T.) McFarland, named as Deputy National Security Advisor. She has publicly backed open relations with Cuba. In 2014, she wrote “We must take steps now to ensure that Cuba doesn’t become a Russian or Chinese pawn, and thus serve as a launch pad to threaten America’s security were they to establish a military presence.” [7]

Basic Internet searches about the following members of Trump’s team failed to find any comments about Cuba: General James Mathis (Secretary of Defense), Vincent Viola (Secretary of the Army), Steven Mnuchin (Secretary of the Treasury), Wilbur Ross (Secretary of Commerce), Todd Ricketts (Deputy Secretary of Commerce), Nikki Haley (U.N. Ambassador) and Jeff Sessions (Attorney General).[8]

Conclusion

The above analysis of commentaries by members of the Trump team regrettably suggests a dim future for continuation of normalization of U.S.-Cuba relations. Those of us in the U.S. who believe that this is an erroneous move need to continue to advocate for normalization and to share that opinion with our Senators and Representatives, the Trump Administration and our fellow U.S. citizens.
